Home My WebLink About720307.tiff - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -- - - - - RESOLUTION WHEREAS, a hearing was held on Monday, January 24, 1972 in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of Henry Deibel, Route 1, Box 226, Fort Lupton, Colorado, requesting permission to locate a dairy operation on the following described property, to-wit: West Half(W4) of the Southwest Quarter (SW4) of the Southeast Quarter (SE4) of the Southwest Quarter (SW4) of Section Thirty-six (36), Township Two (2) North, Range Sixty-seven (67) West of the 6th P. M. , Weld County, Colorado, and WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner to locate said dairy operation on the above described premises, and WHEREAS, the said requested dairy operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution of Weld County, said dairy operation or any expansion thereof may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Henry Deibel, Route 1, Box 226, Fort Lupton, Colorado, to locate a dairy farm operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That said dairy operation shall not exceed 40 milk cows at any one time. 3. That petitioner shall proceed with due diligence to effect said dairy operation and that he shall have up to one year from date hereof to begin construction of said operation. 4. SUBJECT : Subdivision and' zoning regulations DISCUSSION : Mr. Bob Leigh presented a draft of the proposed regulations . Mr. Leigh stated they have been tailored as closely as possible to the model set up by the State Land Use Commission. It was sug- gested the members read the draft, make any changes they see fit and present them at the next regular meeting. Meeting adjourned . Deibel ' DISCUSSION : Mr. Lorenson recommended approval . It has been approved by the Health Department , the soil report is favorable and the use is compatible with surrounding land use and zoning. It should be subject to construction to begin within one year of approval by the County Commissioners and a maximum of 40 milk cows , and pro- vide a more detailed plan and reduce legal description to the area proposed for the dairy site. Mr. Deibel stated he owns 80 acres and suggested the 12 acres in the southwest part of the parcel be used for this purpose . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to Mr. Lorenson ' s requests . Motion by John Watson , second by Mr. Nix . The Board of Adjustment ; has on three previous hearings allowed the expansion of this non-conforming use . The proposed use agrees with 713 v' with the Greeley Compre hensive Plan , however a letter from the City has been received stating the area land use map shows the west side of 1st Avenue as heavy industry. If this were zoned industrial , this uselwould be allowed . Make it subject to ded- ication on First Avenue as required by the City of Greeley . This is designated as a. collector road which would required an additional 10 ' on the west side . Mr. Dinner presented the history of this business which was established before zoning . RESOLUTION : Be it therefore resolved to recommend approval of the zone change subject to the additional road dedication of 10 ' . Motion by Mr. Anderson , second by Mr. Watson . A vote of "Aye" by Anderson , Bowles , Nik and Watson. Motion carried. APPLICANT : Farr Farms Co . CASE NUMBER : SUP #131 tape 395 SUBJECT : Quarry operation LOCATION : NW4 SW4 Sec 30115 R65 APPEARANCE : Stow Witwer and Bill Farr DISCUSSION : Mr. Lorenson ' recommended approval . The land has little value as farm land . The site as exists has been partially exca- vated and has been used as a dump site . Further excavation would allow the site to be , cleaned up. If approved it should be subject to a redevelopment plan that proposes either a lake or a park area . Redevelopment as a land fill site at some point in the future would have to be determined when the site is actually available for that use . Suggestions have been made by the developer for re- use , but no plan has ' been submitted . Mr. Witwer stated a report on the soil conditions in the site indicate that this is suitable as fill dirt for feed lots and at some time in the future would be suitable as a land fill site . They proposed secondly that it become a lake or a park . Mr. Lorenson stated he felt the slopes should be indicated , Ithe ,depth that it will be excavated and whether it will be a wet pitjor a dry pit. Mr . Witwer stated it will be approximately 12 feet deep and will be a dry pit . Mr. Farr stated it will be used for approximately 10 years . RESOLUTION : Be it thereforeiresolved to recommend approval to the Board of County Commissioners subject to a rehabilition plan as a possible park area . Motion by Mr. Nix , second by Mr. Anderson . A vote of "Aye" by Anderson , Bowles , Nix and Watson. Motion carried . APPLICANT : Moore Realty CASE NUMBER: S-74 3961 SUBJECT : Northmoor Acresp - 2nd Filing LOCATION : Wk Sec 24 T4 R68 APPEARANCE : Robert Marx , Dale Olhausen , Dave Shupe DISCUSSIONS Mr. Lorenson ' recommended the plat be accepted subject to a road construction performance bond of $42 ,500 for 10,592 . 70 ' of road , approval of the drainage plan by the County Engineer , closure sheet being submitted of outer boundry of plat and dedi - cation of a 1 ' strip ' for non-road purposes on all lots that have double frontage,. Septic tanks will be used and has been approved by the Health Department , Joe Knutson , Charles Wilson , Elmer Rutt Charles Burch appeared to oppose the drainage and run-off that they feel will occurs. Mr. Shupe explained the retention area and where the run-off will go , and that there will be no more 714 run-off when the area is fully developed than there is at the present time . MOTION : By Mr . Nix to take the matter under advisement until a report is received from the 'County Engineer on the drainage . Second by Mr. Watson . A vote of "Aye" by Anderson , Bowles , Nix and Watson . CASE NUMBER : Z-188 tape 396 SUBJECT : Zone change A - IC LOCATION : NZ NW-4 Sec 6 T6 R65 APPEARANCE : Robert Wilcox and Ted Sutter DISCUSSION : Mr. Lorenson 'stated the original staff recommendation was for approval as the proposed rezoning is consistant with existing non-conforming use , surrounding use is consistant with the proposed use . The Highway department has no objections . Site iS adjacent to Eaton City limits and should be considered for annexation . However , the Town of Eaton has made a request to allow the Eaton Planning Commission an opportunity to consider the application at it ' s December 15th meeting . They would like to discuss the pos- sibility of annexation , therefore it is recommended that it be tabled . Mr . Wilcox sjtated they had no objections to annexation but this is the first they had heard anything about it. Mr. Lorenson suggested they withdraw their zone application and apply for a variance for th'e expansion of a non-conforming use until the annexation could be alccomplished . MOTION : By Mr . Anderson to table the application . Motion died for lack of a second . MOTION : By Mr .. Nix to table the zone application and recommend the applicant apply for al variance through the Board of Adjustment, with recommendation to the Board of Adjustment to approve the extension of a non-conforming use with the approval of the Town of Eaton that they will proceed with annexation procedures . SUBJECT : Left Hand Water District contracts APPEARANCE : Alva Dodd and, Chuck Brackenberry DISCUSSION : There was dislicussion on the availability of water for high density subdivislions . Their primary purpose is - to furnish agricultural water. 'Mr. Dodd stated they would like to work with the Planning Commission regarding subdivisions before they are approved . If they expand their facilities , they would have to purchase water from Big Thompson . One unit of water is required for each tap . SUBJECT : Building permits DISCUSSION : Mr . Lorenson presented statistics on building permits written so far this year showing the number , valuation and fees . SUBJECT : Pine Lake Trailer Resort DISCUSSION : Mr . Lorenson presented a letter from H. Gordon Howard regarding the zoning !of his trailer park. SUBJECT : Charles Moeller DISCUSSION : Mr. Lorenson (read a letter from Mr. Moeller regarding serving on the Planning Commission. 715 SUBJECT : Ag Council DISCUSSION : Mr . Watson reported the committee appointed to work on the "A" zone regulations would meet with the Ag Council on Monday, Dec . 20 , ; 1971 at 2 :00 P. M. in the Ag Council office . SUBJECT : Northern Colorado Water Conservancy District DISCUSSIONS Mr. Simpsonlstated he would like to have Mr. Lorenson meet with their water board so they could point out their legal limitations and their previous policy of allocating water. Based on this information , have him present to the Board what he is trying to do In the County which will give..them a back ground to judge their thoughts and actions on . Mr . Anderson stated the Planning Commission , the Regional Planning Commission and the water districts are going to have to work closely to- gether. Mr . Nix stated Left Hand Water District met with the Planning Commissionland they have limited capacity, physically and financially , to serve any kind of a development. They would like the cooperation of the Planning Commission on a moratorium, Mr. Anderson statedlin the very near future he felt there would be strict legislation on the State Land Use Policy which conerns both water and land. SUBJECT : Subdivision Agreement. DISCUSSION : Mr. Lorenson discussed a proposed agreement for Sub- divisions for the improvements in the form of a bond , cash , certified check , a letter of credit or a note . This would be tied to specific items that are listed under the agreement that would go along with the package of a Subdivision . It would be written out in the agreement exactly what the developer is ex- pected to do . A Resolution is to be written . SUBJECT : Land Use Policy DISCUSSION : The Resolution of the Land Use Policy has not been written or signed by the County Commissioners to date . 716 SUBJECT : State Planning Office DISCUSSION : Mr. Lorenson read a letter from the State Planning Office requesting a representative from this area. The letter stated the Governor has requested that the Division of Planning proceed with the development of a Colorado Airport Plan, to be completed by July 1 , 1973 . They requested Mr. Lorenson ' s assistance in an advisory capacity to formulate the goals and objectives of a State wide airport system plan . SUBJECT : A-95 review - Ft. Lupton public water facilities DISCUSSION : Mr. Lorenson stated Ft . Lupton is requesting funds for public water facilities , improvements to the town water system, replacing, undersize transmission lines , extend lines into resi - dential and industrial growth areas . water pressure storage facilities and replace inadequate existing tower . MOTION : By Mr . Nix to recommend approval for this application . Second by Mr. Ashley. A unanimous vote of "Aye" . Motion carried . SUBJECT : Letter from Chairman of Regional Planning Commission DISCUSSION : Mr. Lorenson stated the letter stated the rules of of association , makes reference to what our contractor is sup- posed to be doing on the regional level and also relates to the City of Greeley appointing a member to replace Wayne Wells on the Policy Board. IThe City feels that the consultant needs to give us some direction in the formation structure . The com- pletion date of the contract is in May. Mr. Leigh stated he in- tended to have a draft by Feb . 1 , 1972. It will take a series of meetings after that to go over the draft. ANNOUNCEMENT : A Policy Board is scheduled to meet Wed . 12/15/71 at the Northern Colorado Water Conservancy District office at 7 :30 in Loveland . An effort will be made to have the Planning Com- mission members of both Counties meet also . SUBJECT : Interladco DISCUSSION : Mr . Lorenson discussed having a moratorium on subdivisions until the "A" zone is revised or approved . Larimer County at the present time has a moratorium on subdivisions in the mountain areas . All other subdivisions must be tied to water and sewer . Mr. Leigh stated as an alternative , would be to amend the sub- division regulations . ' SUBJECT : Land Use Polity DISCUSSION : There was discussion regarding the Land Use Policy as adopted by the Planning Commission and recommended to the Board of County Commissioners . County Attorney will be contacted to draw up a resolution for adoption by the County Commissioners . SUBJECT : Press media DISCUSSION : A request from some of the press media to be present at the executive meetings . It was agreed that these meetings are work sessions and not necessary for press to be present. SUBJECT : Draft of zoning regulations DISCUSSION : Mr . Bob Leigh of Alan Voorhees and Associates presented a draft of the zoning regulations of the Comprehensive Plan . Marshall Anderson suggested when a subdivision plat is filed_ 717 developers not be allowed to have several filings , that the entire developmentlibe filed at one time . Mr. t!orenson stated there is a procedure in some areas which takes care of this, A preliminary plat is filed , it is only acceptable for a certain time. An overall development plan is filed . There was dis- cussion regarding 'Temporary Assemblages " Reference could be made to a resolution by the County Commissioners regarding the regulations for such . . Mr. Deibel intends to use the land for a dairy operation. • The area in question is level to nearly level, is not subject to flooding and has very little runoff. The nearest open water is the Lupton Bottom canal, about 700 feet away. The soils are deep, moderately coarse to medium textured.
