Home My WebLink About20210852.tiffRESOLUTION RE: APPROVE BILL OF SALE, AND ACCEPT ASSETS AND AUTHORIZE CHAIR TO SIGN - 911 EMERGENCY TELEPHONE SERVICE AUTHORITY BOARD WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Bill of Sale between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Safety Communications, and the 911 Emergency Telephone Service Authority Board, with further terms and conditions being as stated in said bill of sale, and WHEREAS, after review, the Board deems it advisable to approve said bill of sale, a copy of which is attached hereto and incorporated herein by reference, and accept the assets listed on Exhibit A. In addition, the change will place all the communications equipment and capital infrastructure to support the Weld County Regional Communications Center (WCRCC) in one place on the books of Weld County rather than being split between the county's and the Authority's balance sheets, and WHEREAS, the Board of the Weld 911 Emergency Telephone Service Authority desires that Authority no longer directly purchases capital assets with Authority funds nor carry the assets on the Authority's balance sheet, and WHEREAS, per an intergovernmental agreement (IGA) between the Weld 911 Emergency Telephone Service Authority and the Board of Weld County Commissioners approved on February 16, 2021, Weld County will assume the funding responsibility of communications assets, assume the responsibility of developing and funding the Ten -Year Capital Plan for E911 required assets from a contribution from Authority. The funding of the Ten -Year Capital Plan for E911 required assets will be in the Weld County Capital Expenditure Fund in an earmarked budget unit and separately identified reserve. Assets purchased with Authority funding transferred to the county will be identified on the county books. The current reserve amount in the Authority Fund would be transferred to the Weld County Capital Expenditure Fund per the IGA in the amount of $5,487,604, and WHEREAS, all Authority assets to be transferred are listed on the attached Exhibit A. WHEREAS, the Board of the Weld 911 Emergency Telephone Service Authority wishes to rescind the policy adopted September 15, 1992 concerning the funding of an equipment reserve and depreciation policy effective with the approval of this resolution. NOW, THEREFORE, BE IT RESOLVED, by the Board of the Weld 911 Emergency Telephone Service Authority that the transfer of Authority assets listed on Exhibit A and the reserve amount of $5,487,604 to Weld County are hereby approved. BE IT FURTHER RESOLVED by the Board of the Weld 911 Emergency Telephone Service Authority that the policy adopted September 15, 1992 concerning the funding of an equipment reserve and depreciation policy is hereby rescinded effective with the approval of this resolution. BE IT FURTHER RESOLVED by the Board of the Weld 911 Emergency Telephone Service Authority, if any section, subsection, paragraph, sentence, clause, or phrase of this resolution is for any reason held or decided to be unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The Board hereby declares that it would have enacted this resolution in each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared to be unconstitutional or invalid.
