Dear Mr. Reck,
You have informed us that Simplot Grower Solutions will be conducting aerial applications to combat crop
insect, weed, and disease pressure from an agricultural aircraft between August 2, 2001 and August 3, 2021.
Please be aware that in accordance with C.R.S. § 30-10-112.5 (2), the Weld County Code contains no
provisions regulating the use or application of pesticides in unincorporated Weld County. Furthermore, no
portions of the Code regulate the flying of airplanes, helicopters or drones that may be used in pesticide
application.
Regarding incorporated areas of cities and towns within Weld County in which your company may be
intending to fly over and/or to apply pesticides by air, I suggest you contact those municipalities to see if
they may have any ordinances regulating such activities.

August 31, 2021.
