Thank you , Leslie Peterson mmvrlica. + ions 202 ) onk 3 / 4. 4 /2t pL, 13000 Attn: Weld County Commissioners Re: Weld County Case USR 20-0038 Rodeo and Roping Arena I was at the Public Hearing of the Planning Commission on March 2nd, 2021 and was very disappointed in the attitude of the Planning Commission and their lack of knowledge of the area in question. I am hoping to provide additional details regarding the area around the property that Ms. Billings Barton owns on County Road 53 and County Road 48 in Kersey that she has left out of her presentation. The first item I would like to address is the location of the property that Ms. Billings Barton is representing as "her property". There are basically 2 ways to get to The Barton Land and Cattle Arena on County Road 53 in Kersey that Ms. Billings Barton is requesting the USR be reinstated for: FROM THE NORTH Option 1: South on County Road 53, a 2 lane County Road approximately 4.25 miles South of Highway 34 FROM EITHER DIRECTION Option 2: Weld County Road 49/ Weld County Parkway to County Road 48 East on County Road 48 - a dirt road - to County Road 53. South on County Road 53 approximately a quarter of a mile to the Barton Land And Cattle Driveway. COUNTY ROAD 53 AND COUNTY ROAD 48 are 2 LANE COUNTY ROADS. Both Roads have burrow pits on each side of the road, there is NOT an emergency lane, bicycle lane or any other city feature. Per the traffic study, the average speed on County Road 53 is over 65mph. The closest traffic signal is approximately 41/z miles North of the property at Highway 34 and County Rd. 53. There is a 2 way stop sign on County Road 48 and County Road 53. The Major Roads around Barton Land and Cattle Arena would be: To the North Highway 34 To the South County Road 44 To the West County Road 49 / Weld County Parkway To the East County Road 53 • The only traffic signs/signals on County Road 53 from Highway 34 on the North and County Road 44 on the South are: o Going South: 2 way stop sign on County Road 53 at County Road 44 o Going North: Stop Light at Highway 34 When discussing the location of the Barton Land and Cattle Arena, Ms. Billings Barton and Mr. Hall like to refer to the property as ADJACENT TO County Road 53 and County Road 48. The pictures used in the presentation show the property with a SINGLE LANE dirt driveway going up to the west with a Work Over Rig in a pasture as part of "her" property. The SINGLE LANE dirt driveway is on the Barton property, the Work Over Rig is NOT on the Barton property. The well is on the Barton property, however Ms. Billings Barton would not allow the Work Over Equipment to be set up on her property, so they had to be set up on the adjacent property as seen in the picture. While it is true that Ms. Billings Barton does own 50 plus acres, her property is surrounded by houses. She does NOT own any of the other houses around her property. All of the houses on County Road 48 share her North fence line. • There is a 5 acre plot on the corner of County Road 48 and County Road 53. o The pictures in her presentation show a Work Over Rig in the pasture of this property. o Ms. Billings Barton does NOT own this property. o This is the only property that shares the driveway fence line during the SINGLE LANE PORTION OF MS. BILLINGS BARTON'S DRIVE WAY • Going West on County Road 48 are 3 more residents that back to Ms. Billings Barton property North fence line. • The 4th house to the west on County Road 48 is Elaine Braswell. She shares Ms. Billings Barton's West fence line and a pond. There is also an access road to the North West section of Ms. Billings Barton's property which is beside Braswell's house. Per Ms. Billings Barton, Mr. Barton has built an Equipment Shed on the property in this area. I'm not sure how the fence line goes and if there are other neighbors on the west fence line. Going South on County Road 53 past Ms. Billings Barton's driveway, to her South fence line, is one house. From my understanding at the Planning Commission Hearing, Ms. Winter has owned this house for over 20 years. Ms. Winters house is the closest house to the Arena in question. Directly East of Barton Land and Cattle Arena is a hay field as I am not sure where Ms. Billings Barton's West fence line ends, I am not sure what is across from it. SUMMARY OF PLANNING COMMISSION MEETING: Per Ms. Billings Barton's own testimony: • She signed the paperwork to VACATE the USR in error (According to Ms. Billings Barton, she did not know that she was signing the paperwork for the arena in question and thought it had something to do with the property that they sold off as a bird watching property.) • She wants to continue to use the property in the same manner that it has always been used in. • She doesn't want to do anything different than "Mr. Nelson did with arena" and that she is applying to have the same USR that "Mr. Nelson" had and wants to do the same things that has always been done at the arena • Her ideal event will have: o At least 1 food truck o Expecting that there would be approximately 50 -barrel racers at a time at the arena o Expecting the Producers to run the Barrel Race under the same Covid Restrictions that they ran their May 16th, 2020 race under. Resulting in Contestants driving up and down the driveway all day, producing additional dust and traffic ■ During this Barrel Race the contestants had to come to the race in groups of 20, warm their horses up, make their run, cool their horses down and leave so the next group of 20 could arrive. • This resulted in trailers going in and out of the property all day. • She wants to continue to promote the Ag Industry of Weld County. • From my understanding during Ms. Winter's presentation at the Weld County Planning Commission meeting she has owned her home for over 20 years, her daughters currently live in the home with their father. (Ms. Winter's ex-husband) Ms. Winter is remarried, lives in Windsor (still a Weld County Resident). • Ms. Winter was there to present her concerns as the homeowner and the Parent of the residents of the home in Kersey. • Per Ms. Billings Barton's own admission, she does not live at the residence where the Arena is located and where she is trying to get the USR re instated. • Ms. Billings Barton's youngest daughter, Brian Barton's Step Daughter, Sydney Schleik resides at the residence. • The Weld County Planning Commission and Ms. Billings Barton were very disrespectful to Ms. Winter when she presented her information and concerns regarding the USR and were not going to take her concerns into consideration because she did not live at the residence on County Road 53. • I'm not sure what the difference is since Ms. Billings Barton does not live at the residence on County Road 53 either. • Ms. Billings Barton's very last statement was: 'IF THEY STOP THIS I WILL PUT 500 COWS IN THERE INSTEAD" Concerns brought up at Planning Commission Hearing on March 2nd: CONCERN 1: Ms. Billings Barton continued to state that she wanted to continue what has alzvays been done at the arena and not do anything differently. o This statement is very confusing and misleading. o The only events held at this arena in the past 11 years have been since Ms. Billings Barton purchased the property. o Ms. Billings Barton continued to refer to the previous owner as "Mr. Nelson" o Charlie Carter lived in this home until Ms. Billings Barton purchased it approximately 2 years ago. Ms. Billings Barton stated that True West Productions would be producing the Barrel Races. • Per True West Productions FaceBook Post dated February 2nd and March 12th 2021 the following dates are already scheduled for the 2021 Season at the Barton Land and Cattle Arena, copy attached: May 8th and 9th June 12th and 13th July 10th and 11th July 24th and 25th CONCERN 2 The Weld County Planning Commission also suggested approving the USR with the removal of the following stipulations: • Veterinarian on Site • Ambulance on Site • Security on Site This is a source of concern not only for the safety of the event, but also for the safety of the neighbors. o Most people who are competing in events like this are capable of taking care of the basic needs if something was to happen to their animal o The new fire department is only 41/2 miles North of the arena, so if something was to happen, Emergency Personal would be able to arrive quickly. o However, removing the requirement for Security is concerning ■ Horse Trailers are stolen all the time ■ Trucks are stolen all the time ■ Tack is stolen from events more than ever before ■ The event is being held at a personal property not a commercial property ■ There are 6 houses surrounding the arena, not counting all the other properties along County Rd 48 or County Rd 53 CONCERN 3 Ms. Billings Barton's Driveway As you can see in the pictures: SINGLE LANE DIRT DRIVEWAY • ONLY ROOM FOR ONE TRUCK AND TRAILER • NOT WIDE ENOUGH FOR 2 TO PASS EACH OTHER I want to start out with that I really don't care what anyone does with their own property, as long as it does not negatively affect my family. My husband spoke at the Weld County Planning Commission and Ms. Billings Barton belittled him with her remarks. My husband is 100% disabled Veteran in Stage 4 Broncular COPD (not emphysema and not from smoking) He is required to wear oxygen 24/7. My husband brought up his concerns of the extra dust from the trucks, trailers and event. As well as the contestants using our yard as a turn around. • We are the 5 acre corner lot on the corner of County Road 48 and County 53 and we have an entrance into our house from both county roads. • Our Driveway becomes the turnaround when people miss their turn previously to Mr. Carter's and now to the Barton's The Planning Commission confirmed that there will be a Road Maintenance Agreement between Ms. Billings Barton and the County to help mitigate the dust on County Road 48, however, this does nothing for the dust issue that will arise from the event in the arena as well as the traffic going up and down their driveway for the event. The dust from the Events in the Arena will affect all of the houses that directly border the property. The property that will be affected most from the Events in the Arena will be Ms. Winters property to the South of the Arena. The landscape of the area will change with each event as the arena is groomed prior to the event then re worked during the event This will directly affect Ms. Winters as the flow of the dirt will go directly towards her home. I am the North fence line of the drive way, and the way their drive is set up, if 2 trucks need to pass each other, one of the trucks will need to veer over to the North. This could result into someone hitting my fence. I currently have a 5 wire barb wire fence on t post which if hit by a truck and trailer won't cause much damage to their truck, but would take out my fence. Who is going to be responsible for repairing this? • The contestant that hit the fence? • The Event Producers? • Barton Land and Cattle? • Me... • I need to have gates made for both of the entrances into my yard to keep the additional traffic out whether it is a wrong address for the event or a turn around to get back to the event. • I need to reinforce 152 feet of fence with 60 inch 4 x 214 guage welded fence with 4 inch wood posts to match the section that is already done. I now have ADDITIONAL expenses so Ms. Billings Barton CAN MAKE MONEY renting out her arena to True West Productions who will in turn MAKE MONEY from the contestants. Ms. Winter, who shares the South fence line with Ms. Billings Barton has an expense with her house being the closest to the arena. • There are not only the dust issues, but the noise issues, and dirt mitigation issues. o I don't know what they will do, but the IDEAL solution would be an ESTABLISHED LIVE FENCE LINE INSTALLED between the Arena fence on Ms. Billings Barton's side and Ms. Winters home. Ms. Billings Barton continues to state that she wants to continue with the same use that has always been done at the arena, if that is the case, that would be a private use arena and not an arena for HER MONITORAY GAIN at the EXPENSE OF HER NEIGHBORS. Ms. Billings Barton's last statement at the Planning Commission Meeting was if the USR is stopped she will put 500 cows on the property. She said this as a threat. This continues to show that she can marry into a Land and Cattle Family and still have no understanding of what a real AG Family is about. Ms. Billings Barton states that she wants to promote the Weld County Heritage and that adding an arena would do that...I'm not sure how many True AG Supporters would choose 20 days of 200 strangers at a new arena over 500 cows.
