A. Carlson, J. S . Ogilvie and S . K. Clark. Board of Commissioners )f said County, hereinafter called the "second party": WITNESSETH: ( 1) THAT, for and in ooneideration of the sum of One Dollar ( 31.00) receipt whereof is hereby acknowledged, and upon the condi- tions hereinafter set forth, the first party herein grants unto the second party license to construct, maintain and use a public highway upon the premises of the first party at Sligo, Weld County, Colorado, described as follows; to-wit: )41 The westerly twenty-five ( 25) feet of the station r u Sligo not lying within one hundred twenty- ive 125) feet, measured at right angles to center line main track of railroad as now located over Sec. 35, T 10 N, R 61 W. As shown in red on the plat hereto attached and made a part hereof, No. 1312-21 identified by the signature of F. T. Darrow. ( 2) The Railroad Company reserves unto itself at all times during the term of this license, the right to use said premises, or to license the use of said premises, for sewers, water mains, conduits, and other underground construction (except culverts or bridges to be oonstructed thereon as a part of said highway), and also for telephone, telegraph, and power and light transmission wires, and all other kinds of aerial construction, together with the supports therefor, and for all other purposes, inoluding the use of the surface of said premises, not inconsistent with the mairztenanee and use by the second party of said public highway thereover. (3) The said highway shall be constructed and maintained by the second party at its sole cost and expense, and the second party shall be charged with all duty and obligation as to the due and proper construction, maintenance and use of said h ,ghway, it being under- stood and agreed that the first party does not warrant its premises to be in a suitable condition for the use herein granted; and that the second party shall release and protect, indemnify and save harmless the first party from all claims, demands, suits, judgments, moats and expenses for loss, damage or injury to the person or pro— perty of any person or persons, whomsoever, in any manner arising from, or growing out of, the construction, maintenance, existence or use of said highway on the said premises of the first party and to whatso'ver o u e. (4) It is further understood and agreed that if at any time in the future any ohange in the use of its said premises by the first party shall in its judgment make such aotion necessary, the first party shall have the right, upon six months' notioe in writing to the second party, to terminate this license, and thtt.t upon the expiration of said notice period, all the rights and privileges herein granted to the second party shall cease and determine. ( 5) This license shall be binding upon the euooessors or assigns of the parties hereto. Deer Sir: - On the 7th of this month I wrote to you advising that it was necessary to deposit $15.00 with the petition for the rord along the Burlington from Sligo -to the Wyoming State line . ne yet this deposit has not been received and until it is furn- ished further ration on the petition will be tied up. In order to get this matter under wry and save delay, I presented the peti- tion to the Board in the regular way, assuming that the deposit would follow unon my rdvising thrt it wee necessary that it should be mrde. Mr. Rowe, County Commissioner, advises me that Mr. Abbey told him that the dates on the notice of opening the road running ?ast from Grover read 1915 and should hrve read 1916. The d• te of 1915 is right end should not be chrnged. The read was granted on the 11th of December, 1915, and notices rerd that road will be orened in sixty days after that date.
