RESOLUTION RE: ACTION OF THE BOARD TO SET PUBLIC HEARING CONCERNING APPLICATION FOR RENEWAL OF OPTIONAL PREMISES (COUNTY) LIQUOR LICENSE - IHRF, INC. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 30th day of June, 2021, the Board considered the application of IHRF, Inc., for renewal of an Optional Premises (County) Liquor License for the facility located at 18233 County Road 96, Pierce, Colorado 80650, and WHEREAS, the Board received referral responses from the Department of Planning Services regarding the property owner's noncompliance with the existing Use by Special Review (USR) Permit, and from the Sheriff's Office regarding two (2) calls for service involving an All -Terrain Vehicle (ATV) accident and an assault, both occurring at an event in May 2021; the Board further reviewed videos showing multiple events occurring on the licensed premises which included patrons drinking large amounts of liquor and beer, the presence of cases of beer and liquor bottles, patrons drinking alcohol while operating ATVs, and patrons drinking alcohol while riding in the bed of a moving truck, and WHEREAS, the Board finds that pursuant to the procedures as set forth in Chapter 12, Article II, of the Weld County Code, there is probable cause to believe that one or more of the factors described in Section 12-2-40 of the Weld County Code exists, and WHEREAS, the Board finds evidence that the licensee has violated, does not meet or has failed to comply with any of the terms, conditions or provisions of Chapter 12, Article II of the Weld County Code, or any rules and regulations promulgated pursuant to the Colorado Beer Code or the Colorado Liquor Code, as provided in Section 12-2-40.A of the Weld County Code, including: 1) Evidence that patrons have brought alcohol from off -premises onto the licensed premises in violation of C.R.S. §44-3-901(1)(i) and 1 CCR 203-2:47-914; 2) Evidence of overserving and overconsumption in violation of C.R.S. §44-3-901(1)(a) and 1 CCR 203-2:47-900; 3) Evidence that the events during which alcohol is being served (car and truck shows) do not comply with the outdoor sports and recreational facility for which the Optional Premises (County) Liquor License was approved (horse match racing), and WHEREAS, the Board deems it advisable to schedule a Public Hearing to consider whether good cause exists to refuse to renew said Optional Premises (County) Liquor License for failure to comply with Chapter 12, Article II, of the Weld County Code, and Article 3, Title 44, C.R.S., and cc : CAC6c/i3B). The following standards for the issuance of an Optional Premises Liquor License or Optional Premises for a Hotel and Restaurant Liquor License are adopted pursuant to C.R.S. §44-3-310. The standards are considered additional to all other standards applicable to the issuance of liquor licenses pursuant to the Colorado Liquor Code and the Colorado Liquor Rules. These two (2) types of licenses are collectively referred to in this Section as "Optional Premises License" unless specifically identified separately. A. Eligible facility. An Optional Premises License may be approved for any facility that is located on or adjacent to an outdoor sports and recreational facility, as defined in C.R.S. §44-3- 103(33). B. No minimum size. There is no minimum size restriction for the outdoor sports and recreational facility to be eligible for the approval of an Optional Premises License. However, the Board of County Commissioners may consider the size in relationship to the number of optional premises locations requested for the facility. C. Number of optional premises. There are no restrictions on the number of optional premises locations which any one licensee may have on his or her outdoor sports or recreational facility. However, any applicant requesting approval of more than one (1) optional premises location shall demonstrate the need for each optional premises location in relationship to the operations of the outdoor sports and recreational facility and the activities of its guests. D. Submittal requirements. When submitting an application of an Optional Premises License, in addition to meeting the application requirements set by the State of Colorado, the applicant shall submit: 1. A map or other drawing illustrating the outdoor sports and recreational facility boundaries and the approximate site of each optional premises location requested. Such optional premises locations shall be numbered and shown in such a manner as to clearly depict the area encompassed in each location. After license approval, the applicant shall update the map or drawing on an annual basis. 2. A description of the method which shall be used to indentify the boundaries of the optional premises locations when in use. 3. A description of the provisions which have been made, including locations, for storing malt, vinous and spirituous liquors in a secured area on or off the optional premises for use on the optional premises. After license approval, the applicant shall update the description upon the provisions for storage being changed. 4. If the applicant does not own the proposed optional premises, a notarized written statement by the owner of the premises approving the application sought. The information is from call notes, which are taken by dispatchers when a call is received. Reports were not generated because involved persons had left the scene by the time deputies arrived and there was no information we could follow-up on. 21W016760, Accident with injuries, May 5, 2021 @ 5:15 pm : Caller states person fell from an ATV and was injured during a special event. Medical resources were cancelled by the reporting party. The person was transported to the hospital by private vehicle. 21W016770, Assault, May 5, 2021 @ 6:14 pm: Caller states there was a physical altercation occurred where two men kicked a third person in the head. The victim was bleeding and in and out of consciousness. The suspects and victim left the area. The event was described by the caller as a "big event". RP tells deputy that there was no ambulance on site and victim transported to the hospital by private vehicle. Security tells deputy that there were a couple of fights that got broken up. Suspects and victim not on scene when deputy arrives. We don't have the ability to get information on medical/fire calls at that location after the fact. Two days after the assault the victim called in to the deputy handling the case. The victim refused to prosecute and would not provide the deputy the suspects name. 19W030488: 08/17/2019 A security guard was hit in the head while trying to break-up a fight.
