RESOLUTION WHEREAS, on or about June 22, 1973, Weld County, Colorado, did ,sustain damage to a bridge located on County Road No, 21, said bridge having been destroyed by negligence of Exeter Drilling Company due to moving of overweight heavy equipment thereover, and WHEREAS, the Board of County Commissioners, Weld County, Colorado, did request the engineering firm of Nelson, Haley, Patterson & Quirk to submit an estimate of costs to replace said damaged bridge structure, and WHEREAS, said engineering firm of Nelson, Haley, Patterson & Quirk did render an estimate of $28, 240. 00, being the figure it arrived at to repair said damaged bridge and as demonstrated in letter of October 31, 1973, copy attached hereto and made a part hereof by . reference, and WHEREAS, Crawford & Co. , insurance adjuster, on behalf of Exeter Drilling Company, made an offer of $25, 000. 00 cash as complete settlement of any and all damages to said County owned bridge No. 21 hereinabove mentioned, and WHEREAS, the Board, after careful consideration of said offer of settlement, has determined that it would be in the best interests of the County to accept said offer of settlement. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, Weld County, Colorado, that the hereinabove mentioned offer of settlement in the sum of $25, 000. 00 be, and the same is hereby accepted. BE IT FURTHER RESOLVED, that Samuel S. Telep, Weld County Attorney, be and he hereby is authorized, on behalf of Weld County, to accept said offer of $25, 000. 00 as complete settlement of any and all damages that Weld County may have against Exeter Drilling Company and that he be further authorized to sign any release or releases relative thereto that may be required. WHEREAS, The Larimer-Weld Regional Planning Commission has been duly organized pursuant to Article 2, Chapter 106 of the 1963 Colorado Revised Statutes and has been operating as such from and since September 24, 1969; and WHEREAS, effective November 28, 1973, the Larimer-Weld Regional Council of Governments was duly organized, the purposes and functions of which may overlap with the purposes and functions of the Larimer-Weld Regional Planning Commission; and WHEREAS, Administrative efficiency would be encouraged if all of the functions of the Larimer-Weld Regional Planning Commission were to be handled through the Larimer-Weld Regional Council of Governments; NOW, THEREFORE, BE IT RESOLVED that effective April 3, 1974, the Larimer-Weld Regional Planning Commission be dissolved and cease to operate, that all official records, plans and maps be released and transferred to the Larimer-Weld Regional Council of Governments to be maintained as the official documents of the Council of Governments, that all contractual rights and obligations and all property of any kind belonging to the Larimer-Weld Regional Planning Commission be transferred to the Larimer-Weld Regional Council of Governments, BE IT FURTHER RESOLVED that the Larimer-Weld Regional Council of Governments be encouraged to appoint an advisory committee substantially comprised of the present members of the executive committee of the Larimer-Weld Regional Planning Commission to meet on a regular basis and advise the Larimer-Weld Regional Council of Governments with respect to all matters con- cerning land use planning within the Larimer-Weld region, CONSENT TO RESOLUTION DISSOLVING THE LARIMER-WELD REGIONAL PLANNING COMMISSION The Board of County Commissioners, Weld County, Colorado, having considered the hereinabove Resolution dissolving the Larimer- Weld Regional Planning Commission, hereby consents to said Resolution and further agree that the action dissolving the Larimer- Weld Regional Planning Commission may be done by means of a written consent without a meeting; FURTHER, that the Board be, and it hereby is, authorized to execute such consent and to make the same effective as hereinabove stated. Deputy Co(inty Cler % A PPROVT AS TO FORM: c ' County Atorney JOINT RESOLUTION ,Regarding Island Grove Park WHEREAS , there is now located within the city limits of Greeley, Colorado a public park known as the Island Grove Park; certain city buildings and structures are located on the Island Grove Park and certain public buildings owned by the County of Weld are located on the fringes of the park, and ;WHEREAS , the City of Greeley and the County of Weld: are considering an arrangement whereby the city and the county woul , operate , maintain r and develop the Island Grove Park, and the public f cilities in and near the Island Grove Park, on a joint and cooperative basis , as authorized by Article 2 of Chapter 88 of the Colorado Revised Statutes of 1963 , as amended , , and. by Section 18 (2)(a) of Article XIV of the Colorado Constitution, as amended , and : WHEREAS , the joint arrangement , as now envisaged, would involve, among other things , placing the day-to-day manages ni of said park and lfacilities under, the direction of a board of seven individuals selected by the city and the county , which board wo ld. be, known as the Island Grove Park Board, and WHEREAS , the contemplated arrangement can be 1 gally effected only if the city and the county enter into a formal contract , and' in the case of the City of Greeley , only if such contr et is authorized by ordinance, and • ' WHEREAS , the City Council of the City of Greeley and the Hoard of Commissioners of the County of Weld will require ad ice and information, before they can intelligently consummate the joint rrangement byi entering into a formal contract , and the City Council and the Board of Commissioners have concluded that an Island Grov Park Board should now be created for the limited purpose of investigating all facets of the contemplated arrangement and reporting the results of those investigations to the City Council and the Board of Commissioners ; NOW, THEREFORE , BE ' IT RESOLVED BY THE CITY CO NCIL OF THE CITY OF GREELEY , AND THE ?BOARD OF COMMISSIONERS OF THE OUNTY OF WELD, AS FOLLOWS : 1. An Island Grove Park Board is hereby cre ted and it is hereby determined that the -Board shall consist of seven ( 7) individuals , .115 I , r I . three to be appointed by the City Council of she City of Greeley , Colorado, an additional three to be appointed by the Board of Com- missioners of the County of Weld, and the seventh to be appointed by the concurring action of the six appointees . 2 . Until such time as a formal contract between the City of Greeley and the County of Weld pertaining to the Island Grove Park has been consummated, the sole function of th Island Grove Park Board shall be to investigate on all facets of the pr posed ,joint arrangement des- cribed generally above and to report the esults of those investiga- ir . tions to the City Council and the Board of Commissioners. 3. Each of the governing bodies shall name its three appointees i within thirty (30) days of this Resolution , and each of the governing bodies. hereby authorizes and directs its appointees to cooperate in the selection of the seventh member of the Boa d and to diligently conduct the investigations and reports referred to above. 4 . The adoption of this Resolution shall not be construed as imposing any obligation on either the City of Greeley or the County of Weld to consummate an arrangement for the management of Island Grove Park and the public facilities in and near the park on a joint basis . L ' f 4 RESOLUTION WHEREAS, the City of Greeley, Colorado, and the Greeley Ambulance Company have entered into an agreement whereby the Greeley Ambulance Company guarantees to provide ambulance services to the City of Greeley and to the County of Weld purusant to said ambulance service agreement marked "Exhibit A", and WHEREAS, the City of Greeley, Colorado, has now submitted an agreement entitled "Participation Agreement", incorporating therein the aforementioned service agreement marked "Exhibit A" providing for said ambulance service to both the City and the County, and WHEREAS, the Board of County Commissioners, Weld County, Colorado, has determined that said agreement providing ambulance services for both the City of Greeley and the County of Weld would greatly benefit the County, and that it would be in the best interest of the County to participate with the City of Greeley providing for the necessary ambulance services all in accordance with the terms and conditions thereof. NOW, THEREFORE, BE IT RESOLVED, that the agreement with the City of Greeley and the Greeley Ambulance Service, copy of which is attached hereto and made a part hereof, be approved. Greeley Ambulance hereby waives and releases 1. any and all right to receive any additional compensation pursuant to the old contract, for services rendered by Greeley Ambulance at any time up to Apri'. 1, 1974. Accordingly, the City is hereby excused from paying Greeley Ambulance 80% of its uncollected bills, as now provided in para- . graph 8 of the old contract, regardless of whether those bills are for services rendered in 1974 or earlier years and regardless of whether or not those bills already have been delivered to the City, pursuant to paragraph 7 of the old contract. In return, the City hereby waives and releases any claim it might have to receive a portion of amounts col- lected on rills, as now provided in paragraph 9 of the old contract.
