The following resolutions were presented: THE BOARD OF EQUALIZATION 1971 PETITIONS OF NEW CACHE LA POUDRE IRRIGATING COMPANY: o\ WHEREAS, the Board of County Commissioners of Weld County, Colorado, organized as a Board of Equalization for the purpose of adjusting, equalizing, raising or lowering the assessments and valua- tion of real and personal property within this County, and for the purpose of hearing any denials or any objections and protests made to the assess- ment of real property, fixed and made by the County Assessor as certified to this Board by the County Assessor for the year 1971, and WHEREAS, New Cache La Poudre Irrigating Company did present their petition of appeal from the County Assessor's determination of taxability of the property belonging to Petitioner, claiming as grounds for relief thereunder that said property described in such petition was exempt from separate taxation as provided under Section 3, Article X of the Colorado State Constitution and also found in C. R. S. 137-2-1 (4), and WHEREAS, said petition has been heard before the County Asses- sor and due notice on appeal thereon has been given to taxpayer, and taxpayer has timely filed an appeal petition with this Board, and WHEREAS, after due consideration of the facts and statements as presented by the taxpayer, the Board has been sufficiently advised. WHEREAS, Globe Construction Company, a Colorado Corporation, and Country Club Villas Association, a Colorado Corporation, have sub- mitted an Agreement accompanied with a condominium declaration for Country Club Villas providing, among other things, for a private street and any extensions thereof within the condominium, which street is known as Ward Drive, all as more particularly set out in paragraph 31(b) of said declaration, and WHEREAS, the Board has determined and believes it to be in the best interest of the County to enter into such an agreement on the basis recited therein. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to expand said cattle feed lot operation and that he shall have up to one year from date hereof to begin construction for the expansion thereof. 3. That when expansion of said cattle feed lot operation is com- pleted, same shall not contain more than 1500 head at any one time. 4. That petitioner shall construct a sealed retention pond and drain ditch to prevent pollution. 5. Sy y��"'."'°„`, RESOLUTION WHEREAS, on or about May 8, 1970, Weld County, Colorado, through its Board of County Commissioners, for good and valuable consideration, did grant a Mineral Lease to V. H. Simmons, Jr. covering the following described premises, to-wit: The SW 4 of Section 26, Township 4 North, Range 63 West of the 6th P. M. , Weld County, Colorado, and WHEREAS, on or about November 4, 1970, Weld County, Colorado, through its Board of County Commissioners, for good and valuable consideration, did grant a Mineral Lease to Thomas Wheatley covering the same identical hereinabove described property, and WHEREAS, it has been brought to the attention of the Board that it had leased property to Wheatley although at the time there already was an existing lease of the same property in favor of Simmons, and WHEREAS, Wheatley caused his lease to be recorded and sub- sequently sold same by assignment for a profit, including a five per cent (5%) overriding royalty interest, and WHEREAS, the Board recognizes that through some inadvertance within its office an unusual situation exists causing undue hardship and loss of reasonable profits to Simmons, and WHEREAS, the Board, desirous of avoiding an unnecessary lawsuit, believes it to be in the best interest of the County to enter into a negotiated agreement of Accord and Satisfaction with Simmons, pro- viding for settlement of all claims and demands that Simmons may have against the County upon the basis recited therein. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, Weld County, Colorado, that said agreement of Accord and Satisfaction between Weld County and Simmons, providing for settle- 32S ment of all claims and demands of Simmons against the County, copy attached hereto and made a part hereof by reference, be, and it hereby is approved. BE IT FURTHER RESOLVED, that the Board be, and it hereby is authorized to execute said agreement of Accord and Satisfaction with Simmons and to make the same effective forthwith. R. S. 1963, and WHEREAS, funds derived from said 3 mill levy have now been exhausted, and WHEREAS, Weld County did not request authorization for a levy in excess of the mill levy rate as set forth in 119-3-6(4), C. R. WHEREAS, it has been determined that the present accounting system within the Weld County Department of Public Welfare is in need of revision and change, and WHEREAS, The Greeley National Bank has submitted an agree- ment to perform services for the Weld County Department of Public Welfare in the form of calculation and printing of the Human Resources Accounting System reports, and WHEREAS, the Board of County Commissioners, Weld County, Colorado, believes it to be in the best interest of the County to enter into such an agreement on the basis recited therein. In the event GNB should determine that any renewal of this agreement shall be subject to modification in costs charged by GNB for services rendered, it shall be obliged to furnish such notice on or before the 1st day of each month of April hereafter, and if such charges are not acceptable to the County, the latter may thereafter advise GNB in writing of its intention not to renew this Agreement, even if such notice is received by GNB later than the 1st day of each month of April hereafter. WHEREAS, it has been determined that the present system of U printing of the welfare recipient payroll checks and reports is in need of revision and change, and WHEREAS, The Greeley National Bank of Greeley, Colorado, is engaged in the commercial activity of computer data processing, and WHEREAS, The Greeley National Bank has submitted an agree- ment to perform services for the Weld County Department of Public Welfare in the form of calculation and printing of the Welfare recipient payroll checks and reports, and WHEREAS, the Board of County Commissioners, Weld County, ��F!
