HomeMy WebLinkAbout20210732.tiffRESOLUTION RE: APPROVE REQUEST TO MODIFY FOUR -LOT RECORDED EXEMPTION, RECX20-0003, DELETING CONDITIONS OF APPROVAL #2.B AND #2.C AND ADDING CONDITION OF APPROVAL #2.D - BOYD AND HELEN ARNOLD WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the request for a Four -Lot Recorded Exemption, RECX20-0003, was submitted by Boyd and Helen Arnold, 28667 County Road 20, Keenesburg, Colorado 80634, for property which is located on the following described real estate, to -wit: Lot D of Recorded Exemption, RECX-4903; being part of the NW1/4 of Section 1, Township 1 North, Range 64 West of the 6th P.M., Weld County, Colorado being more particularly described in the plat which shall be provided by the applicant, said plat to be recorded, and WHEREAS, the Board of County Commissioners, pursuant to its authority under C.R.S. §30-28-101(10)(d), did determine at a public meeting held on May 6, 2020, in the Chambers of the Board, that a certain parcel of land, to be divided into four parcels estimated to be approximately 120 acres and three parcels each approximately four (4) acres in size, does not come within the purview of the definition of the terms "subdivision" and "subdivided land," and WHEREAS, subsequent to said hearing on May 6, 2020, the applicants approached the owner of Lot B of RE -4903, Henrylyn Irrigation District, which refused to sign an easement agreement to allow the applicant to cross their property, thus making the applicants unable to comply with Conditions of Approval #2.B and #2.C, and WHEREAS, the Board has been presented with a request to modify RECX20-0003, so as to relocate the access west of Lots B and C of RE -4903, to be shown on the plat known as Recorded Exemption, RECX20-0003. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land, be, and hereby is, exempt from the definition of the terms "subdivision" and "subdivided land." co t PLCOAITP). APPL, APP L RE,P OcorOgrai 2021-0732 RECX20-0003 RECX20-0003 - BOYD AND HELEN ARNOLD PAGE 2 BE IT FURTHER RESOLVED by the Board that Conditions of Approval #2.B and #2.C of Four -Lot Recorded Exemption, RECX20-0003, for Boyd and Helen Arnold, be, and hereby are, deleted, and a new Condition of Approval #2.D, be, and hereby is, added, such that the Conditions of Approval read as follows: 1. Prior to recording the plat: A. The applicant shall attempt to address the requirements of Weld County School District RE -3J, as stated in the referral response dated January 21, 2020, per Section 24-8-40.K.1 of the Weld County Code. Evidence of such shall be submitted, in writing, to the Weld County Department of Planning Services. B. The applicant shall attempt to address the requirements of the Henrylyn Irrigation District, as stated in the referral response dated January 16, 2020. Evidence of such shall be submitted, in writing, to the Weld County Department of Planning Services. C. Lots A, B, and C shall comply with the 2.5 -acre net minimum lot size required by Section 24-8-40.L of the Weld County Code. Net acreage calculations should not include future road right-of-way. D. Lot A shall comply with the less than 35 -acre maximum lot size required by Section 24-8-10.6 of the Weld County Code. Net acreage calculations should not include future road right-of-way. E. Lot D shall comply with the 120 -acre minimum lot size required by Section 24-8-20.C.3 of the Weld County Code. Net acreage calculations should not include future road right-of-way. 2. Items to be included on the plat: A. The plat shall be titled: Recorded Exemption No. 1475-01-2 RECX20-0003. B. County Road 14 is a gravel road and is designated on the Weld County Functional Classification Map (Code Ordinance #2017-01) as a local road, which requires 60 feet of right-of-way at full buildout. The applicant shall delineate and label the future and existing right-of-way (along with the documents creating the existing right-of-way) and the physical location of the road on the plat. If the existing right-of-way cannot be verified, it shall be dedicated. The applicant shall also delineate the physical location of the roadway. Pursuant to the definition of setback in Section 23-1-90 of the Weld County Code, the required setback is measured from the future right-of-way line. This road is maintained by Weld County. C. County Road 59 is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance #2017-01) as a local road, which requires 80 feet of right-of-way at full buildout. If the existing right-of-way cannot be verified, it shall be dedicated. The applicant shall also delineate the physical location of the roadway. Pursuant to the definition of setback in Section 23-1-90 of the Weld County Code, the required setback is measured from the future right-of-way line. This road is maintained by Weld County. D. The easement shall be located across Lot D of Recorded Exemption, RECX20-0003, off of County Road 14, adjacent to and west of Lot B of Recorded Exemption, RE -4903. E. The applicant shall show and label the existing and proposed access point(s) and the usage types (Agriculture, Residential, Commercial / Industrial, or Oil and Gas). The Department of Public Works will review access locations as a part of the plat submittal. F. Setback radii for existing oil and gas tank batteries and wellheads shall be indicated on the plat, per the setback requirements of Section 23-3-70.E of the Weld County Code. G. All recorded easements and rights -of -way shall be delineated on the plat by book and page number or reception number. H. The following notes shall be placed on the plat: 1) All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. No occupied building or structure shall be constructed within 200 feet of any tank battery, within 150 feet of any oil and gas wellhead or within 25 feet of any plugged or abandoned oil and gas well. 2) Any future structures or uses on the site must obtain the appropriate Zoning and Building Permits. 3) Lots A, B, and C are not eligible for a future land exemption, in accordance with Section 24-8-20.C.3 of the Weld County Code. 4) The largest lot of any Recorded Exemption may not be less than 35 acres net, unless approved by the Weld County Board of Commissioners in accordance with Section 24-8-40.P of the Weld County Code. 2021-0732 RECX20-0003 RECX20-0003 - BOYD AND HELEN ARNOLD PAGE 4 5) The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 6) Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate existing utilities within the existing County right-of-way. 7) All access and utility easements are dedicated for the benefit of all owners of lots depicted on this plat, including owners of future lots created therefrom, regardless of lot configuration or number of users, and without limitation of the use or intensity of the use of such easements. No lot owner may install a gate or otherwise impede the use of such easements without the approval of all persons with rights of use of such easements. 8) Access on the site shall be maintained to mitigate any impacts to the public road, including damages and/or off -site tracking. 9) Prior to the release of Building Permits, the applicant shall be required to submit a complete access application for a "preliminarily approved" access location as shown on this plat. 10) Any work that may occupy and/or encroach upon any County rights -of -way or easement shall acquire an approved Right -of -Way Use Permit prior to commencement. 11) The historical flow patterns and runoff amounts will be maintained on the site. 12) Prior to the release of building permits, the applicant shall submit evidence to the Department of Planning Services that the Lots A, B, C, and D have an adequate water supply of sufficient quality, quantity and dependability. 13) Building permits shall be obtained prior to the construction of any building. Buildings that meet the definition of an Agricultural Exempt Building, per the requirements of Sections 29-1-20 and 29-3-20.B.13 of the Weld County Code do not need building permits; however, a Certificate of Compliance must be filed with the Department of Planning Services and an electrical and/or plumbing permit is required for any electrical service to the building or water for watering or washing of livestock or poultry. 14) Building Permits issued on the proposed lots will be required to adhere to the fee structure of the County -Wide Road Impact Fee, the County Facility Fee, and the Drainage Impact Fee Programs. 2021-0732 RECX20-0003 RECX20-0003 - BOYD AND HELEN ARNOLD PAGE 5 15) Prior to the release of Building Permits, the applicant shall submit a recorded deed describing the Lot upon which the building permit is requested with the building permit applications. The legal description on such deed shall include the Lot designation and Recorded Exemption number. 16) Recorded Exemptions on adjacent properties may raise the issue of compliance with the intent of the Recorded Exemption process. Approval of this Recorded Exemption does not guarantee approval of future applications on adjacent properties. 17) RIGHT TO EXTRACT MINERAL RESOURCES STATEMENT: Weld County has some of the most abundant mineral resources, including, but not limited to, sand and gravel, oil, natural gas, and coal. Under Title 34, of the Colorado Revised Statutes, minerals are vital resources because (a) the State's commercial mineral deposits are essential to the state's economy; (b) the populous counties of the state face a critical shortage of such deposits; and (c) such deposits should be extracted according to a rational plan, calculated to avoid waste of such deposits and cause the least practicable disruption of the ecology and quality of life of the citizens of the populous counties of the state. Mineral resource locations are widespread throughout the County and people moving into these areas must recognize the various impacts associated with this development. Oftentimes, mineral resource sites are fixed to their geographical and geophysical locations. South of and adjacent to CR 14 and east of and adjacent to CR 59 Parcel No . : 1475- 01 -2 - 00 - 061 Zone District : A (Agricultural ) Background : Recorded Exemption RECX20 -0003 was approved by the Board of County Commissioners on May 6 , 2020 via Resolution #2020 - 1328 : this case is a four- lot recorded exemption owned by Boyd and Helen Arnold . The access to all four lots was proposed to cross Lot B and Lot C of RE -4903 . The Conditions of Approval required that the applicant obtain an easement from the existing property owners . The applicant is unable to acquire this easement from the owner of Lot B of RE -4903 and therefore cannot place the access easement in the area designated on the draft plat as previously approved by the Board of County Commissioners . This hearing is to Reconsider Resolution #2020- 1328 to approve the new access location . The location of the access point will be moved to the west edge of Lots B and C of RE -4903 . which is addressed in Conditions of Approval 2 . B . and 2 . C . on the RECX20 - 0003 Resolution #2020 - 1328 . Proposed RECX20 -0003 modification : The applicant has indicated to the Department of Planning Services that they are unable to comply with the Conditions of Approval that address the access location on County Road 14 that cross over Lots B and C of RE -4903 . This access point was the proposed access to Lots A . B . C , and D per RECX20-0003 Resolution #2020- 1328 . These conditions are included as items number 2 . B . and 2 . C . in the Board of County Commissioner' s Resolution . These Conditions of Approval state : B . A 30 foot wide joint access and utility easement extending across Lot B of RE -4903 from County Road 14 , for the benefit of Lot C of RE -4903 and Lots A . B , C , and D of RECX20-0003 , shall be shown clearly on the plat . The joint easement shall be dedicated for the use as shown using the language set forth in the Weld County Code , Appendix 24- F . 2 . The access for Lots A, B, C and D from County Road 14 crosses property not included in the Recorded Exemption. The applicant shall create and record a 30 -foot access and utility easement agreement signed by all owners of property crossed by the access and show and label the access and utility easement on the plat. The applicant has approached the owner of Lot B of RE -4903, Henrylyn Irrigation District, and this property owner refuses to sign an easement agreement to allow the applicant to cross their property. Due to the inability to acquire an access easement the applicant has alternatively proposed an access to the west of Lots B and C in order to access their newly proposed Lots. The Department of Public Works has indicated that this new access point is acceptable and stated that the applicant should close one of the access points on County Road 59 to achieve the no "net increase" requirement in the former Chapter 24-8-40.C. Section 24 -S -40.C. of the Weld County Code states: An access is, or can be made, available that provides for safe ingress and egress to a public road. All accesses shall be in accordance with Chapter 12, Article V of this Code, and shall endeavor to achieve the goal of no "net increase" in the number of accesses onto adjacent County roads when accesses already exist. I was wondering if Boyd is still going to move forward with this? One concern I have is that he is going to try to use our driveway for access to the proposed lots? The current access is only for Lots B and C as there is no agreement in place for any access to future lots that Boyd may want to create. We certainly don't want anymore traffic going through our business than there already is. Boyd has plenty of room to the west of Henrylyn's lot for an access off road 14. Any info you could provide to me in this matter would be most appreciated. This means PW would be concerned about "No net increase" for a RE . This means a new access point would not be granted without closing an existing one . If the applicant is willing to "Close and Reclaim" one of the existing access points. I would feel comfortable saying that all PW items have been addressed .
