James, Pro -Tern Commissioner Perry L. Buck Commissioner Mike Freeman Commissioner Lori Saine Also present: Acting Clerk to the Board, Jess Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Maxwell Nader Health Department representative, Lauren Light The following business was transacted: i g I hereby certify that pursuant to a notice dated September 14, 2021, and duly published September 17, 2021, in the Greeley Tribune, a public hearing was conducted on October 27, 2021, to consider the request of Highpoint Operating Corporation, c/o JSB Interests, LLLP, requesting a Change of Zone, COZ21-0003, from the A (Agricultural) Zone District to the C-3 (Business Commercial) Zone District, and being fully informed, the Board continued the hearing until November 10, 2021, to allow the applicant additional time to finalize improvements and the Road Maintenance Agreement with county Staff. On November 10, 2021, Bob Choate, Assistant County Attorney, made this a matter of record. Maxwell Nader, Department of Planning Services, presented a brief summary of the proposal and explained Site Plan Review, SPR21-0008, is being processed in conjunction with the Change of Zone (COZ) application and noted the existing USR14-0002 will be vacated as Condition of approval of the COZ. He indicated the Department of Planning Services has received no correspondence from surrounding property owners (SPOs) regarding the COZ application, and relayed there is an existing, permitted commercial access onto County Road 33, which adequately meets traffic requirements. Mr. Nader stated the site is within the three (3) mile referral area of the City of Greeley and the Town of Eaton, described the surrounding zoning, and entered the favorable recommendation of the Planning Commission into the record as written. He displayed images of the site and surrounding views and in response to Chair Pro -Tern James, Mr. Nader clarified the surrounding zoning. MI Lauren Light, Department of Public Health and Environment, stated the North Weld County Water District currently provides water to the site and there is an existing commercial septic system that is permitted for 25 people. cc:pi-cm/HN%EH(u.), CA(881Kn) 3/15/22 2021-2959 PL2267 HEARING CERTIFICATION - HIGHPOINT OPERATING CORPORATION, C/O JSB INTERESTS, LLLP (COZ21-0003) PAGE 2 5 Chair Pro -Tern James reviewed for the applicant and the public, the procedures to follow should this case result in a tie vote due to four (4) Commissioners being present and Chair Moreno being excused. Andy Gerk, Baessler Homes, represented the applicant and provided the history of Baessler Homes, as a company as well as their previous and current corporate office location. He stated the proposed location will be the "forever home" for the corporate headquarters. El No public testimony was offered concerning this matter. .= Mr. Gerk stated he would like to continue to work with staff regarding a possible Intergovernmental Agreement (IGA) and was agreeable to the Conditions of Approval, as presented. After reviewing the Conditions the Board made no changes. El In response to Pro -Tern James, Mr. Gerk indicated, he had, on behalf of the applicant, reviewed and agreed to abide by, the Conditions of Approval, as presented. El Commissioner Saine moved to approve the request of Highpoint Operating Corporation, do JSB Interests, LLLP, for a Change of Zone, COZ21-0003, from the A (Agricultural) Zone District to the C-3 (Business Commercial) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval, as presented. The motion was seconded by Commissioner Freeman, and it carried unanimously.
