Said division of land determined to be exempt from the definition of subdivision is more particularly described as follows: That part of the Northwest one-quarter of Section 23, Township 1 North, Range 68 West of the 6th P.M. , Weld County, Colorado, described as: Beginning at the North- west Corner sa d Section 23; thence N88°41'40"E on an assumed bearing along the North line said Northwest one- quarter a distance of 50.00 feet to the true point of beginning; thence continuing N 88°41'40"E along said North line a distance of 2592.28 feet to the Northeast corner said Northwest one-quarter; thence S00°16'12W along the East line said Northwest one-quarter a distance of 2669.50 feet to the Southeast corner said Northwest one-quarter; thence S89°11'30"W along the South line said Northwest one-quarter a distance of 2579.62 feet to a point 50.00 feet East of the Southwest corner said North- west one-quarter; thence N00°00'00"E parallel with the West line said Northwest one-quarter a distance of 2646.80 feet to the true point of beginning. GENERAL PROVISIONS • • FIRST: The Applicant represents all parties in interest, and affirms that the driveway approach(es) is to be constructed by him for the bona fide purpose of securing access to his property and not for the purpose of doing business or servicing vehicles on the highway right-of-way. - ,SECOND: The applicant shall furnish all labor and materials, perform all work, and pay all costs in connection with the construction of the driveway(s) and its appurtenances on the right-of-way. Secboo 2 At any intersection of a State Highway with another highway, road, or street, }where right-of-way has •. Intersection been acquired to provide sight distance, no driveway approach shall be permitted within the frontage - 'Clearance thereof. At any other intersection, a driveway shall be restricted for a sufficient distance from the intersection to preserve the normal and safe movement of traffic. (It is recommended for rural residence entrances that a minimum intersection clearance of 50 feet be provided and for rural commercial entrances a minimum of 100 feet be provided. Adjustment will be made according to the type of traffic to be served and othe{ physical conditions • Section 10 Permissible radii on driveway returns shall be governed by such factors as width of drive and angular Curb Return placement. Where the flared edge of an approach controls the turning radius of a vehicle entering a Radii property by a right turn from the adjacent outside traffic lane of the roadway, the radius of that edge shall be not less than twenty (20) feet where the approach is to be used by passenger cars and single unit trucks and not less than fifty (50) feet where all types of vehicles may be expected. Section 11 A safety island or buffer zone shall be constructed and maintained between adjoining driveway approaches Area Between to a State Highway. Size and shape of such restricted islands shall be determined according to existing Drive lot frontage, right-of-way depth, and angle of entry but a minimum length of ten (10) feet at the shoulder line shall be required for the island separator. Curbs or posts, or other suitable methods of island desig- nation and protection as approved by the Division, shall be provided to prevent vehicle parking and access in the restricted island area. Section 12 The construction of parking or servicing areas on the highway right-of-way is specifically prohibited. Parking Oft-the-road parking facilities should be provided by commercial establishments for customers' vehicles.
