WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, pursuant to Section 2-4-10 of the Weld County Code, the Board of County
Commissioners considered the appeal of the decision by the Department of Planning Services to
deny an Access Permit to Lot A of Corrected Recorded Exemption, RECX18-0075, applied for by
the Appellant, Erica Arnold, and
WHEREAS, the Board heard testimony and took evidence from Department of Planning
Services staff and the Appellant's representative, and
WHEREAS, upon consideration of such appeal, including review of all information
submitted by the Appellant and the Department of Planning Services, the Board deems it
advisable to grant the appeal of Erica Arnold, reverse the denial of the Access Permit application
by the Department of Planning Services, and remand the issue back to staff with instruction to
issue the applied for Access Permit with the condition that the appellant first submit a copy of the
recorded document to the Department of Planning Services, signed by the owners of Lots A and B
of Corrected RECX18-0075, which vacates the 30 -foot wide access and utility easement across
Lot B, dedicated on the Corrected RECX18-0075 plat, recorded on December 4, 2019, at
Reception #4546892.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the appeal of Erica Arnold, be, and hereby is, granted, and the decision of
the Department of Planning Services to deny the applied for Access Permit to Lot A of Corrected
Recorded Exemption, RECX18-0075, be, and hereby is, reversed and remanded back to staff
with instruction to issue the applied for Access Permit with the condition that the appellant first
submit a copy of the recorded document to the Department of Planning Services, signed by the
owners of Lots A and B of Corrected RECX18-0075, which vacates the 30 -foot wide access and
utility easement across Lot B, dedicated on the Corrected RECX18-0075 plat, recorded on
December 4, 2019, at Reception #4546892.

SUBJECT: Appeal of Access Permit Denial for Erica Arnold
Weld County Planning Services Department (Planning) received an access permit application from Erica Arnold on
November 18, 2021. The permit application was in response to a stop work order issued on November 10, 2021 by the
Department of Public Works, with support from Planning. The stop work order was to halt construction of an access without
the proper access and/or right-of-way use permits. Upon receipt of the application, it was communicated that based on
prior history and decisions from the Board of County Commissioners (BOCC), in two prior hearings, that this request would
also need to go in front of the BOCC for consideration. The submitted application requested one (1) agricultural access
point onto WCR 388 for Lot A of recorded Exemption (RE), RECX18-0075. Lot A was part of a two -lot recorded exemption
(RE), RECX18-0075, approved by BOCC Resolution. Below is a summary of the prior case history:
Weld County Planning staff had initially recommended denial of the RE based on non-compliance with Section 24-8-40.P
of the Weld County Code. Because staff denied the RE the project was presented to the BOCC for consideration on August
6, 2018. Ultimately, the BOCC approved the RE with a condition that the two lots/properties share an access point. As
shown in Exhibit A, Resolution Condition 2.6 as determined by the BOCC states:
A 30 -foot wide joint access and utility easement extending across Lots A and B from County Road 388, for the benefit of
Lots A and B, shall be shown clearly on the plat. The joint easement shall be dedicated for the use as shown using the
language set forth in the Weld County Code, Appendix 24-F.2. The easement shall be graded and drained to provide all-
weather access.
This resolution language was consistent with other sections of the Weld County Code as follows:
12-5-30.A, Access to a Single Parcel. Each parcel shall be allowed one access point for safe ingress and egress, which
may be an existing or new shared access. Each parcel shall be limited to this single access, except as modified by the
Board of County Commissioners; as a result of zoning requirements; consideration in land use applications; safety
considerations; subdivision regulations; or the inability to meet minimum requirements as outlined in the Weld County
Engineering and Construction Criteria document shown in Appendix 12-A.
24-8-40.C, Exemption Standards. An access is, or can be made, available that provides for safe ingress and egress to a
public road. All accesses shall be in accordance with Chapter 12, Article V of this Code, and shall endeavor to achieve the
goal of no "net increase" in the number of accesses onto adjacent County roads when accesses already exist.
1. Where the access is adjacent to a state highway, the Colorado Department of Transportation has jurisdiction over
existing or proposed access points. The applicant shall be responsible for obtaining a new Access Permit from the
Colorado Department of Transportation.
2. Contiguous lots created through the exemption process shall, when practicable, share access.
3. Existing or future public rights -of -way and additional access points on County raods shall be dedicated or reserved
in conformance with Chapter 22 of this Code and any adopted intergovernmental agreements or master plans of
affected municipalities.
4. A new access with a choice as to which County road it feeds onto shall choose the County road with the lowest
traffic count.
At the August 6th board hearing, the County Commissioners asked the owner if she understood and could agree to a shared
access point and she agreed. The BOCC did not require a specific location as long as there was one safe access point
that would be shared for both lots.
Later that month (August, 2018) staff received an access permit application from AGPROfessionals on behalf of Erica
Arnold. The permit application requested two residential access points on WCR 388 as part of a two -lot recorded exemption
(RE), RECX18-0075. Staff denied this request based on the original resolution and determination of the BOCC fora shared
access point for both lots of the RE. AgPro appealed to the BOCC and during the hearing it was presented that Lot A had
an existing agricultural access point. Based on this information and the BOCC's position to not close historical, existing ag
accesses AgPro withdrew the appeal request. A few weeks after this hearing it was determined that the surveyor had made
an error and the existing ag access was on the neighboring property to Ms. Arnold. That landowner locked the gate to
prevent access through their parcel. Ms. Arnold contacted the County with this news and was told that her legal access
was through the easement on Lot B. It was at that time when Ms. Arnold disclosed that during the sale of Lot B, and prior
to knowing about the survey error, she agreed to an arrangement giving up rights to use the access easement to access
her property essentially land locking it. No other communication or requests were made until the current submittal being
discussed today.
Planning Staff recommends denial of the access application based on the original resolution and decision of the BOCC for
a shared access point. The requested access does not meet current Weld County Code for spacing criteria but does not
have any safety concerns with sight distance. If the BOCC does choose to approve the application and provide an access
to Lot A, staff recommends that it be conditioned on updating the plat map to document approved conditions.
WCR 388 is a collector road with 80' of right-of-way as identified on the County's functional classification map. The ADT
is 389 with 22% of the vehicles per day being trucks.

County Road 388 is a paved road and is designated on the Weld County
Functional Classification Map (Code Ordinance #2017-01) as a collector
road, which requires 80 feet of right-of-way at full buildout. The applicant
shall verify and delineate on the plat the future and existing right-of-way
and the documents creating the existing right-of-way. If the existing
right-of-way cannot be verified, it shall be dedicated. The applicant shall
also delineate the physical location of the roadway This road is maintained
by Weld County.

I went before the BOCC in Summer of 2018. At this time Lot A of my parcel had an existing Ag
access directly off of CR 388, that myself and the landowner before me utilized the past 20
years. At this hearing the BOCC granted me an easement entering through the neighboring
property of Lot B, in which there is a 30 foot undriveable terrain in order to access Lot A. At this
time, I had an existing Ag access that I have been using since purchasing the parcel and
confirmed by the surveying company, Hammer Land Surveying Inc, so the easement had no use
to me and I gave it up knowing that I would not use it. Due to financial hardship, I sold lot B in
Sept/Oct 2018. Fall of 2018, Hammer Land Surveying Inc contacted me and informed due to
negligence, the survey that was done for the Recorded Exemption was incorrect, and the Ag
access we are utilizing to access the property (Lot A) actually falls within the neighboring
property (to the east). Hammer Land Surveying Inc contacted the neighbor to the East and within
weeks the neighbor ripped out my 10 foot gate and refertced his boundary line to include the
existing Ag access we were utilizing to get in and out of the property, even though they currently
had an existing access point. Now the neighbor to the East has 2 access points, leaving no access
point for our property, Lot A. Due to the negligence Hammer Land Surveying Inc voluntary
permanent relinquishment of professional land surveyor by the State of Colorado (Dora Case
Nos 2019-7566 and 202-6856), effective Feb 16, 2021, but I'm still without an access point into
Lot A.
Since we have no way of accessing Lot A, it is causing financial debt, I have no way to unitize
the property and therefore it is not being maintained. The brush is high and there's no way of
driving or walking on the property. The week of October 26 I rented a bobcat to clear the brush
and put some dirt in the ditch so an individual or a vehicle can access the property. On Nov 10, I
received a Stop Work order from Weld County, in which they requested 1 apply for a permit. I
can not apply for a permit since I originally went before the BOCC. I am currently land locked
and unable to maintain my property.
I appreciate you taking the time to hear my story and work with me in finding a solution that
doesn't negatively affect the neighbors.

Once you download the document and save it to your files, open with Adobe and click on the green arrow bookmark. If
a yellow notification bar opens at the top of your screen, click on the Options button and select `Trust this document

When we spoke, you indicated you had someone available to represent you on December 8, 2021, at 9:00 a.m., so I am
going to go ahead and schedule the matter for that date and send you a calendar appointment. Please complete the

reviewing the upcoming Commissioner meeting availability, we can schedule your hearing on either December 8th
(Commissioner Freeman will be absent), or December 13th (this would require your waiver of allowing for two

Services. Unfortunately, the variance request has been denied. You have the option of
appealing this decision and forwarding your case to the Board of County Commissioners.
The Board of County Commissioners shall act as a board of appeals to hear complaints on
