HomeMy WebLinkAbout20210360.tiffHEARING CERTIFICATION DOCKET NO. 2021-04 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR20-0031, FOR OIL AND GAS SUPPORT AND SERVICES, SPECIFICALLY OIL AND GAS PROCESSING FACILITIES AND RELATED EQUIPMENT (PUMP STATION) IN THE A (AGRICULTURAL) ZONE DISTRICT - ONEOK ELK CREEK PIPELINE, LLC A public hearing was conducted on February 10, 2021, at 10:00 a.m., with the following present: Commissioner Steve Moreno, Chair Commissioner Scott K. James, Chair Pro-Tem Commissioner Perry L. Buck Commissioner Mike Freeman Commissioner Lori Saine Also present: Acting Clerk to the Board, Jan Warwick Assistant County Attorney, Bob Choate Planning Services Department representative, Michael Hall Public Works Department representative, Melissa King Health Department representative, Ben Frissell The following business was transacted: I hereby certify that pursuant to a notice dated December 21, 2020, and duly published December 23, 2020, in the Greeley Tribune, a public hearing was conducted to consider the request of ONEOK Elk Creek Pipeline, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR20-0031, for Oil and Gas Support and Services, specifically Oil and Gas Processing Facilities and related equipment (pump station) in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. EI Michael Hall, Department of Planning Services, presented a brief summary of the proposal, stating the site is known as the Stoneham Pump Station facility, and described how the site will support the transportation of natural gas liquids (NGL) and the history and location of the Elk Creek Pipeline (ECP), which traverses under the property by USR18-0043. He stated the ECP enters Weld County from Laramie County, Wyoming, and runs approximately 43.3 miles through Weld County and exits into Logan County. Mr. Hall described the operation and production statistics of the pipeline, stating the Stoneham Pump Station facility is one of ten (10) proposed similar facilities along the pipeline established to increase capacity by 160,000 barrels per day (bpd). He relayed the station will be located on a seven (7) acre parcel, will be unmanned, closed to the public and only accessed by deliveries and authorized employees for monthly operation maintenance, inspection and repair activities. Mr. Hall stated the construction of the facility will take approximately nine (9) months, bottled water and portable toilets are proposed during construction and no permanent water storage or sewage disposal method is proposed. He described the equipment to be installed at the station, explaining two (2) of the three (3) pumps will be running at one time, with the third as a back-up. He relayed a 20 -inch pipeline loop system is proposed off the existing pipeline valve site, explaining its use. Mr. Hall described the construction of an on -site pump station and substation, in partnership with Morgan County Rural CC PL (014-/-rni, Ph) CePiK/ Ply), EH -(5F) 2021-0360 PL2781 HEARING CERTIFICATION - ONEOK ELK CREEK PIPELINE, LLC (USR20-0031) PAGE 2 Electric Association, to support the power demand of the facility designed to receive a 69 kV transmission line, which is stepped down to 24.9 kV at the substation transformer with a buried feeder into the pump station, which is deemed an Accessory Use to the Pump Station and does not require a separate USR. He explained the site will be secured by a chain -link fence with a controlled access gate, a dumpster will be located onsite, and an emergency sign is proposed. He relayed the two (2) surrounding property owners (SPOs) were notified with no communication received. Mr. Hall stated two (2) accesses onto County Road (CR) 82 are proposed, no permanent fuel storage or warehousing is proposed, nor is landscaping or screening; however, approximately 52,000 square feet of the site will remain in native vegetation. He explained twelve referrals were sent out, with six (6) responding. He described the location of the site on the Logan County/Weld County line, stating Logan County did not return a referral response. He displayed maps of the parcel explaining the site is not located in a floodplain or any overlay district. Mr. Hall described the adjacent lands and their uses, displayed photos of the site, and entered the favorable recommendation of the Planning Commission into the record as written. Melissa King, Department of Public Works (PW), stated the parcel has one (1) existing permitted access onto CR 82, explained the applicant has proposed a second access located east of the existing access onto CR 82, to be used for installation, decommissioning and routine maintenance of the pump station and which will require a separate permit for the second access. She relayed CR 82 is a local, gravel road, and no traffic counts are available in the area. Ms. King shared the traffic information submitted, indicated during construction there will be approximately 14 to 19 daily round trips to include 10 to 15 passenger vehicles and four (4) truck trailers, and during operation there will be six (6) to nine (9) monthly round trips to include two (2) to five (5) passenger vehicles and four (4) truck trailers. She stated 100% of the traffic will travel west on CR 82, continuing south on State Highway 71. Ms. King stated PW is requesting a Road Maintenance Agreement, including, but not limited to, dust control and damage repair to the specified travel routes. She relayed a Final Drainage Report was received and accepted, and a Weld County Grading Permit is required if more than one (1) acre is disturbed. e Ben Frissell, Department of Public Health and Environment (EH), explained no permanent employees will be employed at the site once construction is complete; therefore, no utilities are required. Mr. Frissell stated typical dust and waste standards are included as Development Standards (DS) #13 and 14, and the applicant submitted a noise modeling study which shows compliance with residential noise standards. He stated DS #11 through 26 address EH items. • Cam Morse, ERM Consulting, introduced himself and stated he was open to any questions. In response to Commissioner James, Mr. Morse confirmed he has visited the site. In response to Chair Moreno, Mr. Hall explained the applicant submitted a Lighting Plan, and all lighting shall be shielded and downcast, and mounted on both the pumps and the power distribution center (PDC). e No public testimony was offered concerning this matter. • In response to Chair Moreno, Mr. Morse indicated agreement with the proposed COA and DS. Commissioner Freeman suggested amending COA #1.6, to read, "A Road Maintenance Agreement is required at this location during construction. Road Maintenance includes, but is not limited to, dust control and damage repair to specified construction haul routes." In response to 2021-0360 PL2781 HEARING CERTIFICATION - ONEOK ELK CREEK PIPELINE, LLC (USR20-0031) PAGE 3 Commissioner James, Mr. Frizzell stated DS #16 is standard EH policy, but since this site is unmanned, it is up to the Board to leave or remove. Commissioner James suggested amending the first sentence to read, "During the construction phase, adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility, at all times. Commissioner James suggested deleting DS #21 (Noise levels) and Commissioner Freeman suggested deletion of DS #32 (Road Maintenance Agreement). The Board agreed to all the aforementioned changes. In response to Chair Moreno, Mr. Morse, on behalf of the applicant, indicated he reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. No public testimony was offered regarding changes made to the Conditions of Approval and Development Standards. e Commissioner James moved to approve the request of ONEOK Elk Creek Pipeline, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR20-0031, for Oil and Gas Support and Services, specifically Oil and Gas Processing Facilities and related equipment (pump station) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Freeman, and it carried unanimously. There being no further discussion, the hearing was completed at 10:38 a.m. This Certification was approved on the 17th day of February, 2021.
