M,ry A-.n reue,s.^r.� Recorder RESOLUTION WHEREAS, a public hearing was held on Monday, December 13, 1971 in the chambers of the Board of County Commissioners of Weld County, Colorado for the purpose of hearing a petition of Ralph Heinz, Box 8, Brighton, Colorado, requesting a change of zone from "A" Agri- -i cultural District to "I" Industrial District, and WHEREAS, the petitioner was present and represented by counsel, and WHEREAS, there was some opposition to the change of zone, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, and WHEREAS, the Board of County Commissioners has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS that the petition of Ralph Heinz for a change of zone from "A" Agricultural District to "I" Industrial District, said area being shown on recorded plat as parcel B more particularly described as follows: That part of the Southeast one-quarter of Section 31, Town- ship 1 North, Range 66 West of the 6th Principal Meridian, Weld County, Colorado, described as: Beginning at the Southeast corner Section 31; thence S 90°00'00" W on an assumed bearing along the South line said Section 31 a distance of 1804. 55 feet to a point on the West R. O. W. line of the Union Pacific Railroad Company; thence N 13°47'30" E along said R. O. W. line a distance of 2685. 46 feet; thence S 89°52'30" W parallel with said North line a distance of 211. 86 feet; thence S 13°47'30" W a distance of 10. 30 feet; thence S 89°52'30" W a distance of 316. 58 feet to the true point of beginning; thence continuing S 89°52'30" W a distance of 610. 00 feet; thence S 27°40'30" W a distance of 108. 159 feet; thence S 16°34'30" W a distance of 452. 627 feet; thence N 90°00'00" E a distance of 659. 133 feet; thence N 17°11'25" E a distance of 332. 191 feet to the beginning of a curve to the left, the delta of said curve is 17°18'55", the radius of said curve is 717. 38 feet; thence along the arc of said curve a distance of 216. 80 feet to the true point of beginning, containing 8. 0 acres more or less, is hereby granted under the conditions following: 1. Any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. M. The following members were present: Marshall H. Anderson, Glenn K. Billings, Harry S. Ashley Assistant County Attorney, Tom Connel Deputy County Clerk Chief Accounting Officer A motion was made and seconded to approve the minutes of the previous meeting. Motion carried. Bids for 2 motor graders were opened and read to the Board by the Chief Accounting Officer. He requested time to tabulate the bids before the awarding of the bid. The following claims were presented for payment: County General Fund 15,133.39 Road & Bridge Fund 7,671.99 Hospital Fund 152,338.38 Mental Health Fund 532.84 A motion was made and seconded to approve the payment of said bills. Motion carried. The organization meeting of the Board will be held the second Tuesday in January, that date being January 11, 1972. A discussion was held regarding a letter from the City of Greeley concerning the formation of an Island Grove Park Board. The Board stated they felt it would be wiser to obtain the guideline from HUD first and review their requirements before establishing a board. Mr. Buss was instructed to contact HUD for the guidelines and the structuring material before taking any action. The Assistant County Attorney was instructed to contact the City Clerk concerning any information which she has available from HUD and/or minutes of previous meetings. Mr. Ralph Heinze was present with his Attorney, Mr. Ed Brown and reviewed their request for their change of zone.
