The Weld County Department of Public Works has reviewed this proposal. Staff comments made during
this phase of the application process may not be all-inclusive, as other issues may arise during the
remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: A Site Specific Development Plan and Third Amended Use by Special Review Permit
for open pit mining and materials processing (sand, gravel, and stone), an Asphalt and Concrete Batch
Plant, an oil and gas support and service facility, pipeline and roust -a -bout and a private commercial
recreational facility (water skiing lake and primitive campsite for water skiing members with hours of
operation, for the water skiers, from sunrise to sunset from April 15 to October 14 of any given year) to add
additional RV storage near Camp Lake, to add 12 camping spots around Camp Lake, to allow overnight
camping along the South Lake, to add electrical to each camping location and to revise some of the
Development Standards in the A (Agricultural) Zone District
This project is south of and adjacent to 0 Street and N. 16th Avenue and is east of CR N. 251h Avenue.
Parcels' numbers: 080331200009, 0€0536100009.
Access is from N. 23rd Avenue.
ACCESS
Weld County Public Works has reviewed the application materials related to access.
The application contained an August 18, 2020, document that requested that the primary entrance be
located on the northeast corner of the property. However, the application also contained a May 6, 2021,
questionnaire response in which the applicant requested no change to the access points. Therefore, the
most recent application information was used for this referral.
The applicant has proposed the main access onto N. 23rd Avenue and the emergency access onto N. 16th
Avenue. The map, submitted with the application, shows the emergency access roadway travelling across
the parcel to the east to access onto N. 16th Avenue. Provide easement documentation.
Both N. 23rd Avenue and N. 16th Avenue are under the jurisdiction of the City of Greeley. The municipality
has jurisdiction over access to the roads. Please contact the municipality for access permitting.
ROADS AND RIGHTS -OF -WAY
N 23rd Avenue and N. 16th Avenue are under the jurisdiction of the City of Greeley. The municipality has
jurisdiction over access to the road. Please contact the municipality to verify the right-of-way requirements,
access permit or for any additional requirements that may be needed to obtain or upgrade the permit.
DRAINAGE REQUIREMENTS
This area IS within an Urbanizing Drainage Area: Urbanizing Drainage Areas typically require detention of
runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at
the historic runoff rate of the 1 -hour, 5 -year storm falling on the undeveloped site for URBANIZING areas.
Detention pond waived and a simple drainage narrative:
The applicant has submitted a drainage narrative stating that the site meets drainage detention exception
11. An individual parcel with an unobstructed flow path and no other parcel(s) between the Federal
Emergency Management Administration (FEMA) regulatory floodplain channel and the project. Located in
Sec. 8-11-40. Drainage Policy.
Historic Flows:
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from
the property.
MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4)
This site is located in a Municipal Separate Storm Sewer System (MS4) Area which may trigger specific
water quality requirements or other drainage improvements. In addition to compliance with applicable Weld
County regulations, property owner is required to be compliant with any additional MS4 requirements.
Any development after July 1, 2019 shall meet the current MS4 requirements, including but not limited to
the development of a drainage plan and the installation of a permanent water quality control measure(s) to
treat the runoff from the development area.
GRADING PERMIT
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications
are accepted after the planning process is complete (plan recorded). An Early Release Request Form may
be entertained only after the applicant, Public Works and Planning Department have reviewed the referral
and surrounding property owner comments. The Early Release Request may or may not be granted
depending on referral comments and surrounding property owner concerns. Contact an Engineering
representative from the Public Works for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575.
If more than 1 acre is to be disturbed for construction of non -gravel pit items such as structures, parking
lots, laydown yards etc, a Weld County grading permit will be required prior to the start of construction.
Grading Permit applications are accepted after the planning process is complete (plan recorded). An Early
Release Request Form may be entertained only after the applicant, Public Works and Planning Department
have reviewed the referral and surrounding property owner comments. The Early Release Request may or
may not be granted depending on referral comments and surrounding property owner concerns. Contact
an Engineering representative from the Public Works for more information.
CONDITIONS OF APPROVAL
A. The plan shall be amended to delineate the following:
1. N. 23rd Avenue and N. 16th Avenue is under the jurisdiction of the City of Greeley. Please contact
the municipality to verify the right-of-way. Show and label the right-of-way. Show the approved
accesses on the site plan and label with the approved access permit number if applicable.

2. Show and label a 30 -foot minimum access and utility easement to provide legal emergency access
to the parcel from N. 16th Avenue on the site plan. (Department of Public Works)
3. Show and label the drainage flow arrows. (Department of Public Works)
4. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around
the property. (Department of Public Works)
Prior to Construction:
If more than one (1) acre is to be disturbed for construction outside of the gravel mining area, a Weld County
grading permit will be required. (Department of Public Works)
DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Department of Public Works)
2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages
and/or off -site tracking. (Department of Public Works)
3. There shall be no parking or staging of vehicles on public roads. On -site parking shall be utilized.

4. The historical flow patterns and runoff amounts on the site will be maintained. (Department of Public

5. Weld County is not responsible for the maintenance of onsite drainage related features. (Department

But the previous verbiage was:

Thank you for your referral agency comments. I compared the Development Standards you provided with the
existing ones. Some of them are missing and I just want to know if you want to add them back in.
#7. Any vehicle washing area(s) shall capture all effluent and prevent discharges from drum washing and the
washing of vehicles, in accordance with the Rules and Regulations of the Water Quality Control Commission
and the Environmental Protection Agency.
#14. The applicant shall remove, handle and stockpile overburden, soil, sand, and gravel from the facility area,
in a manner that will prevent nuisance conditions.
#16. If applicable, the applicant shall obtain a stormwater discharge permit from the Water Quality Control
Division of the Colorado Department of Public Health and Environment.
#17. The facility shall be operated in a manner to prevent odors. Odors detected off of the site shall not equal
or exceed the level of a fifteen -to -one dilution threshold, as measured pursuant to regulation 2 of the Colorado
Air Pollution Control Regulations. Additional controls shall be implemented, at the request of the Weld County
Department of Public Health and Environment, in the event odor levels detected off the site of the facility meet,
or exceed, the level of a fifteen -to -one dilution threshold, or in the judgment of the Weld County Health Officer;
there exists an odor condition requiring abatement.
#24. The facility shall comply with regulation No. 9, open burning, prescribed fire and permitting (5 OCR 1001-
11) of the Colorado Air Quality Control Commission.

Environmental Health Services has reviewed this proposal for a Site Specific
Development Plan and Third Amended Use by Special Review Permit for open pit
mining and materials processing (sand, gravel, and stone), an Asphalt and Concrete
Batch Plant, an oil and gas support and service facility, pipeline and roust -a -bout and a
private commercial recreational facility (water skiing lake and primitive campsite for
water skiing members with hours of operation, for the water skiers, from sunrise to
sunset from April 15 to October 14 of any given year) to add additional RV storage near
Camp Lake, to add 12 camping spots around Camp Lake, to allow overnight camping
along the South Lake, to keep the RVs in the same spot all year, to add electrical to
each camping location and to revise some of the Development Standards in the A
(Agricultural) Zone District.
There is a private residence on the property which is served by North Weld Water
District and an OWTS system (SP -9700216). The applicant is not proposing to use the
residence for business purposes associated with the amended USR. Portable toilets
will be provided. The applicant is not proposing to provide bottled water, indicating that
guests will bring their own water to the site in self-contained RV's. Many of the
development standards are kept from the original USR but may contain new verbiage.
Environmental Health Services has no issue with Development Standards requested by
the applicant.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100,5, CRS.) shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.

2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The facility shall operate in accordance with Chapter 14, of
the Weld County Code. The facility shall adhere to the approved Waste Handling
Plan.
4. Fugitive dust should attempt to be confined on the property. Uses on the
property should comply with the Colorado Air Quality Commission's air quality
regulations.
5. All chemicals must be handled in a safe manner in accordance with product
labeling. All chemicals must be stored secure, on an impervious surface, and in
accordance with manufacturer's recommendations.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Light Industrial Zone as delineated in 25-12-103 C.R.S.
7. Any On -site Wastewater Treatment system located on the property must comply
with all provisions of the Weld County Code, pertaining to On -site Wastewater
Treatment Systems.
8. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes if the watersports and camping operations exceed six months of use in
a calendar year.
9. Recreational Vehicle (RV) units that have self-contained sewage disposal, shall
dispose of sewage at an approved off -site facility.
10. For patrons using the site, portable toilets are acceptable. Records of maintenance
and proper disposal for portable toilets shall be retained on a quarterly basis and
available for review by the Weld County Department of Public Health and
Environment. Portable toilets shall be serviced by a cleaner licensed in Weld
County, shall contain hand sanitizers. Portable toilets shall and be screened from
existing adjacent residential property and public view.
11. The applicant shall be made aware that the lake water may not meet all water
quality standards for natural swimming areas, as defined by the Colorado
Department of Public Health and Environment. The WCDPHE encourages the
applicant to periodically test the lake water.
12. The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

We have reviewed the above referenced application for an amendment to Site Specific
Development Plan and Use By Special Review Permit No. USR95-1075 for the Greeley Pit. The
submitted material does not appear to qualify as a "subdivision" as defined in section
30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11,
2011 memorandums to county planning directors, this office will only perform a cursory review of the
referral information and provide comments.
The application seeks an amendment to the Site Specific Development Plan and Use by
Special Review for a site totaling approximately 166 acres in size. The site currently contains a gravel
pit ("Greeley Pit"), oil and gas support and service facility, an existing single-family residence, and
private commercial recreational facilities (water skiing and camping). The application seeks to add
additional RV storage at the site, add camping spots, allow overnight camping, allow RVs to remain
onsite year-round, add electrical access to each camping location, and to revise Development
Standards.
The Greeley Pit is operated under Colorado Division of Reclamation, Mining and Safety
("DRMS") permit no. M-1977-151. Depletions due to past and present evaporation of exposed
groundwater and dust control operations are replaced under a Substitute Water Supply Plan ("SWSP")
approved by this office. The current SWSP approval is valid through March 31, 2022. According to
materials submitted with the SWSP request, the final reclamation plan for the mining site is to
create four unlined lakes with a total surface area of 95 acres. According to the SWSP request, the
applicant is in the process of acquiring the additional replacement water necessary for the long-term
augmentation of the final reclamation of 95 acres of exposed groundwater. If the applicant is not
able to purchase additional replacement water, they may be required to backfill exposed
groundwater areas not covered by their existing replacement water supply.
Potable water is currently supplied to the single-family dwelling and non -camping facilities
through an existing tap from the North Weld County Water District ("NWCWD"). The NWCWD most
recently provided updated supply and demand information via the Tri-Districts on December 18,
2012. The document showed that NWCWD's firm yield supply of 6,392 acre-feet greatly exceeded its

dry year planning demand of 4,702 acre-feet. This office considers the NWCWD to be a reliable water
source. Potable water is not provided to the RV and camping sites on the property. Campers must
bring their own potable water. Portable toilets serve as the sanitary facilities for campers.
According to records available to this office, five wells identified as well permit nos. 45974,
45975, 14147-F, 11845-F, and 19712-F and decreed as Strong Wells #7-9 and #11-12 in Division 1
Water Court case no. W-3352 previously supplied water to the property. Well permit nos. 45974 and
45975 were issued for the wells' historical domestic use. Well permit no. 14147-F was issued for
industrial truck washing. Well permit no. 11845-F was issued for dewatering associated with the
gravel pit operations. Well permit no. 19712-F was issued for irrigation of 40 acres in the SW 1/4 of the
NW '/a, Section 31, Township 6 North, Range 65 West of the 6th P.M. Field inspection reports by a
Well Augmentation Coordinator from the Division 1 Office suggest that the wells with permit nos.
14147-F, 11845-F, and 19712-F may not exist anymore. If any of these wells are no longer in
existence, the property owner should submit an Abandonment Report (GWS-09) to this office for
each well no longer in existence. In addition, if any of the wells with permit nos. 14147-F, 11845-F,
or 19712-F are in existence, the property owner should be aware that they cannot legally be used
until they are first included in an approved substitute water supply plan or a water court decreed
augmentation plan and meet the measurement rules.
