HomeMy WebLinkAbout20210450.tiffHEARING CERTIFICATION DOCKET NO. 2021-02.B RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR20-0022, FOR AN OIL AND GAS SUPPORT AND SERVICE (OUTSIDE STORAGE OF OIL FIELD SUPPORT EQUIPMENT, VEHICLES, AND SUPPLIES) AND MORE THAN THE NUMBER OF CARGO CONTAINERS ALLOWED BY SECTION 23-3-30 OF THE WELD COUNTY CODE (UP TO 20 CARGO CONTAINERS) IN THE A (AGRICULTURAL) ZONE DISTRICT — 151 DEVELOPMENT GROUP, LLC A public hearing was conducted on February 17, 2021, at 10:00 a.m., with the following present: Commissioner Steve Moreno, Chair Commissioner Scott K. James, Pro-Tem Commissioner Perry L. Buck Commissioner Mike Freeman Commissioner Lori Saine Also present: Acting Clerk to the Board, Jess Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Chris Gathman Public Works Department representative, Zackery Roberson Health Department representative, Lauren Light The following business was transacted: E I hereby certify that pursuant to a notice dated November 16, 2020, and duly published November 20, 2020, in the Greeley Tribune, a public hearing was conducted on January 13, 2021, to consider the request of 151 Development Group, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR20-0022, for an Oil and Gas Support and Service (outside storage of oil field support equipment, vehicles, and supplies) and more than the number of cargo containers allowed by Section 23-3-30 of the Weld County Code (up to 20 cargo containers) in the A (Agricultural) Zone District. At said hearing, the matter was continued to February 17, 2021, to allow the matter to be heard by the Planning Commission on January 19, 2021. Bob Choate, Assistant County Attorney, made this a matter of record. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal explaining the site would be an unmanned facility with no on -site employees, would operate seven (7) days a week, year round, and the USR application stemmed from Zoning Violation, ZCV20-00100. He described the existing storage location, as well as the proposed expansion of the storage area. He stated the applicant has applied for a Subdivision Exemption to increase the size of an adjacent parcel where a manufactured home exists, to meet the minimum lot size of 2.5 acres, and has also applied for a Zoning Permit for a Second Dwelling in the Ag Zone (ZPAG) for that parcel. Mr. Gathman relayed a surrounding property owner (SPO) contacted staff regarding screening of the site, and confirmed the applicant has been working with the SPO about his concern. He described surrounding residences and land uses, stated staff is requesting a Screening Plan to ensure all sides of the site are screened. He mentioned the site is within the LE: PL I C.61 TP) Ph1(zR / Da), Ei-k-CLO 3/8/a a.4 2021-0450 PL2780 HEARING CERTIFICATION - 151 DEVELOPMENT GROUP, LLC (USR20-0022) PAGE 2 three (3) mile referral area of the Towns of Firestone and Mead and the City of Longmont, and within the Coordinated Planning Agreement (CPA) of the Town of Mead, who indicated they are not interested in annexing the site. He described the buffering around the site, the traffic associated with the site, and the height limitation of the storage containers. Mr. Gathman entered the favorable recommendation of the Planning Commission into the record as written and displayed images of the site and surrounding views. ▪ Zackery Roberson, Department of Public Works, provided a brief overview of the transportation plans and requirements, stating there is a Planning and Environmental Linkage (PEL) Study for State Highway 66 and an Access Control Plan for the site. He indicated access to the site is on County Road (CR) 1, stated no traffic counts are available for CR 1, described the site -associated traffic, and presented the drainage and grading requirements. He mentioned the applicant would need to obtain an updated Access Permit for the access location. e Lauren Light, Department of Public Health and Environment (EH), stated because there are no on -site employees the applicant can use a screened portable toilet, an outside vendor will provide water for dust control, as necessary, there will be an on -site dumpster for waste, and Development Standards (DS) #23-28 address EH items. e David Lee, applicant, stated the purpose of the application is to utilize otherwise unusable space. He explained there is no water on the land, so it cannot be farmed, and there are oil and gas setbacks on the site, which limit the site's use. e No public testimony was offered concerning this matter. e Mr. Roberson suggested adding "with future triggers", to Condition of Approval (COA) #1.A (Improvements and Road Maintenance Agreement) and in response to Commissioner James, Mr. Gathman confirmed landscape and screening requirements have been met and indicated the applicant had agreed to screening around the whole site. In response to Chair Moreno, the applicant stated the current lighting consists of yard and farm lights and no additional lighting is proposed, therefore, Commissioner Freeman suggested removing COA #1.E.13 (delineate on -site lighting). After discussion among the Board and staff, Commissioner James suggested deleting DS #3 (hours of operation) and Commissioner Freeman suggested deleting DS #29 (Lighting Plan). The Board agreed to all of the aforementioned changes. e In response to Chair Moreno, Mr. Lee, on behalf of the applicant, indicated he had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. e No public testimony was offered regarding changes made to the Conditions of Approval and Development Standards. IE Commissioner Freeman moved to approve the request of 151 Development Group, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR20-0022, for an Oil and Gas Support and Service (outside storage of oil field support equipment, vehicles, and supplies) and more than the number of cargo containers allowed by Section 23-3-30 of the Weld 2021-0450 PL2780 HEARING CERTIFICATION - 151 DEVELOPMENT GROUP, LLC (USR20-0022) PAGE 3 County Code (up to 20 cargo containers) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Buck, and it carried unanimously. There being no further discussion, the hearing was completed at 10:28 a.m. This Certification was approved on the 22nd day of February, 2021.
