HomeMy WebLinkAbout20212749.tiffRESOLUTION RE: ACTION OF THE BOARD AT SHOW CAUSE HEARING, PCSC20-0030, TO DETERMINE WHETHER OR NOT THE APPLICANT IS IN COMPLIANCE WITH CERTAIN DEVELOPMENT STANDARDS CONTAINED IN USE BY SPECIAL REVIEW PERMIT, USR-1371, FOR A USE PERMITTED AS A USE BY RIGHT, ACCESSORY USE, OR USE BY SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICTS (STORAGE UNITS) IN THE A (AGRICULTURAL) ZONE DISTRICT - BENNIE RODRIGUEZ WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on March 24, 2021, a Show Cause Hearing was conducted to consider revocation of Use by Special Review Permit, USR-1371, for a Use Permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (storage units) in the A (Agricultural) Zone District, issued to Bennie Rodriguez, P.O. Box 1376, Greeley, Colorado 80632, and WHEREAS, Bennie Rodriguez is the current owner of the facility located on property being further described as follows: Lot A of Recorded Exemption, RE -2063; being part of the NW1/4 of Section 35, Township 5 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing on March 24, 2021, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the permit holder, and the recommendation of Planning staff, and having been fully informed, deemed it advisable to continue said hearing until April 7, 2021, at 9:00 a.m., to allow Mr. Rodriguez additional time to evict all persons living on the property and install a lock on the entrance gate, and WHEREAS, at said hearing on April 7, 2021, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the permit holder, and the recommendation of Planning staff, and having been fully informed, deemed it advisable to continue said hearing until July 14, 2021, at 9:00 a.m., to allow Mr. Rodriguez additional time to construct a fence and gate, per the specifications on the USR map, and WHEREAS, at said hearing on July 14, 2021, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the permit holder, and the recommendation of Planning staff, and having been fully informed, deemed it advisable to continue said hearing until September 22, 2021, at 9:00 a.m., to allow Mr. Rodriguez additional time to finish the fence and install a gate, and Gc:Pt.(-rPJcb), E+4(u) CROW), APP[. • 3fty/22 2021-2749 PL1619 CONTINUANCE PCSC20-0030 - BENNIE RODRIGUEZ PAGE 2 WHEREAS, at said hearing on September 22, 2021, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the permit holder, and the recommendation of Planning staff, and having been fully informed, deemed it advisable to continue said hearing until, October 27, 2021, at 9:00 a.m., to allow Mr. Rodriguez additional time to finish the fence and install the Knox Box on the gate. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Show Cause hearing, PCSC20-0030, concerning Use by Special Review Permit, USR-1371, issued to Bennie Rodriguez, be, and hereby is, continued until October 27, 2021, at 9:00 a.m. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 22nd day of September, A.D., 2021.
