RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT,
USR20-0034, FOR ONE (1) SECOND SINGLE-FAMILY DWELLING PER LEGAL LOT,
SUBJECT TO THE PROVISIONS OF CHAPTER 23, ARTICLE IV, DIVISION 8, OF THE
WELD COUNTY CODE, IN THE A (AGRICULTURAL) ZONE DISTRICT - VICTOR AND
SHARON SCHENCK
A public hearing was conducted on March 31, 2021, at 10:00 a.m., with the following present:

The following business was transacted:
IR I hereby certify that pursuant to a notice dated February 22, 2021, and duly published
February 24, 2021, in the Greeley Tribune, a public hearing was conducted to consider the
request of Victor and Sharon Schenck, for a Site Specific Development Plan and Use by Special
Review Permit, USR20-0034, for one (1) Second Single -Family Dwelling per legal lot, subject to
the provisions of Chapter 23, Article IV, Division 8, of the Weld County Code, in the A (Agricultural)
Zone District. Bob Choate, Assistant County Attorney, made this a matter of record.
El Chris Gathman, Department of Planning Services, presented a brief summary of the proposal,
stating Milton Lake Estates is a 24 -lot subdivision that was platted in 1970, and there are personal
livestock of three (3) goats and ten (10) chickens on the property. He stated the Colorado Division
of Water Resources issued Well Permit #320525 for up to two (2) single-family dwellings, along
with the watering of the domestic animals and irrigation of not more than one (1) acre of home
gardens and lawns, and a separate individual septic system is proposed for the second dwelling.
Mr. Gathman pointed out the proposed location of the second dwelling on the plat, stated
no communication has been received regarding this application, entered the favorable
recommendation of the Planning Commission into the record, and displayed images of the site
and surrounding views.
Zackery Roberson, Department of Public Works (PW), provided a brief overview of the
transportation plans and requirements, relaying the application proposes three (3) round -trips per
day, and PW does not have specific traffic counts on this section of County Road (CR) 47. He

stated the new access is 0.39 miles south of CR 34.5 on CR 47, and PW is requesting the new
access for the house be a minimum of 150 feet away from any other access, to meet spacing
requirements and a Grading Permit will be required if more than one (1) acre of land is disturbed.
In response to Chair Moreno, Mr. Roberson confirmed there will be two (2) accesses.
El Lauren Light, Department of Public Health and Environment (EH), stated water will be
provided by a well that is permitted for two (2) dwelling units, the septic system to the existing
dwelling is permitted for three (3) bedrooms, and a new septic system will be installed for the
proposed dwelling, which is required prior to issuance of a Certificate of Occupancy. Ms. Light
relayed there are two (2) Development Standards (DS) that address water and septic and EH has
no outstanding concerns with this request.
e Victor Schenck, Applicant, stated his son, Chad Schenck, is recently out of the military, and
this request will provide housing for his family.
e No public testimony was offered concerning this matter.
IR In response to Chair Moreno, Mr. Victor Schenck indicated he had reviewed, and had no
concerns with the Conditions of Approval and Development Standards.
El The Board reviewed the Conditions of Approval and Development Standards and found no
changes or corrections were necessary.
• In response to Chair Moreno, Mr. Schenck agreed to abide by the Conditions of Approval and
Development Standards as written.
e Commissioner Freeman moved to approve the request of Victor and Sharon Schenck for a
Site Specific Development Plan and Use by Special Review Permit, USR20-0034, for one (1)
Second Single -Family Dwelling per legal lot, subject to the provisions of Chapter 23, Article IV,
Division 8, of the Weld County Code, in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of Approval
and Development Standards, as written. The motion was seconded by Commissioner Saine, and
it carried unanimously. There being no further discussion, the hearing was completed at
10:07 a.m.
