RE: APPROVE APPLICATION FOR ENERGY AND MINERAL IMPACT ASSISTANCE
FUND (EIAF) PROGRAM GRANT FUNDS FOR COUNTY ROAD 22 IMPROVEMENTS
PROJECT (SEPTEMBER CYCLE -TIER II)
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Application For Energy and Mineral
Impact Assistance Fund (EIAF) Program Grant Funds For County Road 22 Improvements Project
(September Cycle -Tier II) between the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, on behalf of the Department of Public Works,
and the Colorado Department of Local Affairs, Division of Local Government, commencing upon
full execution of signatures, with further terms and conditions being as stated in said contract, and
WHEREAS, after review, the Board deems it advisable to approve said contract, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Application for Energy and Mineral Impact Assistance Fund
(EIAF) Program Grant Funds For County Road 22 Improvements Project (September Cycle -Tier
II) between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Public Works, and the Colorado
Department of Local Affairs, Division of Local Government, be, and hereby is, approved.
The above and foregoing Resolution was, on motion duly made and seconded, adopted

SUBJECT: DOLA Application -2021 September Cycle
In accordance with the work session held on August 18, 2021, Public Works is requesting
the Commissioners submit one Tier 2 Energy and Mineral Impact Grant to the Department
of Local Affairs (DOLA) for the September cycle.
This grant request is for a Tier 2 - $600,000 application for full depth reconstruction (FDR)
of Weld County Road (WCR) 22 from WCR 31 to WCR 41. The total project budget is
estimated to be $1,400,000. If awarded, Public Works will use the grant funds to leverage
the cost to purchase cement treated base (CTB), aggregate, and asphalt materials, which
our crews will use to pave approximately 5 miles of the WCR 22 arterial corridor. Pursuant
to grant funding and the winter months, this HARP project is anticipated to begin in the
spring of 2022.
Staff recommends authorization of the Chair's signature on this DOLA application. I am
available to answer any questions you may have.

The Department of Local Affairs' (DOLA) Energy and Mineral Impact Assistance Fund (EIAF) program was created to assist political
subdivisions that are socially and/or economically impacted by the development, processing, or energy conversion of minerals and mineral
fuels. Funds come from the state severance tax on energy and mineral production and from a portion of the state's share of royalties paid to
the federal government for mining and drilling of minerals and mineral fuels on federally -owned land. The creation of the fund is outlined in
C.R.S. 34-63-102 (Federal Mineral Lease) and C.R.S. 39-29-110 (Severance). Grant dollars are to be awarded for the planning, design,
construction, and maintenance of public facilities and for the provision of services by political subdivisions.
Requests in this Cycle 21-12 may be for either Tier I: up to $200,000 or Tier II: over $200,000 and up to $600,000 with a 1:1 match
requirement for any application. Tier I award notifications are anticipated in mid -November. Tier II applicant presentations are scheduled for

Weld County believes this project reaches the elderly, under -employed and minority populations, which is why the project
includes an improved roadway with paved shoulders to serve not only transit populations but safer bicycle/pedestrian facilities,
which builds community capacity. In addition, the Commissioners offer many public options to solicit public input, including but
not limited to social media, public meetings and Board hearings.

Weld County follows current construction best practices in the field and goes above and beyond implementing the minimum
construction standards. This philosophy is based on best management practices that provide a road map for success based on
performance measures, such as, fiscal responsibility with taxpayer dollars, high level project management expectations,
implementation of construction and grant schedules.
K. HIGH PERFORMANCE CERTIFICATION PROGRAM (HPCP) COMPLIANCE

Colorado Revised Statutes (C.R.S. 24-30-1305.5) require all new facilities, additions, and renovation projects that meet the following
criteria to conform with the High Performance Certification Program (HPCP) policy adopted by the Office of the State Architect (OSA) if:
• The project receives 25% or more of state funds; and
• The new facility, addition, or renovation project contains 5,000 or more building gross square feet; and
• The building includes an HVAC system; and
• In the case of a renovation project, the cost of the renovation exceeds 25% of the current value of the property.
The HPCP requires projects that meet the criteria above to achieve third party verification with the target goal of LEED Gold or Green
Globes -Three Globes. Projects are strongly encouraged to meet the Office of the State Architect's (OSA) Sustainable Priorities in addition
to the LEED prerequisites. Projects funded through DOLA that meet the above applicability criteria are required to complete the DOLA

In instances where achievement of LEED Gold or Green Globe -Three Globes certification is not achievable, an applicant may request a

We perform CBA's on all our construction projects to ensure the department is being strategic and responsible with taxpayer
dollars and this project will produce more economic benefits than it cost to implement it. Weld County crews self -perform the
improvements, which reduces overhead and admin costs typically seen by contracting out similar projects. County residents will
see sustainable benefits through improved physical and social conditions.

Weld County does not conduct projects in a vacuum. We coordinate with our surrounding communities and build projects based

The WCR 22 project addresses potential risks and vulnerabilities for infrastructure. Reconstruction of this corridor is taking into
consideration the best management practice strategies to reduce vulnerabilities to the infrastructure and housing sectors.
Reinforcing this infrastructure will support the impacted unincorporated areas of Weld County classified as vulnerable
populations/communities, which this project applies.

Weld County's FDR program promotes the departments ingenuity and leadership in roadway projects. The FDR model can be
implemented by other agencies experiencing high truck volumes on every type of road, not just paved. This project relies on
construction techniques that require implementation of GPS equipment for construction efficiencies.

As long as O£tG drilling occurs in Weld County, we envision an energy impact program partnership with the State. We are the 3rd
largest county at 4,000 sq. miles with one of the highest amounts of lane miles to maintain. As the #1 energy impacted county,

If the grant is approved, the Commissioners will direct the funding be encumbered for this project. Weld County will cover any
unanticipated cost overruns with this project as part of our local match.

Based on our grant monitoring history, Weld County Public Works has a good track record for managing projects in a timely manner
within the contract deadlines. Chris D'Ovidio is the point of contact for this grant and Elizabeth Relford will be responsible for
managing the construction project.

This is a safety project and does not duplicate service capacity but enhances it. Current service is inadequate and inefficient to
meet current demands.

The Energy and Mineral Impact Assistance Program is required to integrate resilience criteria into the program. By bringing resiliency
considerations into project planning and implementation, projects should be better poised to benefit a number of sectors (economy, health,
infrastructure, etc.), minimize long-term risks, and anticipate or be better prepared to respond to changing conditions faced by Colorado
communities.
The 2020 Colorado Resiliency Framework provides nine Resiliency Prioritization Criteria that can serve as a guide when planning a project to
enhance its long-term resilience. More information on the Resiliency Prioritization Criteria can be found at

Weld County is the #1 oil and gas producing county in the State of Colorado and therefore by default is the most impacted county.
The majority of the county's traffic impacts directly result from the oil and gas industry.

Cite actual use data that documents direct impact as it relates to the need for the project. For example: "heavy truck traffic
directly related to energy development activities is impacting County Road X. A traffic count done in May 2020 showed energy
related truck traffic increased from 100 trips per day to 300." (2,500 character limit)
For this five mile arterial corridor, the annual average daily traffic varies from 1,777 to 1,895. The raw trip data ranges from 2,221
to 2,369. The truck percentages range from 44-47%.

Weld County's Accounting Department is recognized as a Tier 3 local government by the state. We manage all invoicing and payments
through our Banner Accounting System. In addition, Public Works uses project management software call PubWorks to assist with
grant management tracking.

Weld County is trying to proactively improve routes significantly impacted by the oil and gas industry. These grant funds are supplied
by the industry and vetted through DOLA to make us all partners in mitigating the impacts created by the industry.

If funding is not awarded, this project will have to be deferred and this segment of road will continue to deteriorate and become an
even greater safety issue then currently exists today.

This is an extremely busy arterial corridor having numerous oil and gas operations, including a gas plant along that is experience
continued development and population growth. This project will enhance the livability of the region by improving the safety of this
arterial corridor.

increased conservation of energy, or does it capitalize on renewable energy technology? If yes, please describe. (2,500 character

Yes, this project builds on the strategies identified in the 2010 Colorado Resiliency Framework for achieving a resilient vision
pertaining to the Building and Infrastructure (BI) Sustainability goals by supporting a project that is climate and hazard resilient,
while also being environmentally sustainable. It will reduce the carbon footprint by constructing a more resilient corridor utilizing
recycled materials as well as reducing vehicle emissions utilizing newer more efficient truck equipment. Consistent with the 2013
flood, the reconstruction of this corridor will make it more resilient to future hazardous events, such as flooding.

This project is needed due to repetitive heavy oil and gas truck traffic deteriorating this arterial corridor located in the heart of the
Denver-Julesburg oil and gas basin.
e. Description of the project scope of work
Description of the various tasks involved in the project including specific data such as quantities, mileage, square feet, linear ft. etc., as
well as specific project location within the city and/or county, etc. Please be specific to the project. (2,500 character limit)
Weld County requests energy and impact funding to assist with the full depth reconstruction (FDR) of approximately 5 miles of Weld
County Road (WCR) 22 from WCR 31 to WCR 41. Weld County Public Works crews will mill off the existing asphalt to a depth suitable
for mixing cement treated base (CTB) into the subgrade. The CTB will reinforce the subgrade structure to strengthen the foundation
for the asphalt to sustain the heavy duty truck traffic. Last, Public Works will pave the roadway with 6" of polymer asphalt. The
asphalt thickness along with the CTB will improve the lifecycle of the road.
