HomeMy WebLinkAbout20212212.tiffRESOLUTION RE: ACTION OF THE BOARD AT PROBABLE CAUSE HEARING, PCSC21-0009, CONCERNING USE BY SPECIAL REVIEW PERMIT, USR-760 - SMITH FAMILY TRUST AND 6 B'S PROPERTY, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 26th day of July, 2021, a Probable Cause Hearing was held before the Board to consider setting a Show Cause Hearing to determine whether or not Smith Family Trust and 6 B's Property, LLC, 29 Highway 52, Longmont, Colorado 80504, was in compliance with certain Development Standards contained in Use by Special Review Permit, USR-760, for a Use Permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (wastewater treatment facility for B&B Smith Mobile Home and Recreational Vehicle Park), and WHEREAS, the alleged violations were said to be occurring on property being further described as follows: Lots A and B of Recorded Exemption RE -1204; being part of the SW1/4 of Section 31, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing on July 26, 2021, the Board heard all of the testimony and statements of those present and reviewed the evidence presented by staff and, having been fully informed, finds that the matter should be continued to September 1, 2021, at 9:00 a.m., to allow Staff and the property owner time to reach an amicable solution, and WHEREAS, on the 1st day of September, 2021, after hearing testimony from the Department of Planning Services, the Board finds that pursuant to the procedure as set forth in Chapter 2 Administration, of the Weld County Code, there is not sufficient probable cause to schedule a Show Cause Hearing and deemed it advisable to dismiss the matter and allow the applicant to submit an application to the Department of Planning Services for a Minor Amendment. (Site Plan Review) SPR-38 was approved for a mobile home/RV park in the R-5 (Manufactured Home Residential) and C-4 (Highway Commercial) Zone Districts. USR-760 was approved by the Board of County Commissioners for a wastewater treatment facility for the mobile home/RV park. (Recorded Exemption) RE -1204 was approved. The RE split the property into two pieces. Complaint received from a citizen stating non-compliance with the USR and possible floodplain violation. Staff visited the site to verify that there were four (4) semi -trailers parked cn the site and RVs being lived in that were not part of the approved permit. Additionally, there was debris being placed in the floodplain. Initial Probable Cause and Floodplain Violation letters sent via first class and certified mail. Phone call with Mr. Orville (Bill) Smith I clarified questions about the letters that he had received. It was stated that there could be two (2) semi -trailers on the site but this was an error and no semi -trailers can be used as storage on site. 09/0t Page 1 of 3 QCYD le Deal ( PLO094 April 23, 2021 Email received from Ms. Dheanna McCormick stating that she works with Mr. Bill Smith at the B&B Mobile Home park. April 23, 2021 The applicant was given a deadline of May 15, 2021, to have the site in compliance with the USR and the floodplain regulations. April 30, 2021 Received the PreApplication Request form. May 13, 2021 The applicant was given a deadline of June 7, 2021, to have the site in compliance with the USR and the floodplain regulations. May 14, 2021 Email sent to Ms. Dheanna McCormick indicating that no PreApplication meeting would be necessary but if they wanted to meet I would be available. The email stated that there could be two (2) semi -trailers on the site instead of the four (4) however per Section 23-3-30.G. of the Weld County Code semi -trailers can only be an accessory use. Since there is no primary use on this lot the semi- trailers will need to be removed. May 17, 2021 Site visit. The RVs that are not part of the approved RV park are still on site. The four (4) semi -trailers are still on -site. May 24, 2021 The applicant was given a deadline of June 30, 2021, to have the site in compliance with the USR and the floodplain regulations. June 10, 2021 Email to Ms. Dheanna McCormick stating that the semi -trailers can only remain on site as an accessory use and since there is no primary use on the property the semi -trailers would need to be removed from the site. July 2, 2021 Site visit. There are still four (4) semis on the site. The RVs that were not part of the approved RV park have been removed from the site and the floodplain violation has been addressed. July 12, 2021 Probable Cause letter sent via first class and certified mail. The letter was also emailed to Ms. Dheanna McCormick. July 26, 2021 The Board of County Commissioners continued this item until September 1, 2021. August 2, 2021 August 19, 2021 Background: SPR-38 USR-760 Summary: Staff held a Pre -Application meeting with the applicant to discuss the process to amend the USR to add the four (4) semi -trailers. The applicant indicated that they are working on getting the paperwork together for the minor amendment per an email dated August 19, 2021. RV and non -transient residence would be allowed in the R-5 (Manufactured Home Residential) and C-4 (Highway Commercial) Zone Districts. Mobile homes would be allowed in the R-5 (Manufactured Home Residential) Zone District but not in the C-4 (Highway Commercial) Zone District. The Use by Special Review permit is for a wastewater treatment facility for B & B Smith Mobile Home and Recreational Vehicle Park as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. This case was conditionally approved by the Board of County Commissioners on December 17, 1986. The USR map was recorded on February 19, 1987, under reception #2088963. USR-760 Development Standards #1, 6, and 7 state: Page 2 of 3 1. The Use by Special Review Permit is for a wastewater treatment facility for B&B Smith Mobile Home and Recreational Vehicle Park as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 6. The Use by Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 7. The property owner or operator shall be responsible for complying with all of the foregoing Standards. I talked to a Zoning Compliance Officer and she informed me that semi- trailers and cargo containers are only allowed as accessory uses. Furthermore, since these properties are in the 100 -year floodway, addition of wood, debris, etc. is not allowed and any development requires a permit in accordance with the Federal Emergency Management Agency (FEMA) requirements. Development is defined as any man-made change to improved or unimproved real estate, including but not limited to buildings or other structures, mining, dredging, filling, grading, paving, excavation or drilling operations or storage of equipment or materials. Some of the problems might have been answered by a more detailed application and can easily be answered. The main problems with the park are as follows: 1. The mobile home spaces are not identified as required in Section 5. 1 . 2. It is not clear whether independent, dependent or both types of trailers are to be accommodated. 3. The adequacy of the water supply and method of distribution is not mentioned. 4. The plat fails to meet the five acre minimum established for mobile home parks. 5. The entrance streets are supposed to be forty feet in width. 6. It is not dear if the roads are lighted and paved as required in Section 5.3. 7. Are there any service building facilities to be provided besides the toilets? 8. Has the leach field and sewage system been approved? 9. Are waste disposal facilities to be provided? 10. How many mobile home spaces are proposed for the park? All of the above items are required by the County regulations which also specify the standards to be met in the construction of the various facilities. In addition, we would question the purpose of the street immediately north of the residence. This appears to be wasted space and may lead to another entrance to Highway No. 52 which would be an unnecessary safety hazard. He stated they had and have no objectiono to them. He asked if he should submit the plat for recording prior to the application being completed by the State. Lee Morrison explained it would be to his benefit to file the Use by Special Review Plat because this is a recuest for a Use by Special Review permit and not a site plan application. He explained that the site plan application is part of the the State's citings, and s recommendation is made to the state and not the Board of County Commissioners. This supplemental report responds item by item to the Application Re- quirements delineated in the procedural guide. Reference is made, as appropriate, to the wastewater facility report. * The proposed use and need for that use are described on page 1 of the WWTP report. * The surrounding properties are agricultural and do not have an approved Mobile Home/RV Park, therefore do not have or require a wastewater treatment facility as is being proposed. * The physical location of the plant is approximately 100 feet from the nearest RV site. The plant is, however, essentially an integral part of the mobile homes and RV's that it serves. * The present and future demand for wastewater treatment is covered on page 1 and Tables 1 & 2 of the WWTP report. * The number of employees, shifts, etc. is basically not applicable in this case. Mr. Smith is a licensed WWTP operator and will maintain his own facility. See page 2 of WWTP report. * Available well water feeds the residences served by the WWTP. * Access to the plant is by existing private roads within the park. * No traffic or vehicular use is associated with the regular operation of the WWTP. * The facility which is a WWTP is an Aerobic Digester. * Fire protection for this facility is not applicable. * No animals are associated with this facility. * No waste nor stockpile nor storage areas are anticipated being needed. * Storm water retention is not an issue with the WWTP. * It is possible that annually the operator might elect to have an approved sewage pumper and hauler remove approximately 1000 gallons in order to stabilize the treatment. The approved hauler would dis- pose of the pumped waste in an approved facility. -1- * Basically, the facility is below or at ground surface and will be fenced in for safety. Grass, shrubs and gravel will be placed in the perimeter area. * This is a permanent facility. * See page 2 of the WWTP report for the construction time frame. * The addition of a wastewater treatment plant to properly handle and treat wastewater produced by an existing (and future addition to) mobile home and RV park is consistent with the Weld County Compre- hensive Plan. This facility does not remove active agricultural land from agricultural use. The future expansion would be onto land zoned agricultural but not used for any purpose other than a leach field and approved quarry. Further, the expansion of the park is a con- firmation of the Comprehensive Plan's acknowledgment of population growth within the county. The population growth in the park is well defined and has a stated upper limit that is restricted by available land. The construction of a wastewater treatment plant is more likely to be supportive of the environment than the existing leach field. This is particularly true in this case because the wastewater is first treated within the plant so that the discharge is within state effluent limi- tations and is then placed in a polishing pond (the quarry pond). The retention in the polishing pond further reduces the pollutants in the wastewater. This further reduced effluent will eventually leach into the surrounding soil, be even further reduced, before reaching Boulder Creek. * The site for the treatment plant is located within the Boulder Creek 100 year flood plain. The 100 year water surface elevation is 4950.2' (refer to figure 3, WWTP Report). In order to protect the environment against contamination during a 100 year flood condition, the concrete side walls will be constructed to a top elevation 18" above the 100 year water surface elevation. -2- Construction of the treatment plant will utilize reinforced concrete walls with water stops at all exterior wall construction joints and waterproofing of all perimeter surfaces. Consideration is also made to resist the possibility of uplift (floating) resulting from buoy- ancy during periods of high ground water elevation. * The plant itself does not require water for its operation, but rather it treats permitted water after use. The availability of water is a function of that already permitted for the park with no extra being required for the WWTP. Included with this report please find drawing No. 2 Plot Plan for Use by Special Permit. Manufacturer's technical information K. 24" x 36" site plan The B & B Mobile and RV Park is an existing mobile home and recreational vehicle park located in the SW 1 of the SW 14 of Section 31, T2N, R68W of the 6th P.M., Weld County, Colorado. More precisely located at the NE corner of the intersection of State Highway 52 and Northeast County Line Street. It is desired to expand this existing facility over the next 2 to 5 years by the addition of 30 recreational vehicle sites. Currently the mobile home and RV park consists of one residential dwell- ing, an allowance for 22 mobile homes and 22 recreational vehicles. The maximum population for the mobile home and recreational vehicle park, therefore, is one residential dwelling, 22 mobile homes and 52 recrea- tional vehicles. Tables 1 and 2, respectively, estimate current waste- water flow/loading and give projections for the future. Waste water generated by the existing mobile home and RV park is treated by a leach field located just North of the park. This leach field is to be reclaimed and used as the site for the proposed expansion. North of the park a sand and gravel quarrying operation is active. A pond is being formed by this operation. With the expansion, all contiguously owned land is employed. With reclamation of land for use in the proposed expansion, wastewater treatment through the use of a leach field is impossible. In addition, all existing municipal wastewater treatment facilities do not serve nor are within the vicinity of the B & B Mobile Home and RV Park. These limitations have directed the owners of B & B Mobile Home and RV Park to look at an aerobic digestive system with polishing pond as the only practical means of treating wastewater. A 15,000 gallon per day plant with chlorination will adequately handle and treat the maximum anticipated wastewater generated. It should be -1- noted that the actual wastewater generated by the existing mobile home. and RV park is approximately one half of that shown in Table 1. Table 1 was created using standard values for flow and loading. The site for the treatment plant is located within the Boulder Creek 100 year flood plain. The 100 year water surface elevation is 4950.2' (refer to figure 3). In order to protect the environment against con- tamination during a 100 year flood condition, the concrete side walls will be constructed to a top elevation 18" above the 100 year water surface elevation. Construction of the treatment plant will utilize reinforced concrete walls with water stops at all exterior wall construction joints and waterproofing of all perimeter surfaces. Consideration is also made to resist the possibility of uplift (floating) resulting from buoy- ancy during periods of high ground water elevation. The plant will require minimum cost and effort to operate and maintain. It is estimated that electricity will cost $1.00 per day and chlori- nation will cost $.60 per day. We anticipate an average of one (1) man hour per day as the basis for time required to maintain and oper- ate the plant. The on site owner of the mobile home and RV park holds a Class A wastewater treatment plant operator's license, certificate #26, which expires June 1, 1991. It is anticipated that the owner will operate and maintain the WWTP facility in a manner compatible with the training he has received under his Class A license. It is estimated that it will require between 90 and 120 days from approval to construct this wastewater treatment facility and put it into operation. -2- , The mobile home and RV park and the property it is situated on is wholly owned by the property deed holders. All users of the facility are space renters of the park. The owner is in residence on site. Construction cost is estimated at $30,000 and will be paid by the owner on a cash basis, with no debt being incurred by the construction. In order to provide for operating and maintenance costs, a portion of the monthly (or equivalent) parking space fee will be reserved. As mentioned earlier, operation and maintenance of the plant is minimal, and is expected to cost approximately $200 per month. Under full occu- pancy, this breaks down to $2.67 per space. Under existing occupancy the cost increases to $4.44 per space per month. In anticipation of overall operation, a figure of $5.00 per space will be used to cover the operation and maintenance of the plant. The one most readily accepted has been termed "Aerobic Digestion" or "Extended Aeration" which involves aeration over a 24 hour period. The pri.::ipal characteristics which have contributed to its ready acceptance include: 1. ability to handle peak and shock loadings. 2. capital investment considerably below that for complete treatment. ;. highly technical operational supervision generally not required. Plants utilizing this process fill the need for an efficient, low test treatment plant particularly adapted to the needs of schools, sub- divisions, motor lodges, hospitals, trailer parks, industry annd other small installations. They provide odor -free and trouble -free operation and produce an effluent acceptable to state and local health authorities. Originally, they were intended to fill the gap between primary and complete treatment and were classified as 'intermediate treatment," but operating results have shown consistent BCD removals in the a5 - 95% r ar:'ge. The results of the next days test will indicate if the amount wasted was adequate. Vote that the aerator must be in operation to insure that mixed liquor enters the final tank during this operation. Final Tank There are two styles of final tanks, hopper bottomed and mechanically cleaned. Operation of the final tank is quite simple and consists only of scraping down the walls to dislodge hanging sludge on the hopper, setting the air lift Dump so that all of the settled sludge is returned, and ilerring to clean the liquid surface. The return of sludge from µ:e final tank should be continuous and adequate to keep sludge from accumulating in the hopper. This rate on the air lift pump is set by adjusting the air throttling valve on the air line to the airlift. If the final is mechanically cleaned, the telescoping valve should be set so that all of the sludge is withdrawn. Also this valve should be flushed daily by increasing the withdrawal rate momer- tarily. The scraping mechanism should be kept in continuous operation. -Skimming should be done no more than necessary, normally only a few minutes once or twice a day.
