RE: DESIGNATION OF THE SITE SELECTION AND CONSTRUCTION OF SOLAR
ENERGY FACILITIES GREATER THAN 160 ACRES IN SIZE WITHIN THE
NEAR -URBAN AREA OF UNINCORPORATED WELD COUNTY, COLORADO, AND
THE SITE SELECTION AND CONSTRUCTION OF SOLAR ENERGY FACILITIES
GREATER THAN 320 ACRES IN SIZE WITHIN THE AG -RURAL AREA OF
UNINCORPORATED WELD COUNTY, COLORADO, AS ACTIVITIES OF STATE
INTEREST, PURSUANT TO C.R.S. §24-65.1-203(1)(f)
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant
to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, pursuant to C.R.S. §24-65.1-401, the Board of County Commissioners has
the authority to designate "matters of state interest" in Weld County, which may then be subject
to guidelines and regulations promulgated by the Board, pursuant to C.R.S. §24-65.1-402,
and
WHEREAS, by Resolution #2021-1122, dated April 26, 2021, the Board set a public
hearing on June 14, 2021, to consider designating the site selection and construction of solar
energy facilities greater than 160 acres in size within the Near -Urban Area of unincorporated Weld
County, Colorado, and the site selection and construction of solar energy facilities greater than
320 acres in size within the Ag-Rural Area of unincorporated Weld County, Colorado, as activities
of state interest, pursuant to C.R.S. §24-65.1-203(1)(f), and
WHEREAS, the delineation of the "Near -Urban" and "Ag-Rural" Areas of the
unincorporated portions of Weld County is found in Appendix 21-B of the Weld County Code, and
WHEREAS, pursuant to C.R.S. §24-65.1-404(2)(a), the Board was required to publish
notice of said public hearing in a newspaper of general circulation in Weld County, at least
thirty (30) days and not more than sixty (60) days prior thereto, which notice publication occurred
on April 30, 2021, in the Greeley Tribune, a copy of said notice being attached hereto as
Exhibit "A," and
WHEREAS, the Board conducted said hearing on June 14, 2021, heard testimony and
took exhibits with respect to such designation, and considered that such regulation will:
A. Encourage planned and orderly development of solar energy facilities of the sizes and
within the areas described above;
B. Provide for present and future electrical needs of oil and gas, agriculture, industry,
business, residential and recreation;
C. Encourage use of land in a manner which ensures return to original productivity and
character upon cessation of such use;
D. Ensure coordination and compatibility between large size solar energy facilities and
agriculture;

CONSTRUCTION OF SOLAR ENERGY FACILITIES GREATER THAN 320 ACRES IN SIZE
WITHIN THE AG -RURAL AREA OF UNINCORPORATED WELD COUNTY, COLORADO, AS
ACTIVITIES OF STATE INTEREST, PURSUANT TO C.R.S. §24-65.1-203(1)(f)

E. Conserve soil and agricultural resources;
F. Protect the environment, cultural and historic resources, and wildlife;
G. Promote the efficient and economic use of public resources;
H. Balance the protection, mitigation of damage to and enhancement of environmental
resources with the electrical energy needs of development;
I. Promote efficient and economic use of public resources;
J. Avoid or reduce direct conflicts with adopted local government, regional and state
master plans;
K. Protect the health and welfare of the citizens of Weld County, and
WHEREAS, the Board took into consideration: 1) the intensity of current and foreseeable
development pressures in Weld County, and 2) through the enactment of various legislation,
generation of electricity through solar energy facilities is encouraged in Colorado, and
WHEREAS, at said hearing the Board approved such designation and directed staff to
prepare regulations concerning the activity so designated, in accordance with the requirements
of Section 24-65.1-402, C.R.S., for the Board's consideration.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the site selection and construction of solar energy facilities greater than
160 acres in size within the Near -Urban Area of unincorporated Weld County, Colorado, and the
site selection and construction of solar energy facilities greater than 320 acres in size within the
Ag-Rural Area of unincorporated Weld County, Colorado, be, and hereby are, designated as
activities of state interest, pursuant to C.R.S. §24-65.1-203(1)(f), said Areas being delineated in
Appendix 21-B of the Weld County Code.
BE IT FURTHER RESOLVED by the Board that staff be, and hereby is, directed to
prepare, for the Board's consideration, regulations concerning the activity so designated, in
accordance with the requirements of Section 24-65.1-402, C.R.S.
BE IT FURTHER RESOLVED by the Board that no moratorium, as authorized by
Section 24-65.1- 404(4), C.R.S., shall exist during the pendency of the adoption of the regulations
referred to above.

State Interest, pursuant to C.R.S. §24-65.1-203(1)(f).

days prior to the hearing. The cost of engaging a court reporter shall be borne by the requesting
