Home My WebLink About740010.tiff RESOLUTION WHEREAS, on or about January 19, 1972, Mr. Heinz, et al. , as owners, entered into an agreement with Weld County, Colorado, whereby the owners agreed to construct a portion of Polk Avenue in accordance with Weld County road specifications, all as contained in that certain agreement dated January 19, 1972, copy of which is attached hereto for ready reference, and WHEREAS, in order to comply with the agreement to build a portion of said Polk Avenue, the owners signed and delivered to the Board of Weld County Commissioners a note dated January 4, 1972 in the sum of $2, 800. 00 guaranteeing that the portion of said road would be built in accordance with the specifications and in accordance with the aforementioned agreement, and WHEREAS, it has now come to the attention of the Board that the owners have completed the work pursuant to the agreement and in accordance with the specifications as contained therein and now wish to have the aforementioned note cancelled and returned, and WHEREAS, the Board has determined that the owners have fulfilled their agreement with regard to building the said road and its subsequent acceptance by the County of Weld for maintenance. NOW, THEREFORE, BE IT RESOLVED, by the Board, and it hereby orders and authorizes that the aforementioned note dated January 4, 1972, in the sum of $2, 800. 00, be marked cancelled and that same shall be returned to the owners pursuant to the agreement.
