- / 77.8 RESOLUTION WHEREAS, a hearing was held on October 16, 1972 in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of Charles R. Schmidt, 520 N. County Road, No. 9E, Fort Collins, Colorado, requesting permission to locate a dairy operation on the following described property, to-wit: A parcel of land located in the Northeast Quarter (NE4) of Section Thirteen (13), Township Five (5) North, Range Sixty-five (65) West of the Sixth (6th) Principal Meridian, Weld County, Colorado, and more particularly described as follows: Beginning at the Northwest corner of said Northeast Quarter (NE4) of said Section Thirteen (13), thence South along the West line of said quarter section a distance of 1570 feet to the true point of beginning; thence South along the West line of said quarter section a distance of 500 feet; thence East and parallel to the North quarter section line a distance of 500 feet; thence North and parallel to the West quarter section line a distance of 500 feet; thence West and parallel to the North quarter section line a distance of 500 feet to the West quarter section line which is the true point of beginning, containing 5. 1 acres, more or less, and WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner to locate said dairy operation on the above described premises, and WHEREAS, the said requested dairy operation is located in an Agricultrual Zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution of Weld County, said dairy operation or any expansion thereof may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Charles R. Schmidt, 520 No. Co. Rd. No. 9E, Fort Collins, Colorado, to locate a dairy farm oper- ation on the premises indicated above be, and it hereby is granted, under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. • 2. That petitioner shall proceed with due diligence to construct said dairy operation and shall have up to one year from date hereof to begin construction of same; otherwise, the Board may, for good cause PL0722 720364 shown, on its own motion, revoke the permit herein granted. 3. That petitioner shall construct sealed lagoon or lagoons as proposed. 4. That all applicable subdivision and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. Dated this 18th day of October, 1972. He explained the develop- ment is limited to 2 access points . There was discussion regard- ing easement necessary to maintain the Bliss lateral at the rear of the property. There was discussion regarding the ROW for the road . Mr. Lorenson stated the City of Greeley had agreed to a lesser amount on the road . They have suggested 80' because of the existing house. MOTION : By Mr. Nix to table the- matter until an agreement between Mr. Fagerburg and the Bliss Lateral has been worked out . A variance requested on certain block lengths WASC discussed . A letter fromithe Town of Firestone was read regarding their con- cern of the development. Mr. Lorenson stated other than the block lengths , they have met all requirements . Street profiles have been approved by the County Engineer. RESOLUTION : Be it therefore resolved to recommend approval of the plat to the Board of County Commissioners subject to the Subdivision Agreement being approved by the County Engineer. Eastman stated it has been approved by the Health Dept. There was discussion regarding the proposed private road and seepage in the area. Mr. Lorenson explained the lots are small but are planned in conjunction with the pasture areas . It was suggested a water table study be made. Mr. Lorenson suggested this type of .thing might serve as a buffer area between the growth of the town of Eaton and the intense agricultural uses ; such as feedlots , etc.• It was noted all the percolation tests were made in the pasture areas and should be in the area where the resi- dents would be built . MOTION: By Mr. Heitman to table the matter until percolation tests are made in this area and refer it back to the Health Dept. Mr. Eastman stated there should be adequate covenants covering the open space , batns etc . Mr. Heitman withdrew his motion. RESOLUTION: Be it therefore resolved to recommend denial to the Board of County Commissioners due to the seepage in the area, the perc- olation tests are not in the area of the homes and the proposed private road . CASE NUMBER: S-97 tape 449 SUBJECT: Final plat of Indianhead Subdivision LOCATION : NE4 Sec 18 T5 R67 DISCUSSION : Mr. Ohi stated the planning staff recommends denial of the plat . Reasons for denial were read . A letter from the ditch company had been received and there are still problems to be worked out. They have refused to dedicate ROW for highway 34. On the preliminary plat was shown a dedication for 100 ' of ROW. . . inaudible . . there was discussion regarding the proposed sewage facility and the maintenance of the plant. Letters have been received from adjacent farmers stating they are concerned about the run-off and possible seepage. 815 RESOLUTION: Be it therefore resolved to recommend denial to the Board of County Commissioners based upon existing regulations and conformance to them. Motion carried. , SUBJECT: Existing regulation regarding 660' set-back from State Highways DISCUSSION : There was discussion regarding the set-back from State highways for feeding operations . SUBJECT: Planning Contract with Windsor DISCUSSION : Mr. Anderson stated the Windsor Planning Commission approved an extension of the contract with the Planning staff for a planning consultant for Windsor subject to the approval of the County Commissioners . This was a three month contract and they feel they need more time to evaluate the cost for the Plan- ning Services . MOTION: By Mr. Nix to recommend approval of the contract to the Board of. County Commissioners . Second by Mr. Heitman. A vote of "Aye" by Anderson , Heitman , Nix and Watson . Motion carried . APPLICANT: Meroco Bradcasting Co. A discussion followed regarding request for exempt- tion of filing a minor subdivision application in this instance . It was agreed parcels for public utilities where no water or sewer is required , should be exempt and .each stand on its own merit. This type of use will require a special use permit and observe the proper set-backs , Mr. Eastman presented the material submitted for the Special Use Permit . The facility_=will have to have PAR and FCC approVal . RESOLUTION : Be it therefore resolved to recommend approval subject to the approval by FFA and FCC and this does not constitute a minor sub- division. Motion by Mr. Nix , second by Mr, Watson. If approved it should be ' subject to : a sealed lagoon as recommended by SCS and increas- ing the size to a total of 9 . 7 acre feet to meet the Colo. Wate Pollution standards as recommended by the Extension office . Th lagoons to be located at least 400 ft . from the West bank of tl Lone Tree Creek and a line installed to pump the waste up to t/ walking spritt er as required by the Health Dept. Construction to begin within 1 year of approval by the County Commissionerf and limited to the pen size as indicated by the submitted pla/ There should be screening along the entire south boundary per meter adjacent to the road for vegetation . Stated there will be no habitation and is strictly a tank site . Height will be approx- imately 30 ft . Mr. Lorenson stated he recommended approval as additional water storage is needed to provide service to the water district , and should be subject to screen planting around the perimeter . Mr. Olhausen stated they have already agreed to the planting . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to the screening request . Gaskins explained the necessity of the spindle field facility to take care of about 40 wells . Mr. Lorenson stated he is recommending approval of the application as it agrees with the land use policy and is compatible with surrounding land use • and zoning . Mr . Lorenson .stated the Health Department may have some requirements . Mr . Paul stated they will need to get a per- mit to operate from the Pollution office and the State Pollution Control . Mr . Lange stated the items they will have on this are exempt under existing air pollution statutes and they have applied to the State Air Pollution Commission and they were grant an exemption . Mr. Lorenson recommended a planted screen around the perimeter and construction to begin within one year of approval by the Board of County Commissioners and limited to the items shown on the submitted plan . Mr. Gaskins voiced some ob- jection to the screening requested . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to Mr . Lorenson stated a letter from the North Weld Water District of their intent to serve water to this dairy. The staff recommends approval as it agrees with the land use policy , is compatible with surrounding land use and zoning , the design is judged adequate by the Extension agent . If approved it should be subject to any conditions required by the Health Dept. , construction of a lagoon as proposed , construction to begin within 1 year of approval by the Board of County Commissioners and limited to the pen size (159 ,000 sq . ft. ) and facilities as shown on the submitted plan . Mr. Miller stated according to his interpretation of the zoning regu- lations , dog kennels art a permitted use in an "A" zone . SUBJECT : Utility Installatton Agreement DISCUSSION : Miss Telep stated that after reviewing the proposed agreement , she felt it should be considered at some other level., and perhaps a public hearing held . Mr. Anderson stated he felt it is something that could, be handled by the utilities themselves . MOTION : By Mr . Heitman to reject the proposal that the Utilities Installation Agreement be handled through the Planning Commission . After further discussion , Mr. Heitman withdrew his motion . MOTION : By Mr. Clark that no action be taken at this time and it is immature at this time . Second by Mr. Watson . A vote of "Aye" by Anderson , Clark , Heitman , Nix , Rothe and Watson . Motion carried SUBJECT : Model Subdivision Ordinance for Incorporated Towns . DISCUSSION : Mr. Ohi presented the Model Subdivision Ordinance tha would allow the incorporated towns to adopt , by, reference . The ordinance is based on the Weld County Subdivision Resolution that subdivision regulations will be as uniform as possible 826 throughout the county. The model ordinance should be approved by both the Weld County Planning Commission and Board of County Commissioners as an official publication of Weld County to en- able towns in the county to adopt it by reference. . Miss Telep stated she would like to review the ordinance, RESOLUTION : tape 457 Be it therefore resolved to recommend approval subject to to the legality of such ordinance being approved by Miss Telep .
