HomeMy WebLinkAbout20210765.tiffHEARING CERTIFICATION DOCKET NO. 2021-08 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR20-0038, FOR COMMERCIAL RODEOS AND COMMERCIAL ROPING ARENAS OUTSIDE OF SUBDIVISIONS AND HISTORIC TOWNSITES IN THE A (AGRICULTURAL) ZONE DISTRICT - BARTON LAND AND CATTLE, INC., C/O BRIAN AND DENISE BARTON A public hearing was conducted on March 17, 2021, at 10:00 a.m., with the following present: Commissioner Steve Moreno, Chair Commissioner Scott K. James, Pro-Tem Commissioner Perry L. Buck Commissioner Mike Freeman Commissioner Lori Saine Also present: Acting Clerk to the Board, Jess Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Michael Hall Public Works Department representative, Melissa King Health Department representative, Lauren Light The following business was transacted: e I hereby certify that pursuant to a notice dated February 1, 2021, and duly published February 5, 2021, in the Greeley Tribune, a public hearing was conducted to consider the request of Barton Land and Cattle, Inc., c/o Brian and Denise Barton, for a Site Specific Development Plan and Use by Special Review Permit, USR20-0038, for Commercial Rodeos and Commercial Roping Arenas outside of subdivisions and historic townsites in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. e Michael Hall, Department of Planning Services, presented a brief summary of the proposal and the property history, including the partial Vacation and the subsequent complete Vacation, by the applicant, of USR-1224. He described the applicant intends to hold four (4) to six (6) events per year, during summer months, with approximately 50 participants, 50 spectators, and 50 participating horses, at any given time. He explained the events will be organized and run by a third party roping event contractor, provided the hours of operation and described the existing arena and sign. He stated there is an existing gravel parking area for 100 trucks and trailers, described the fencing around the site, and stated no additional landscaping or screening is proposed. He relayed notice was sent to 15 surrounding property owners (SPOs), two (2) letters of opposition, with outlined concerns, were received prior to the Planning Commission (PC) hearing and four (4) postcards indicating opposition, with no specific concerns, were received after the PC hearing. He stated 14 referrals were sent out with 11 agencies responding, the site is within the Town of Kersey Coordinated Planning Agreement and the Kersey three (3) mile referral area. In response to Chair Moreno, Mr. Hall clarified the locations of the properties from which the letters of opposition and postcards were received. ▪ Melissa King, Department of Public Works (PW), stated the site has four (4) existing, permitted access points and the applicant will need to obtain new access permit, due to proposing an additional type of use for an existing access. She provided the daily traffic count and average speed for County Road (CR) 53 and noted the traffic associated with the proposed use will be eight (8) to ten (10) roundtrips per day and approximately 50 truck/trailer roundtrips per event. She stated PW is requesting a Road Maintenance Agreement and indicated the site meets an exception for detention. le Lauren Light, Department of Public Health and Environment, stated Central Weld County Water District provides water to the property and there is a septic system sized for four (4) people, located in the pole barn. She noted the septic system will need to be expanded if they exceed the number of people using it and indicated the applicant proposes to supplement with portable toilets, which is acceptable. She relayed the applicant provided Dust Abatement and Waste Handling plans and noted all food trucks and caterers must comply with retail food regulations. She mentioned the previous USR had a commercial noise limit, which the applicant is proposing, and Development Standards (DS) #17-27 address Environmental Health items. • Denise Barton, applicant, provided the history of property, stated they had previously held barrel races on the site and indicated True West Productions would be organizing and running the events. She explained the loudspeaker is for announcing, not music, addressed the SPO concerns, and relayed there was not a Road Maintenance Agreement associated with the old USR. • No public testimony was offered concerning this matter. e In response to Commissioners James and Freeman, Ms. King explained the purpose of COA #1.B (Road Maintenance Agreement), reiterated the traffic count on CR 53, and in turn, Commissioner Freeman suggested deleting COA #1.6. Responding to Chair Moreno, the applicant clarified DS #4 (Events are limited to weekends and one (1) weekday immediately preceding or following the weekend), Commissioner Freeman suggested deleting DS #33 (Road Maintenance Agreement to be reviewed on an annual basis) and Mr. Choate suggested deleting DS #32 (comply with the requirements of the Road Maintenance Agreement). The Board agreed to all of the aforementioned changes. • In response to Chair Moreno, Ms. Barton indicated she had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. • No public testimony was offered regarding changes made to the Conditions of Approval and Development Standards. 2021-0765 PL1306 HEARING CERTIFICATION - BARTON LAND AND CATTLE, INC., C/O BRIAN AND DENISE BARTON (USR20-0038) PAGE 3 IR Commissioner James moved to approve the request of Barton Land and Cattle, Inc., c/o Brian and Denise Barton, for a Site Specific Development Plan and Use by Special Review Permit, USR20-0038, for Commercial Rodeos and Commercial Roping Arenas outside of subdivisions and historic townsites in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Buck, and it carried unanimously. There being no further discussion, the hearing was completed at 11:57 a.m. This Certification was approved on the 22nd day of March, 2021.
