HomeMy WebLinkAbout20213144.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO WEDNESDAY, NOVEMBER 10, 2021 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, November 10, 2021, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Steve Moreno, Chair — EXCUSED Commissioner Scott K. James, Pro-Tem Commissioner Perry L. Buck Commissioner Mike Freeman Commissioner Lori Saine Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Houstan Aragon Controller, Barbara Connolly MINUTES: Commissioner Buck moved to approve the Minutes of the Board of County Commissioners meeting of October 27, 2021, as printed. Commissioner Saine seconded the motion, and it carried unanimously. CERTIFICATION OF HEARINGS: Commissioner Saine moved to approve the Certification of Hearings conducted on October 27, 2021, as follows: 1) PCSC20-0030 — Bennie Rodriguez, and 2) COZ21-0003 — Highpoint Operating Corporation, c/o JSB Interests, LLLP. Commissioner Buck seconded the motion, which carried unanimously. PUBLIC INPUT: Terry Schwindler, Town of Windsor, introduced herself as the newest Business Development Specialist in the Economic Development Department, under the leadership of Stacey Miller, and extended an offer to assist the Board with any future needs. Steve Teets, Greeley resident, announced local restaurants are giving free meals for veterans in honor of Veteran's Day. Mr. Teets further referenced a Denver Post article regarding the passing of one trillion dollars in federal funding for transportation, and Chair Pro-Tem James offered to print a copy of the funding allocation. Additionally, Mr. Teets explained Colorado Public Radio News stated the Bonnell Community Good Samaritan Society is closing in December 2021 as a senior living community and requested to have it remain available to those that do not have shelter, stating that rental amounts are too high for many individuals to afford. Commissioner Saine seconded the motion, and it carried unanimously. PRESENTATIONS: 1) RECOGNITION OF SERVICES, DEPARTMENT OF PUBLIC WORKS - JERRY STEINBAR: Chair Pro -Tern James read the certificate for the record. Don Dunker, Department of Public Works, mentioned how reliable of an employee Jerry Steinbar was and that his presence will be sorely missed. Cameron Parrott, Department of Public Works, summarized Mr. Steinbar's career in the department since 2007, and made recollections of his tenure, accuracy, and dependablility. The Commissioners, in turn, recognized the work during his tenure, thanked him for his service to Weld County, and offered congratulatory well wishes in his retirement endevours. (Clerk's Note: The group gathered for a photo opportunity.) PROCLAMATIONS: 1) APPRENTICESHIP WEEK - NOVEMBER 15-21, 2021: Chair Pro -Tern James read the proclamation for the record. Tami Grant, Deputy Director of the Department of Human Services, thanked the Board for the proclamation and summarized the importance and benefits of apprenticeships, as well as the current apprenticeship programs in Weld County. Karina Amaya Ragland, Department of Human Services, thanked the Board for their recognition and stated the Workforce Development Board was awarded as a High Performaning Board for the fourth consecutive year. Cecilia Moreno, Department of Human Services, introduced various iniative partners who lend to the success of the Workforce Development Board. The Commissioners, in turn, expressed their pride in the collaboration addressing the needs of employers and employees alike, engaged Board members, the ability to recover quickly during economic downturn, and continued partnerships with Bright Futures and local and regional higher education establishments. Ei 2) VETERAN'S DAY - NOVEMBER 11, 2021: Chair Pro-Tem James read the proclamation for the record, asking the veterans in the room to stand to be recognized, including Toby Taylor, Director of the Facilities Department and of Veterans Services, Tom Parko, Director of the Department of Planning Services, and Jennifer Gonzales, Department of Information Technology, who are all U.S. veterans. Each Commissioner, in turn, expressed their appreciation for the service and sacrifice of the men and women who have selflessly given to our country to preserve our freedoms and defend our Constitution and the foundations that this country has been built upon. (Clerk's Note: The group gathered for a photo opportunity.) le WARRANTS: 1) GENERAL WARRANTS - NOVEMBER 9, 2021: Commissioner Buck moved to approve the General Warrants, as printed. Commissioner Freeman seconded the motion, and it carried unanimously. El 2) GREELEY-WELD COUNTY AIRPORT AUTHORITY WARRANTS - NOVEMBER 5, 2021: Commissioner Freeman moved to approve the Greeley -Weld County Airport Authority Warrants, as printed. Commissioner Buck seconded the motion, and upon a roll call vote, the motion passed three (3) to one (1), with Commissioner Saine opposed. El BIDS: 1) RESCIND AND RECONSIDER BID #B2100116, SHERIFF'S OFFICE TRAINING SITE AND SHOOTING RANGE - FACILITIES DEPARTMENT: Rob Turf, Purchasing Department, stated five (5) bids were initially received, with the low bid being from Roche Constructors, Inc., which was deemed incomplete due to the range equipment provider not being indicated at the time of the bid opening, and Minutes, Wednesday, November 10, 2021 Page 2 2021-3144 BC0016 as a result, staff recommended the bid be awarded to the second lowest bidder, Mark Young Construction, LLC, for the total amount of $8,962,808.00. He expanded a bid protest was filed by Roche Constrcutors, Inc., on November 3, 2021, and the department notified Mark Young Construction, LLC, on November 5, 2021. Mr. Turf further discussed an internal review of both bids, which occurred on November 8, 2021, and it was determined that while Roche Constructors, Inc., had not indicated the range equipment provider at the time of submittal, that information was provided soon after and the specifications did not state when the disclosure of the range equipment provider was due. Furthermore, he stated the difference between the two bids is $701,408.00 and, therefore, is in the best interest of the citizens of Weld County to reconsider the awardal of said bid. Chair Pro-Tem James inquired if there was a representative from Mark Young Construction, LLC, present, and there was no response from the audience. Tom Roche, Chief Executive Officer (CEO) of Roche Constructors, Inc., expressed his concerns with the bid process. Commissioner Saine responded the bid process will be reviewed and discussed at an upcoming work session. In response to Commissioner Saine, Mr. Roche explained a bid tabulation form includes the contractors that bid the project, as well as the bid amounts. Chair Pro -Tern James and Commissioners Freeman and Buck likewise discussed the bid process and upcoming review thereof. Commissioner Saine moved to rescind and reconsider Bid #62100116, and to award said bid to Roche Constructors, Inc. The motion was seconded by Commissioner Freeman and it carried unanimously. • NEW BUSINESS: 1) CONSIDER APPLICATION AND MEMORANDUM FOR PERMANENCY INCENTIVE FUND: Jaime Ulrich, Director of the Department of Human Services, stated the funding was awarded to the Child Welfare Division to conduct permanency assessments and provide additional in -home services to support permanency. Commissioner Buck moved to approve said application and memorandum. Seconded by Commissioner Saine, the motion carried unanimously. IR 2) CONSIDER CONTRACT ID #5304 CHILD PROTECTION AGREEMENT FOR SERVICES AND AUTHORIZE CHAIR PRO-TEM TO SIGN - DAVID L. CHRISTIANSEN, LLC: Ms. Ulrich stated the agreement provides mental health services and staff training and consultation. Commissioner Buck moved to approve said agreement and authorize the Chair Pro -Tern to sign. The motion, which was seconded by Commissioner Saine, carried unanimously. • 3) CONSIDER CONTRACT ID #5353 BUSINESS PROPOSAL FOR COUNTY BEHAVIORAL HEALTH GRANT PROGRAM FOR HIGH-FIDELITY WRAPAROUND PROJECT AND AUTHORIZE CHAIR PRO-TEM TO SIGN: Ms. Ulrich stated the grant allows for the opportunity to create a high-fidelity wraparound team that will work directly with children and families within the care of the Child Welfare Division, the Family Resources Division, and the Area Agency on Aging, for those that have complex behavioral and mental health needs. Commissioner Buck moved to approve said business proposal and authorize the Chair Pro-Tem to sign. Commissioner Saine seconded the motion and it carried unanimously. • 4) FINAL READING OF CODE ORDINANCE #2021-15, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 23 ZONING AND CHAPTER 24 SUBDIVISIONS, OF THE WELD COUNTY CODE (BULK REQUIREMENTS AND PUBLIC WATER): Commissioner Freeman moved to read Code Ordinance #2021-15 by title only, Commissioner Saine seconded the motion, and it carried unanimously. Bruce Barker, County Attorney, read the title for the record. Angela Snyder, Department of Planning Services, shared the request of the County Attorney's Office to make a path for new public water supply systems. She reviewed additions to the definitions of `public water' in Chapter 23, which should also remain in the definitions section of Chapter 24, both of the Weld County Code. No public testimony was offered concerning this matter. Minutes, Wednesday, November 10, 2021 Page 3 2021-3144 BC0016 Commissioner Saine moved to approve Code Ordinance #2021-15 on Final Reading. The motion was seconded by Commissioner Buck and carried it unanimously.. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Code Ordinance #2021-15 was approved on Final Reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
