RESOLUTION RE: APPROVE RESUBDIVISION, RES21-0005, OF LOTS 17, 18, 19, AND 20, BLOCK 12, AND PART OF VACATED LEONA AVENUE OF THE TOWN OF WATTENBERG, AND ASSOCIATED VACATION OF THE NORTH 30 FEET OF FREDERICK STREET RIGHT-OF-WAY, RESULTING IN ONE (1) LOT - KENNETH AND DANIELA PEREZ WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 17th day of November, 2021, at the hour of 9:00 a.m., in the Chambers of the Board, for the purpose of hearing the application of Kenneth and Daniela Perez, 11519 Frederick Street, Fort Lupton, Colorado 80621-7808, for a Resubdivision, RES21-0005, of Lots 17, 18, 19, and 20, Block 12, and part of vacated Leona Avenue of the Town of Wattenberg, and associated vacation of the north 30 feet of Frederick Street right-of-way, resulting in one (1) lot, on the following described real estate, being more particularly described as follows: Lots 17, 18, 19, and 20, Block 12, and that part of vacated Leona Avenue of Wattenberg Historic Townsite; being part of the NE1/4 of Section 25, Township 1 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing, the applicants were present, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicants and the recommendation of the Weld County Department of Planning Services and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. It is the opinion of the Department of Planning Services that the Resubdivision submittal has met the Overview and Standards, per Sections 24-9-10 and 24-9-20 of the Weld County Code, as amended. Pertinent processing information includes: A. Section 24-3-60.6 - Easement standards, states: "Twenty (20) feet minimum drainage and utility easements are required along internal lot lines and shall be apportioned equally on abutting properties, unless otherwise justified by the Utilities Coordinating Advisory Committee for technical purposes." A Utilities Coordinating Advisory Committee hearing was held on October 28, 2021. Staff recommended the following easement be created on the Resubdivision plat as a condition of approval. The Utilities Coordinating Advisory Committee agreed to this request by staff. The easement described in Section 24-3-60.6 of the Weld County Code will be the guidelines utilized for the creation of the easement on the subject property. This easement will be for the benefit of the Wattenberg Improvements Association and any other applicable wet and dry utilities. There is a condition of approval added to ensure that a 20 -foot -wide utility easement is created prior to recording the Resubdivision plat. c.c.: PLCmn/-rP), CacPB). APPL O3i0$/9D 2021-3217 PL2807 RESUBDIVISION, RES21-0005 — KENNETH AND DANIELA PEREZ PAGE 2 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Kenneth and Daniela Perez, for a Resubdivision, RES21-0005, of Lots 17, 18, 19, and 20, Block 12, and part of vacated Leona Avenue of the Town of Wattenberg, and associated vacation of the north 30 feet of Frederick Street right-of-way, resulting in one (1) lot, on the parcel of land described above, be, and hereby is, granted subject to the following conditions: 1. Prior to Recording the Resubdivision Plat: A. The plat shall be amended to delineate the following: 1) All sheets shall be labeled Resubdivision No. RES21-0005. 2) The plat shall be prepared per Section 24-9-50 of the Weld County Code. 3) The plat shall contain the certification blocks, per Appendix 24-E of the Weld County Code. Do not include the Appendix 24-E.E, being the "Department of Planning Services - Administrative Review Certificate of Approval". 4) The applicant shall show the lot lines being vacated with a dashed line type and show the new consolidated lot boundary with a heavy -weight line type. 5) The applicant shall show and label all recorded easements on the map by book and page number or reception number. The Utilities Coordinating Advisory Committee hearing was held on October 28, 2021. At the Utilities Coordinating Advisory Committee hearing it was determined to have easements follow Section 24-3-60.B of the Weld County Code and the easement will be for the benefit of all utilities, current and future. The vacation of Frederick Street shall include a reservation of easements for existing utilities, which shall be clearly shown on the plat. 6) The applicant shall show and label all recorded rights -of -way on the map by book and page number or reception number. 7) Frederick Street is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance #2017-01) as a local road, which requires 60 feet of right-of-way at full buildout. The applicant shall delineate and label the future and existing right-of-way (along with the documents creating the existing right-of-way) and the physical location of the road on the plat. If the existing right-of-way cannot be verified it shall be dedicated. The applicant shall also delineate the physical location of the roadway. Pursuant to the definition of setback in Section 23-1-90 of the Weld County Code, the required setback is measured from the future right-of-way line. This road is maintained by Weld County. 8) The applicant shall show and label the existing access points and the usage types (Agriculture, Residential, Commercial/Industrial, or Oil and 2021-3217 PL2807 RESUBDIVISION, RES21-0005 — KENNETH AND DANIELA PEREZ PAGE 3 Gas). Development Review will review access locations as a part of the plat submittal. B. The following notes shall be delineated on the Resubdivision Plat: 1) Resubdivision, RES21-0005, consolidates Lots 17, 18, 19, and 20, Block 12, and that part of vacated Leona Avenue of Wattenberg Historic Townsite and associated vacation of the north 30 feet of Frederick Street right-of-way resulting in one (1) lot. 2) Approval of this plan may create a Vested Property Right pursuant to Article 68 of Title 24, C.R.S., as amended, and Chapter 23, Article VIII of the Weld County Code. 3) Allowed uses in the Resubdivision consist of A (Agricultural) uses listed in Chapter 23, Article III, Division 1, Section 23-3-10 of the Weld County Code. 4) The Resubdivision shall comply with all the regulations and requirements of Chapter 24, Article IX of the Weld County Code. 5) Installation of utilities and requirements of the service providers shall comply with Section 24-3-60 of the Weld County Code. 6) Buildings and structures shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following have been adopted by Weld County: 2018 International Codes, 2018 International Energy Code, 2020 National Electrical Code, and Chapter 29 of the Weld County Code. A plan review shall be approved, and a permit must be issued prior to the start of construction. 7) A Floodplain Permit is required for any new construction in the floodplain. 8) No outdoor storage of floatable material is allowed in the floodplain. 9) A Flood Hazard Development Permit is required for all construction or development occurring in the floodplain or floodway, as delineated on Federal Emergency Management Agency (FEMA) FIRM Community Panel Map #08123C -2115F, dated September 17, 2020 (South Platte River). Any development shall comply with all applicable Weld County requirements, Colorado Water Conservation Board requirements as described in Rules and Regulations for Regulatory Floodplains in Colorado, and FEMA regulations and requirements as described in 44 CFR parts 59, 60, and 65. The FEMA definition of development is any man-made change to improved or unimproved real estate, including, but not limited to, buildings or other structures, mining, dredging, filling, grading, paving, excavation, drilling operations, or storage of equipment and materials. 2021-3217 PL2807 RESUBDIVISION, RES21-0005 - KENNETH AND DANIELA PEREZ PAGE 4 10) FEMA's floodplain boundaries may be updated at any time by FEMA. Prior to the start of any development activities, the owner should contact Weld County to determine if the floodplain boundaries have been modified. 11) The installation of any septic system within the 100 -year floodplain shall comply with the Weld County On -site Wastewater Treatment System (OWTS) Floodplain Policy. 12) Water service may be obtained from the Wattenberg Improvement Association. 13) The parcel is currently not served by a municipal sanitary sewer system. Sewage disposal may be by On -site Wastewater Treatment System (OWTS) designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division, and the Weld County Code in effect at the time of construction, repair, replacement, or modification of the system. 14) Activity or use on the surface of the ground over any part of the On -site Wastewater Treatment System (OWTS) must be restricted to that which shall allow the system to function as designed and which shall not contribute to compaction of the soil or to structural loading detrimental to the structural integrity or capability of the component to function as designed. 15) The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 16) Weld County will not replace overlapping easements located within existing rights -of -way or pay to relocate existing utilities within the existing County rights -of -way. 17) Access on the site shall be maintained to mitigate any impacts to the public road, including damages and/or off -site tracking. 18) Prior to the release of Building Permits, the applicant shall be required to submit a complete access application for a "preliminarily approved" access location as shown on this plat. 19) Any work that may occupy and/or encroach upon any County rights -of -way or easement shall acquire an approved Right -of -Way Use Permit prior to commencement. 20) The historical flow patterns and runoff amounts will be maintained on the site. 2021-3217 PL2807 RESUBDIVISION, RES21-0005 - KENNETH AND DANIELA PEREZ PAGE 5 21) HISTORIC TOWNSITE STATEMENT: Historic Townsites are an important part of Weld County's history, culture, and economy. These subdivisions were created in the late 19th and early 20th centuries. Persons moving into Historic Townsites must recognize and accept there are potential drawbacks in Historic Townsites that may not be present in modern subdivisions, including concerns related to stormwater drainage, water supply limitations, setbacks between wells and septic systems, road access, and road maintenance. Weld County does not maintain internal roads within Historic Townsites unless expressly authorized by Resolution of the Board of County Commissioners. 22) RIGHT TO EXTRACT MINERAL RESOURCES STATEMENT: Weld County has some of the most abundant mineral resources, including, but not limited to, sand and gravel, oil, natural gas, and coal. Under Title 34 of the Colorado Revised Statutes, minerals are vital resources because (a) the state's commercial mineral deposits are essential to the state's economy; (b) the populous counties of the state face a critical shortage of such deposits; and (c) such deposits should be extracted according to a rational plan, calculated to avoid waste of such deposits and cause the least practicable disruption of the ecology and quality of life of the citizens of the populous counties of the state. Mineral resource locations are widespread throughout the County and people moving into these areas must recognize the various impacts associated with this development. Oftentimes, mineral resource sites are fixed to their geographical and geophysical locations. Moreover, these resources are protected property rights and mineral owners should be afforded the opportunity to extract the mineral resource. 23) The Weld County Right to Farm Statement, as it appears in Section 22-2-30.A.4.a of the Weld County Code, shall be placed on the map and recognized at all times. 2. The applicant shall submit one (1) electronic copy (.pdf) of the draft plat for preliminary approval to the Weld County Department of Planning Services. 3. Upon plat approval by the Department of Planning Services, the applicant shall submit the RES21-0005 plat for recording in accordance with Section 24-9-60 of the Weld County Code. A. If the Resubdivision plat has not been recorded within 120 days from the date of approval by the Board of County Commissioners, or if an applicant is unable to meet any of the conditions within 120 days of approval, the Director of Planning Services may grant an extension for a period not to exceed one (1) year, for good cause shown, upon a written request by the applicant. If the applicant is unwilling to meet any of the conditions of approval or the extension expires, the application will be forwarded to the Board of County Commissioners for reconsideration. The new south lot line will be located thirty (30) feet into what is now Frederick Street right-of-way. The southern thirty (30) feet of Frederick Street will go with the adjacent landowner Asphalt Paving Company, to the south but they are not a part of this request. This will be shown by a separate deed executed by this landowner. When the adjustment of the lot line occurs, the domestic service and fire flow waterline will now be located on the newly created property and no longer in the Frederick Street right-of-way, but rather within a proposed utility easement. Therefore, a Utility Coordinating Advisory Committee Hearing was held on October 28, 2021. The Utilities Coordinating Advisory Committee recommended the easement for the waterline and other appropriate utilities to follow the Easements Standard set forth in Subdivision Design Standards per Section 24-9-60.B of the Weld County Code, as supported by staff recommendation. This easement will be for the benefit of current and future wet and dry utilities. The Wattenberg Improvement Association submitted a letter dated September 8, 2021 with concerns related to accessing the current water line meters in order to check them with the new lot line adjustment. Planning Staff did receive six (6) letters from property owners within the Town of Wattenberg. Many of the comments were related to not being able to use the right of way anymore for walking and riding bikes. Some additional comments were in regard to a proposed water loop for the Wattenberg Improvement Association and how this will impact that. The Department of Planning Services' staff recommends that this request be approved for the following reasons: 1. WELD COUNTY'S RIGHT TO FARM STATEMENT: Weld County is one of the most productive agricultural counties in the United States, typically ranking in the top ten counties in the country in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with long-standing agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural areas: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well - run agricultural activities will generate off -site impacts, including noise from tractors and equipment; slow -moving farm vehicles on rural roads; dust from animal pens, field work, harvest and gravel roads; odor from animal confinement, silage and manure; smoke from ditch burning; flies and mosquitoes; hunting and trapping activities; shooting sports, legal hazing of nuisance wildlife; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. It is common practice for agricultural producers to utilize an accumulation of agricultural machinery and supplies to assist in their agricultural operations. A concentration of miscellaneous agricultural materials often produces a visual disparity between rural and urban areas of the County. Section 35-3.5-102, C.R.S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Water has been, and continues to be, the lifeline for the agricultural community. It is unrealistic to assume that ditches and reservoirs may simply be moved "out of the way" of residential development. When moving to the County, property owners and residents must realize they cannot take water from irrigation ditches, lakes, or other structures, unless they have RES21-0005 Page 5 of 6 an adjudicated right to the water. Weld County covers a land area of approximately four thousand (4,000) square miles in size (twice the size of the State of Delaware) with more than three thousand seven hundred (3,700) miles of state and County roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the County, and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self- sufficient than urban dwellers. People are exposed to different hazards in the County than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs and livestock, and open burning present real threats. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. 2. The applicant shall submit one (1) electronic copy (.pdf) of the draft plat for preliminary approval to the Weld County Department of Planning Services. 3. Upon plat approval by the Department of Planning Services, the applicant shall submit the RES21-0005 plat for recording in accordance with Section 24-9-60 of the Weld County Code. A. I have been notified that Mr. and Mrs. Perez have petitioned to have some boundaries changed. I strongly object to this petition for the following reasons: • Mr. Kenneth Perez asked me if it would be okay to build his garage a little bit bigger and closer to his property line, past the Weld County Planning Guidelines. I told him that he would need to set up a meeting with the entire Wattenberg Improvement Association Board Members. I informed him that there would be a water project to allow the proper water circulation of the town water system and that Leona Avenue would become a thru street. I told him that there probably would not be a problem if he stayed inside his property boundaries. He said that he understood what the Association was going to do, and all he wanted to do was to extend his garage just a little bit in his property. As of this date, it is my understanding that Mr. Perez has never attended a Board meeting or has contacted the Wattenberg Improvement Association Board. • In the past Leona Street was open and we were able to walk up to Weld County Road 6 u ntil someone came and dumped tandem loads of dirt side by side, but we were still able to walk over them. Then, someone threw broken concrete and debris making it u nsafe to walk on Leona Avenue. o In a community our size, and as a member of the Wattenberg improvement Association, it would greatly impact the entire community and the Wattenberg water supply ® I am strongly against this request because if this petition is granted other property owners in our small community will apply for this type of petition for other street to be closed and added to their property. Wattenburg is a community founded and settled by Mexican immigrants who happen to be our ancestors. It was the one place where we were allowed to live for many years and we lived in harmony with each other for over 100 years. The property that Mr. Perez hopes to change belonged to his Grandmother, Carolina Ramirez. Although many are not related by blood, Carolina served as "gramma" to me and my siblings. She served in that role to many in the community with her loving, compassionate nature. We were able to walk freely to and from her house or to other destinations in Wattenburg as we crossed her property. Mr. Perez is now suggesting barriers that will impede a community that has long been accustomed to her welcoming attitude. This project will impede the right of passage to three major streets that people use in this part of Wattenburg. Many in our community are used to walking in our small community, particularly as age increases and driving becomes difficult. I have been an active member in the Wattenberg Community for over 60 years. A very important role of President is overseeing the water projects and learning about the flow and process of maintaining a working water supply for our small rural community. It has come to our attention that Mr. and Mrs. Perez have petitioned to have some boundaries changed. In a community our size I would like you to know the impact it would have on the entire community and the Wattenberg water supply. We recently had the great opportunity of taking advantage of a Federal Grant that was provided to our small community and allowed us to enhance and better our water supply. In so doing we had the opportunity to educate ourselves in the workings of the daily flow of water, water lines etc. currently utilized in Wattenberg. We are against this request not only because of the logistics and the financial cost our Association would have to be faced with in the future. Currently we do manual water meter readings and go to each household water meter. If you grant the boundary changes for the Perez household the current location of the Perez water meter would be right on their property and we would not have full access to the meter on a monthly basis or have full access to it for any type of emergency. The requested location is also one of the main tap offs that will need to be untapped to ensure the water flow of the newly installed water system to work even better. This is our next water project that has been put on hold due to the current pandemic. We cannot stress the importance of full access to these locations. We hand delivered to Mr. Nader a copy of the map with the locations of the water lines and our next water project to ensure the water flow of our newly installed system. If you are in need of any additional information please feel free to contact me on behalf of the Wattenberg Improvement Association water system. We are also against this request because the make-up of our streets was done by the County and they even named the streets. We are concerned that should this petition be granted then there will be a lot more future petitions and arguments regarding "claims" to "vacated" areas in our community. Members Present: Mike McRoberts, Robert Fleck, Veronica Garcia and Amy Mutchie. Members Absent: Jared Rauch, Jerry Adams, Jeremy Young, Michael Wailes, Shelley Bergstrom, Mark Alessi, and Lucas McConnell Also Present: Maxwell Nader, Department of Planning Services and Kris Ranslem, Secretary. LOT 17 THRU LOT 20 BLOCK 12 WATTENBERG AND THAT PART OF VACATED LEONA AVENUE; PART OF SECTION 25, Ti N, R67W OF THE 6TH P.M., WELD COUNTY, COLORADO. NORTH OF AND ADJACENT TO FREDERICK STREET; APPROXIMATELY 300 FEET WEST OF CAROLINE AVENUE. Maxwell Nader, Planning Services, stated that the applicants are proposing to amend the existing south lot line of the subject property and the Frederick Street right-of-way. The new south lot line will be located thirty (30) feet into what is now Frederick Street right-of-way. Most utilities are in the right-of-way, which serve the Town of Wattenberg. There is a waterline for the Town of Wattenberg Improvement Association that runs through the north side of Frederick Street right-of-way. When the adjustment of the lot line occurs, the waterline will now be located on the newly created property and no longer in the Frederick Street right-of-way, therefore requiring a utility easement. In response to the proposed Resubdivision, a utility easement shall be created for the Town of Wattenberg Improvement Association waterline and other utilities. Said utility easement shall follow the Easement Standard criteria set forth in Section 24-3-60 of the Weld County Code. Section 24-3-60 states the following criteria are required to be followed: A. Fifteen (15) feet minimum drainage and utility easements are required adjacent to public road rights -of - way, unless otherwise recommended by the Utilities Coordinating Advisory Committee for technical purposes. B. Twenty (20) feet minimum drainage and utility easements are required along internal lot lines and shall be apportioned equally on abutting properties, unless otherwise justified by the Utilities Coordinating Advisory Committee for technical purposes. C. Ten (10) feet minimum drainage and utility easements are required along exterior lot lines, unless otherwise justified by the Utilities Coordinating Advisory Committee for technical purposes. Corner exterior lots requires fifteen (15) feet. D. Easements shall be designed to provide efficient installation of utilities and drainage swales. Proposed easements may be modified by the Utilities Coordinating Advisory Committee. Public utility installations shall be located to permit multiple installations within the easements to avoid cross connections, minimize trenching and adequately separate incompatible systems. Section 24-3-60.6 is applicable for this utility easement request. The newly created twenty (20) foot utility easement will be north of the new southern lot line. This utility easement will be solely on the subject lot and not shared with the lot to the south of the subject lot. The lot to the south is not involved in this 1 request. Again, this utility easement will be utilized by the Wattenberg Improvement Association and other applicable utilities. The Weld County Department of Planning Services recommends that this request be approved. Veronica Garcia, United Power, stated that they did review this request and noted that there is a pole that they serve just off the fence and they will require access to that pole. She added that any costs or changes would be at the cost of the applicant. Mike McRoberts, Planning Development Review, asked if a utility easement should be shown on the plat to identify that. Ms. Garcia replied that it should be included on the plat. Mr. McRoberts noted that it runs parallel to the western property line with the pole inside the fence. Mr. Nader said that we can include the required utility easements on this plat. Amy Mutchie, Public Works, said that they would require those easements to be shown since the right-of-way has been vacated which is the only thing that gives the utilities the right to be in there and there may be future utilities that may come in. She added that there are some existing utilities that aren't shown so they want to see an easement that is accommodating for those as well as some future utilities. Rob Fleck, St. Vrain Sanitation, asked if they had already applied for an access permit. Mr. McRoberts said Frederick Street is a maintained county road. Ms. Mutchie added that now that the right-of-way is vacated it will become an easement. Mr. McRoberts summarized that all of the utility easements should be identified on the plat.
