HomeMy WebLinkAbout20212658STATEMENT OF PURPOSES AULT FIRE PROTECTION DISTRICT In accordance with Section 32-1-208 of the Colorado Revised Statutes ("CRS."), this document and attached exhibit shall constitute the Statement of Purposes of the Ault Fire Protection District, a political subdivision of the State of Colorado ("Fire District"). 1. fuposes For Which The Fire District Is Organized The Fire District is organized pursuant to C.R.S. § 32-1- 101, et seq. ("Special Districts Act") to provide Emergency Services (as defined in Section 2 below) through the exercise of all powers and authority granted to Colorado special districts under the Special Districts Act, as may be amended, including the common powers delineated in C.R.S. § 32-1-1001 and the additional powers and authority granted fire protection districts under C.R.S. § 32-1-1002, and all powers and authority granted under federal, state, or local constitutional, statutory, regulatory, or common law (including all inherent/implied powers and authority), as may be modified or established from time to time (collectively, "Applicable Law"). 2. Services Provided Or To Be Provided By The Fire District The Fire District is permitted to provide fire suppression; fire protection and related support services, such as investigatory and mitigation activities; fire prevention and public education services; emergency rescue and extrication services; hazardous materials services; and ambulance and emergency medical services (collectively, "Emergency Services") to the citizens and property within its jurisdiction, to individuals passing through its jurisdiction, and to citizens and property outside its jurisdiction to the extent authorized by Applicable Law. The term "Emergency Services" also includes any other forms of emergency services that the Fire District may in the future become authorized to provide by Applicable Law, and which the Fire District's Board of Directors ("Fire District Board") determines is in the best interests of the Fire District and its constituents to provide. The Fire District may provide the Emergency Services directly, or may provide all or any of the CoMMc,n:coo+:onS RECEIVED SEP 0 8 2021 WELD COUNTY COMMISSIONERS 2021-2658 sDo02y Emergency Services indirectly by contract with another Emergency Services provider. The Fire District Board shall, in its sole discretion, determine the scope and level of Emergency Services to be provided, whether directly or indirectly, and the method by which the Emergency Services will be provided, based upon such factors as (a) current and projected general economic conditions; (b) Emergency Services technology and best practices; and (c) the Fire District's current and projected: (i) financial condition and budgetary constraints; (ii) Emergency Services area, both within and outside the Fire District's jurisdictional boundaries; (iii) capital and workforce resources; and (iv) Emergency Services demands. The Fire District Board also may consider such other factors as it deems appropriate. All of the Emergency Services as herein defined constitute the same "type" of public services and the Fire District Board's decision to increase, modify, or terminate some aspect of the Emergency Services it provides, whether directly or indirectly, shall not constitute a material modification of this Statement of Purposes within the meaning of C.R.S. § 32-1-207, as may be amended from time to time. 3. Facilities Provided Or To Be Provided By The Fire District The Fire District currently maintains facilities, with associated buildings, structures, and improvements, at the following addresses within its boundaries: 16680 Colorado Highway 14 Ault, Colorado 80610 601 2nd Street Pierce, Colorado, 80650 The Fire District Board shall have the full power and authority provided by Applicable Law to acquire, dispose of, lease, encumber, construct, improve, or renovate/expand any real property, facilities, structures, buildings, or improvements, either within or outside the Fire District's jurisdiction, that the Fire District Board determines necessary or appropriate for the Fire District's administration or operations. The Fire District's acquisition, disposal of, leasing, encumbering, constructing, improving, or renovating/expanding of real property, facilities, structures, buildings, or improvements, either within or outside the Fire District's jurisdiction, shall not constitute a material modification of this Statement of Purposes within the meaning of C.R.S. § 32-1-207, as may be amended from time to time. 4. Areas Served Or To Be Served By The Fire District The Fire District's current jurisdictional boundaries are set forth on the attached Exhibit A. The Fire District shall have the full power and authority granted by Applicable Law, including without limitation, C.R.S. §§ 32-1-401 and -501, et seq., to include within its jurisdiction, or to exclude from its jurisdiction, such real property and improvements thereon as the Fire District Board determines to be in the best interests of the Fire District, the Fire District's constituents, the real property and improvements to be included or excluded, and the real property's owner(s).
