RESOLUTION
WHEREAS, on or about June 22, 1973, Weld County, Colorado, did
,sustain damage to a bridge located on County Road No, 21, said bridge
having been destroyed by negligence of Exeter Drilling Company due to
moving of overweight heavy equipment thereover, and
WHEREAS, the Board of County Commissioners, Weld County,
Colorado, did request the engineering firm of Nelson, Haley, Patterson
& Quirk to submit an estimate of costs to replace said damaged bridge
structure, and
WHEREAS, said engineering firm of Nelson, Haley, Patterson &
Quirk did render an estimate of $28, 240. 00, being the figure it arrived
at to repair said damaged bridge and as demonstrated in letter of
October 31, 1973, copy attached hereto and made a part hereof by
. reference, and
WHEREAS, Crawford & Co. , insurance adjuster, on behalf of
Exeter Drilling Company, made an offer of $25, 000. 00 cash as complete
settlement of any and all damages to said County owned bridge No. 21
hereinabove mentioned, and
WHEREAS, the Board, after careful consideration of said offer of
settlement, has determined that it would be in the best interests of the
County to accept said offer of settlement.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that the hereinabove mentioned
offer of settlement in the sum of $25, 000. 00 be, and the same is hereby
accepted.
BE IT FURTHER RESOLVED, that Samuel S. Telep, Weld County
Attorney, be and he hereby is authorized, on behalf of Weld County, to
accept said offer of $25, 000. 00 as complete settlement of any and all
damages that Weld County may have against Exeter Drilling Company
and that he be further authorized to sign any release or releases relative
thereto that may be required.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 6th day of March, A. D. ,
1974, nunc pro tune as of February 13th, 1974.

RESOLUTION
WHEREAS, it is the desire of the Board of County Commissioners,
Weld County. Colorado, to lease from McCoy Company, Denver,
Colorado, one Tacon MG1900 Snow Blower with caterpillar 3160 engine,
stock No. NOM 31960, Serial No. 7D5202, installed on 930 Wheel
Loader S. N. 41K3342, as per lease rental agreement dated February 20,
1974, including Sales Invoice 1269, and Sales Contract, all attached
hereto and made a part hereof by reference, in accordance with the
rental terms as contained therein,
NOW, THEREFORE, 13E 1T RESOLVED, that the County of Weld,
State of Colorado, agrees to lease purchase from McCoy Company,
Denver, Colorado, the hereinabove mentioned Tacon MG1900 Snow
Blower and appurtenant attached equipment, if any, all as recited in
said lease rental agreement as submitted.

WHEREAS, a public hearing was held on January 14, 1974, in the
chambers of the Board of County Commissioners, Weld County,

WHEREAS, there was some opposition to the request of petitioner
for the location of said gravel pit operation, and
WHEREAS, the said requested gravel pit operation is located in
an agricultural zone, as set forth by the Weld County Zoning Resolution,
and
WHEREAS, according to Section 3. 3(8) and Section 6. 1(3) of the
. Zoning Resolution of Weld County, said gravel pit operation may be
authorized upon the' approval of the Weld County Planning Commission
and the Board of County Commissioners of Weld County, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present; has studied the request of
the petitioner and studied the recommendations of the Weld County
Planning Commission, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED by the Hoard of County
Commissioners, thg.t the application of Robert Jenson, c/o Waverly
Homes, Inc. , 4643 Wadsworth Boulevard, Wheat Ridge,, Colorado, to
locate a gravel pit operation on the premises indicated above be, and
it hereby is granted under the conditions following:
1. That any water and sanitation facilities to be installed shall
lie approved by the State Health Department.
2. That owner, contractor or operator, prior to opening any
pit, shall submit iodation of pit, owner's name, and description of pit
operation to the Weld County Engineer, and shall submit complete unit
development plans for each gravel pit operation for approval by the
Weld County Planning Commission and such unit development plan shall
be filed in the office of the Weld County Clerk and Recoi.der. .
3. That petitioner shall proceed with due dilige rice to effect
construction of said gravel pit operation and that he shall have up to
one year from date hereof to begin the construction of tiame; otherwise,
the Boarcl may, for good .cause shown, on its own motion, revoke the
permit herein granted.

•1. That the operation and development of each gravel pit
excavation and rehabilitation shall be in accordance with the rules and
resulations for the operation of gravel pits as adopted by Weld County,
c h)rado.
5. That all applicable subdivision regulations and zoning
i_ilations shall be followed and complied with in accordance with the
. totiin Resolutions of Weld County, Colorado.

RESOLUTION
RE: DISSOLVING THE LAR.IMER-WELD REGIONAL PLANNINZ
COMMISSION.
WHEREAS, The Larimer-Weld Regional Planning Commission
has been duly organized pursuant to Article 2, Chapter 106 of the
1963 Colorado Revised Statutes and has been operating as such from
and since September 24, 1969; and
WHEREAS, effective November 28, 1973, the Larimer-Weld
Regional Council of Governments was duly organized, the purposes
and functions of which may overlap with the purposes and functions
of the Larimer-Weld Regional Planning Commission; and
WHEREAS, Administrative efficiency would be encouraged if
all of the functions of the Larimer-Weld Regional Planning
Commission were to be handled through the Larimer-Weld Regional
Council of Governments;
NOW, THEREFORE, BE IT RESOLVED that effective April 3,
1974, the Larimer-Weld Regional Planning Commission be dissolved
and cease to operate, that all official records, plans and maps be
released and transferred to the Larimer-Weld Regional Council of
Governments to be maintained as the official documents of the
Council of Governments, that all contractual rights and obligations
and all property of any kind belonging to the Larimer-Weld Regional
Planning Commission be transferred to the Larimer-Weld Regional
Council of Governments,
BE IT FURTHER RESOLVED that the Larimer-Weld Regional
Council of Governments be encouraged to appoint an advisory
committee substantially comprised of the present members of the
executive committee of the Larimer-Weld Regional Planning
Commission to meet on a regular basis and advise the Larimer-Weld
Regional Council of Governments with respect to all matters con-
cerning land use planning within the Larimer-Weld region,
CONSENT TO RESOLUTION DISSOLVING THE
LARIMER-WELD REGIONAL PLANNING COMMISSION
The Board of County Commissioners, Weld County, Colorado,
having considered the hereinabove Resolution dissolving the Larimer-
Weld Regional Planning Commission, hereby consents to said
Resolution and further agree that the action dissolving the Larimer-
Weld Regional Planning Commission may be done by means of a
written consent without a meeting; FURTHER, that the Board be, and
it hereby is, authorized to execute such consent and to make the same
effective as hereinabove stated.
The above and foregoing Resolution dissolving the Larimer-Weld
Regional Planning Commission, including consent to Resolution

wheat; 1/3rd of oats; 1 /3rd of barley; 1/3rd of beans; 1/3rd of corn; 1 /2
o: hay, and 1/3rd of all other crops grown on said premises; all of which
. (except hay) shall be delivered to the nearest market, and the proceeds
paid in joint check to Lessors and Lessee; the Lessee shall furnish all
sacks for crops marketed in bags and Lessors shall pay for its propor-
tionate part in which its share of crops is marketed. The hay shall be •

stacked on the premises and divided by measurement before feeding is
done therefrom, and if Lessee's stock is fed therefrom, he shall be
charged with one-third of a ton per month for each head of stock fed.
All straw, beet tops and fall and winter pasturage, shall be divided
1/2 to Lessors, and 1/2 Lessee, but, if same is fed on the premises by
Lessee, all shall belong to the Lessee.
The Lessee covenants and agrees as follows:
1. To plow, prepare seed bed, cultivate and farm all lands in
a good far mlike manner.
2. To use said premises as a farm and will not use or permit same
to be 'used for any unlawful business or purpose.

there.of without written consent of Lessors.

corrals, pumps, well, well fittings, fences, vines, shrubbery and orchard

now; o do no act whereby any insurance on buildings may be invalidated;

improvement of any kind.
5. To haul out all manure on said premises and spread same for
fertilizer before planting crops.
6. To clean out and maintain.the main lateral to the premises,
and all sub-laterals on the premises, and to do the proportionate part of

cleaning of such laterals used jointly with others.
• ?. To well and seasonably put in, tend, and harvet all crops and to
use only first class seed; to properly irrigate•all crops as often as
necessary to produce the best results and to the full extent of the water
supplied; to harvest all potatoes before October 15, and all beets before

8. To cut all weeds along public highways, private roadways,
lateral oitches and fences and in fields before the seed thereof matures.
9. The Lessors shall have the right of entry, at all times, to
inspe:ct the buildings, premises and crops growing thereon. If Lessee
fails to properly tend, care for or harvest the crops grown on the premises,
the Lessors shall have the right of entry and to take over and perform the
duties of the Lessee in respect thereto, and to charge the expense thereof
to the Lessee and deduct same from Lessee's share of the crop.

10. The Lessors .shat: have a lien on all goods, chattels and other
property and share of crops of the Lessee for the rent, damage and waste
due to the Lessors under the terms of this lease.

14. It is further agreed that the cost of all fertilizer shall be snared
according to crop proration, and Lessors will furnish alfalfa seed and Lessee
will furnish all other seed.

and spraying and Lessee will apply same; in the event of application by plane
the cost shall be prorated according to crop division.

17. It is further agreed that Lessee will make no major improvements
until approval is received by Lessors' agent, The Weld County 1Viunicipal
Airport Board.
18. It is further agreed that Lessors may designate another person or '
persons as manager, and said agent shall have the authority to conduct
negotiations with Lessee concerning operation of the leased premises.
19, It is further agreed that Lessors may, during the term of this lease
or any extension thereof, extend the runway of the Weld County Muncipal
.airport over and across a portion of said leased premises, and may install
other improvements thereon, and in that event the portion used for such runway
or :or any other improvements that may be installed thereon shall be removed
2rom the terms of this lease and Lessee shall waive any and all claims for
damages or otherwise (excepting any damage to growing crops) for
un-availability of this portion of said leased premises.

RESOLUTION
WHEREAS, heretofore and on May 16, 1973, by Resolution, the
Board of County Commissioners, Weld County, Colorado, did authorize
the execution of a contract and agreement with Penner Construction
Company, Lakewood, Colorado, to construct the Weld County Recreation
Building at Island Grove Park and to pay therefor from Federal Sharing
Revenue Funds, all pursuant to proper advertisement for bids and in
accordance with statutes for said purpose, and
WHEREAS, it has now come to the attention of the Board that
said construction of the aforesaid building is subject to AIA Document
G701 concerning Change Order No. 5, with reference made to
A'rchitect's Project No. 73-1-CCA-011.7 concerning complete ton-
, struction work and with further reference made to contract date of
July 13, 1973, copies attached hereto for ready reference, and•
WHEREAS, in order to be in compliance with the Federal Law,
the Board believes it to be in the best interest of the County to' incor-
porate the aforesaid Change Order No. 5 within the contract and agree-
ment previously entered into with Penner Construction Company. ;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that Change Order No. 5
hereinabove mentioned and made a part hereof by reference, be and
the same hereby is ordered to be made a part of the contract and agree-
ment heretofore mentioned and entered into between Weld County and
Penner Construction Company for the erection of the Weld County
Recreation Building at Island Grove Park.

RESOLUTION
IN THE MATTER OF WELD COUNTY, COLORADO, SELLING THE
FORMER WELD COUNTY GENERAL HOSPITAL BUILDING.
WHEREAS, the Board of County Commissioners, Weld County,
Colorado, has determined that Weld County cannot justify the expenditure
of public funds to repair and/or remodel the former Weld County General
Hospital Building located at the corner of 11th Avenue and 16th Street,
Greeley, Colorado, and
WHEREAS, the Board has further determined that said building,
until recently occupied by the Weld County Department of Social Services
and by the Weld County Nursing Home, has depreciated physically,
functionally and economically, to the point that it is of no further use to
the County and should be declared surplus and sold; and that it would be
in the best interest of the County to sell the same, including all the
personalty appurtenant thereto.
NOW, THEREFORE, BE IT RESOLVED, by the I3oard of County
Commissioners, Weld County, Colorado, and it hereby authorizes and
directs Mr. Barton Buss, Chief Accounting Officer for Weld County, to
proceed to sell the aforementioned real property, including the personalty
appurtenant thereto, at no less than the market value obtainable therefor,
and any and all moneys received from the sale of such property shall be
deposited into the County General Fund.
BE IT FURTHER RESOLVED, by the Board, and it hereby
authorizes and directs Mr. Barton Buss to obtain two independent
appraisals of the property to be sold and to proceed with due diligence
to effect the sale thereof and make a report of such sale to the Board of
County Commissioners for ratification of sale and issuance of proper
deed of conveyance to the successful buyer.

RE: REGULATING, WARNING AND GUIDING TRAFFIC ON COUNTY
ROADS AND AT COUNTY ROAD INTERSECTIONS IN WELD
COUNTY, COLORADO.
WHEREAS, a multitude of complaints have been made to the Board
of County Commissioners of Weld County, Colorado, that drivers of motor
vehicles habitually drive on County Roads and through County road inter-
, sections without regard for the general safety of drivers of other motor
vehicles, and
'WHEREAS, pursuant to 1963 Colorado Revised Statutes, 13-5-69(1),
as,amended, local authorities, with reference to streets or highways
under their .jurisdiction, are authorized to designate through streets or
• highways and erect stop signs at specified entrances thereto, and
WHEREAS, the .Board, pursuant to such complaints, has deter-
mined upon the basis of traffic and personal investigation that conditions
exist which make it necessary to regulate, warn and guide vehicular
traffic on County roads by posting signs thereon. •
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that the Board deems it
necessary to regulate, warn and guide traffic on County roads and any
intersections thereof, and it hereby authorizes and orders the posting
of such traffic control devices as shall be reasonably necessary to
regulate, warn and/or guide traffic thereon for the safety of the general
public and that said traffic control devices shall conform to the State
Manual and specifications.
• BE IT FURTHER RESOLVED, that the Board of County Commissioners,
• Weld County, Colorado, does declare and establish the following not to be
through streets or highways for the named portions of County roads which
shall become effective when standard stop signs are erected at the entrances
to:
1. Lee Lake Avenue adjoining northwest subdivision on the
west where• it intersects with County Road No. 76, and
2. County Road No. 15 where it intersects with County
Road No. 76,
all as shown on plat submitted by the County Traffic Engineer and made
a part hereof by reference.

WHEREAS , on May 5 , 1972 , the General Assembly
of the State of Colorado , enacted Senate Bill #35 as relates
to Chapter 106 of the Colorado Revised Statutes , and
WHEREAS, on August 30, 1972 , the Board of County
Commissioners of Weld County, Colorado, adopted Subdivision
Regulations for Weld County, Colorado to comply with the
prescribed Senate Bill #35 , and

from the definition of subdivision is more particularly

Beginning at the Southeast Corner (SE Cor) of said Section 22,
and considering the South line of said Section 22, as bearing
North 88°40 ' 15" West, with all other bearings contained
herein relative thereto;
Thence North 88°40 '15" West, along the South line of said
Section 22, 1329. 90 feet;
Thence North 00°01 ' 14" West, 1320. 59 feet;
Thence South 88°35 ' 30" East, 1330. 51 feet;
Thence South 00°00 ' 00" West, along the East line of said

RESOIXTION
WHEREAS, pursuant to law, the Board of County Commissioners,
Weld County, Colorado, is vested with the responsibility of administering
the affairs of Weld County, Colorado, and
WHEREAS, the County of Weld, State of Colorado, has accumu-
lated many and sundry items of dilapidated and used office furniture and
equipment in the normal course of usage over the past several years,
per attached Exhibit A, and
WHEREAS, said items of office furniture and equipment are con-
sidered to be of no further benefit or use to the County and the Board
believes it to be in the best interest of the County that said items of
personal property be declared surplus property and sold.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that Mr. Barton Buss, Chief
Accounting Officer and Purchasing Agent for Weld County, advertise
the sale of said hereinabove mentioned porsonal property pursuant to
statutes governing such sales; and that any and all moneys received
from such sale shall be deposited into the County General Fund.

WHEREAS, at a regularly held meeting of the Board of
County Commissioners, Weld County, Colorado, on March 20th ,
1974, Gene C. O'Connor of Transcontinent Oil Company, Denver,
Colorado, submitted to the Board ten (10) separate oil and gas
leases covering 3, 734, 43 net acres of county owned mineral lands
situate in the County of Weld and State of Colorado and more
particularly described as shown on sight draft dated March 6,
1974 and in accordance with letter of March 1, 1974, marked
Exhibits A and B respectively, and which are incorporated
herein for ready reference, and
•
• WHEREAS, Gene C. O'Connor of Transcon inent Oil
Company has offered to purchase the hereinabove escribed leases
for the sum of $7, 468. 86 and the said Board deems it to be in the
. best interest of the County that said leases be executed in accordance
with the terms therein.

JOINT RESOLUTION
,Regarding Island Grove Park
WHEREAS , there is now located within the city limits of Greeley,
Colorado a public park known as the Island Grove Park; certain city
buildings and structures are located on the Island Grove Park and
certain public buildings owned by the County of Weld are located on
the fringes of the park, and
;WHEREAS , the City of Greeley and the County of Weld: are considering
an arrangement whereby the city and the county woul , operate , maintain

and develop the Island Grove Park, and the public f cilities in and
near the Island Grove Park, on a joint and cooperative basis , as
authorized by Article 2 of Chapter 88 of the Colorado Revised Statutes
of 1963 , as amended , , and. by Section 18 (2)(a) of Article XIV of the
Colorado Constitution, as amended , and :
WHEREAS , the joint arrangement , as now envisaged, would involve,
among other things , placing the day-to-day manages ni of said park
and lfacilities under, the direction of a board of seven individuals
selected by the city and the county , which board wo ld. be, known as the
Island Grove Park Board, and
WHEREAS , the contemplated arrangement can be 1 gally effected
only if the city and the county enter into a formal contract , and' in
the case of the City of Greeley , only if such contr et is authorized
by ordinance, and •
' WHEREAS , the City Council of the City of Greeley and the Hoard of
Commissioners of the County of Weld will require ad ice and information,
before they can intelligently consummate the joint rrangement byi
entering into a formal contract , and the City Council and the Board
of Commissioners have concluded that an Island Grov Park Board should
now be created for the limited purpose of investigating all facets
of the contemplated arrangement and reporting the results of those
investigations to the City Council and the Board of Commissioners ;
NOW, THEREFORE , BE ' IT RESOLVED BY THE CITY CO NCIL OF THE CITY
OF GREELEY , AND THE ?BOARD OF COMMISSIONERS OF THE OUNTY OF WELD,
AS FOLLOWS :
1. An Island Grove Park Board is hereby cre ted and it is hereby
determined that the -Board shall consist of seven ( 7) individuals ,

three to be appointed by the City Council of she City of Greeley ,
Colorado, an additional three to be appointed by the Board of Com-
missioners of the County of Weld, and the seventh to be appointed by
the concurring action of the six appointees .
2 . Until such time as a formal contract between the City of
Greeley and the County of Weld pertaining to the Island Grove Park has
been consummated, the sole function of th Island Grove Park Board shall
be to investigate on all facets of the pr posed ,joint arrangement des-
cribed generally above and to report the esults of those investiga- ir .
tions to the City Council and the Board of Commissioners.
3. Each of the governing bodies shall name its three appointees
i within thirty (30) days of this Resolution , and each of the governing
bodies. hereby authorizes and directs its appointees to cooperate in the
selection of the seventh member of the Boa d and to diligently conduct
the investigations and reports referred to above.
4 . The adoption of this Resolution shall not be construed as
imposing any obligation on either the City of Greeley or the County of
Weld to consummate an arrangement for the management of Island Grove
Park and the public facilities in and near the park on a joint basis .

WHEREAS, a multitude of complaints have been made to the Board •
of County Commissioners of Weld County, Colorado, that motor vehicles
are habitually being .driven at speeds greater than is reasonable and pru-
dent along that part of said highway, being in Weld County, and known as

WHEREAS, the said applicant having paid to the County
Treasurer the .sum of fifty dollars ($50) therefore , and having
produced a State Retail License for sale of 3. 2% beer only, outside
the corporate limits of any town or city in the County of weld,
at the location described as follows :
A portion of the E1SW1 of Section 11, Township 1 North,

located approximately 500 feet North of the County

good for one year from the date of issue unless revoked according to
law, provided, however, that the place where licensee is authorized
to sell beer under said license will be conducted in strict conformity

WHEREAS, a public hearing was held on March 11, 1074, in the
chambers of the Board of County Commissioners, Weld County, Colorado,

District to "C" Commercial District, Planned Unit Development, and

Weld County, Colorado, is vested with the responsibility of
administering the affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board that there
is a need to purchase 2, 500 Sets of Fixed Asset Transaction
Forms for County use, and
WHEREAS, the Board believes it to be in the best interest
of the County to seek bids for the Board' s approval relative
to the purchase of the aforementioned forms as desired by the
County.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that Mr. Barton Buss,
Chief Accounting Officer of Weld County, advertise for bids
to purchase the aforementioned forms as specified by the
County.
BE IT FURTHER RESOLVED, that the Board be, and it hereby
is authorized to execute an agreement with the successful

Transaction Forms for the County and to make the same effective
forthwith.

RE: WELD COUNTY HOME RULE CHARTER.
WHEREAS, pursuant to Chapter 105, Session Law, State
of Colorado, 1971, a county in the State of Colorado may
locally initiate and adopt a county charter for the
establishment, organization and structure of its county
government, and
WHEREAS, a petition of not less 5% of the registered
qualified electors of Weld County, Colorado, has been •
submitted to the Board of County Commissioners , Weld County,
Colorado, requesting that a charter commission be established;
and further requesting that an election be held on or
before the next general election for the purpose of
determining whether or not a charter commission shall be
elected.
NOW, THEREFORE, BE IT RESOLVED, by the Board of
County, Commissioners, Weld County, Colorado, that pursuant
to said Chapter 105, Session Law, State of Colorado,
1971, an election is hereby called and shall be held on
November 5th, 1974, conterminously with the general election
of the State of Colorado held thereon.
At such general election:
(a) Voters shall cast ballots for or against
forming a charter commission for the said County
of Weld, State of Colorado;
(b) Voters shall also cast ballots for electing the
requested number of members of the charter
commission;
BE IT FURTHER RESOLVED, That pursuant to said Chapter
105, Session Law, State of Colorado, 1971, the County of
Weld is hereby divided into three (3) Districts for the
purpose of electing members to a charter commission for

the said County of Weld. The three (3) district created
by this Resolution shall be the same three districts
into which the county was divided for the purpose of
electing County Commissioners and as the Commissioner Districts
were created and described by Resolution of the Board of
County Commissioners of the said County of Weld on the 16th
day of May, 1972; a copy of which Resolution is attached
hereto, marked Exhibit A, and made a part hereof.
BE IT STILL RUTHER RESOLVED, That a notice of the
election hereby called shall be published in The Greeley

Board of County Commissioners, Weld County, Colorado, did grant
a site permit to Premier Corporation, c/o Philip Higbee, 2 Bar
2 Ranch, Roggen, Colorado, for the location and operation of a cattle
feedlot operation pursuant to Section 3. 3 (3)(c) of the Zoning Resolution
of Weld County, Colorado, and
WHEREAS, subject property cattle feedlot operation was to have
been located on the following described property, to-wit:
The Southeast Quarter (SE:0 and the Northeast Quarter
(NE.1) of Section One (1), Township One (1) North,
Range Sixty-Three (63) West of the Sixth P. M. , Weld '
County, Colorado, containing 320 acres, more or less, i

WHEREAS, said permit as hereinabove stated was granted with
certain conditions, all as recited in the hereinabove mentioned
Resolution, copy attached hereto and made a part hereof, and '

, never did come into existence, and that to the present time there is M

no indication that any effort whatsoever has been made to pursue the
installation and/or development of said cattle feedlot operation upon

NOW, THEREFORE, You are hereby ordered to appear before
the Board of County Commissioners, in the Weld County Courthouse,
Greeley, Colorado, on the 22nd day of April , A. D. , ¢
1974, at the hour of 1:30 7•M. , or as soon after as you can be
heard to show cause why your said permit to operate a cattle feedlot
operation upon the premises hereinabove described should not be ,
revoked as by law provided.

RESOLUTION
WHEREAS, the City of Greeley, Colorado, and the Greeley
Ambulance Company have entered into an agreement whereby the Greeley
Ambulance Company guarantees to provide ambulance services to the
City of Greeley and to the County of Weld purusant to said ambulance
service agreement marked "Exhibit A", and
WHEREAS, the City of Greeley, Colorado, has now submitted
an agreement entitled "Participation Agreement", incorporating therein
the aforementioned service agreement marked "Exhibit A" providing
for said ambulance service to both the City and the County, and
WHEREAS, the Board of County Commissioners, Weld County,
Colorado, has determined that said agreement providing ambulance
services for both the City of Greeley and the County of Weld would
greatly benefit the County, and that it would be in the best interest of the
County to participate with the City of Greeley providing for the necessary
ambulance services all in accordance with the terms and conditions
thereof.
NOW, THEREFORE, BE IT RESOLVED, that the agreement with
the City of Greeley and the Greeley Ambulance Service, copy of which is
attached hereto and made a part hereof, be approved.
BE IT FURTHER RESOLVED, that the Board be, and he hereby
is authorized to execute the agreement entitled "Participation Agreement"
and to make the same effective forthwith.
The above and foregoing Resolution was, on motion duly made and

THIS AGREEMENT, made and entered into this 2nd day of
April , 1974, by and between the City of Greeley, Colorado, a municipal
corporation, hereinafter referred to as "City", and Greeley Ambulance
Co. , a Colorado corporation, hereinafter referred to as "Greeley Ambu-

WITNESSETH:
WHEREAS, an agreement regarding ambulance service is now in
force between these parties, said agreement being dated April 15, 1969,
and covering a period ending April 1, 1974; said agreement is hereinafter
referred to as the "old agreement' , and
WHEREAS, the parties intend this instrument to supersede the
old agreement, and
WHEREAS, Greeley Ambulance has provided in the past, and in-

citizens of Greeley and Weld County require, and

to provide financial assistance to Greeley Ambulance to assure tnat a

(1) Greeley Ambulance acknowledges that it has been paid $1, 740
by the City, under the old contract, for the period from January 1, 1974,
through March 31, 1974. Greeley Ambulance hereby waives and releases 1.
any and all right to receive any additional compensation pursuant to the
old contract, for services rendered by Greeley Ambulance at any time
up to Apri'. 1, 1974. Accordingly, the City is hereby excused from paying
Greeley Ambulance 80% of its uncollected bills, as now provided in para-
.
graph 8 of the old contract, regardless of whether those bills are for
services rendered in 1974 or earlier years and regardless of whether
or not those bills already have been delivered to the City, pursuant to
paragraph 7 of the old contract. In return, the City hereby waives and
releases any claim it might have to receive a portion of amounts col-
lected on rills, as now provided in paragraph 9 of the old contract.
(2) So long as it continuously provides the ambulance service
described generally in paragraph 3 of this instrument, Greeley Ambu-
lance shall be paid $16, 200 for the period from the date of this instru-

payments of $1, 800 each, on the first days of April through December
of 1974. The City shall make such payments, one half from its own
funds and the other one half from the County of Weld, pursuant to a
participation agreement of even date. Such payments shall constitute
the sole compensation to be paid by the City to Greeley Ambulance, it
being understood that the City shall bear no part of Greeley Ambulance's
uncollected bills; provided however, the foregoing limitation is not in-
tended to provide free service to the City, and the City shall be obli-
gated to pay for ambulance service, to the same extent as Greeley-
Ambulance's other customers.
(3) Greeley Ambulance agrees:
' I(a) to provide ambulance service in the City of Greeley
and in all parts of Weld County not adequately served by
other ambulance companies or public agencies;
