An MSWord (.docx) version of this questionnaire is available by request. 9 05-06-2021 Hiner Recreation Lakes USR Revision 2021 Questionnaire — 2220 O Street, Greeley, CO. 80631 Question 1 a, No changes to hours of Operation, Employees landscaping or screening. Member RV Storage has been against the fence line along 231d Ave running north to south starting at the member entrance gate on 213rd Ave.. This has been the designated storage area on the most recent approved USR in 2019 and has been used by the members for 8 to 9 years. We added an additional storage are to this USR revision near the abandoned well just west of the Camp Lake. b. Only changes to Lot surface is the addition of shop near the Hiner's home (north & West of their home). This shop was permitted through Weld County. c. No changes to material stockpile, storage or waste areas to be utilized. d. No changes to the types of items stored. e. No changes to where and how material storage and/or stockpile of waste, chemicals. Oil/Gas well just west of camp lake was plugged and abandoned by company servicing well. This change is noted on the USR revision. f. No changes to Fuel Storage on site. g. No changes to air emissions on site. h. No changed to traffic patterns from last revised and approved USR Permit. i. No changes in the impervious area of the site, j. No changes to access from the most recent revised and approved USR Permit. 2. The reason for this revision of the USR permit are as follows: - Main reason for this revision request is to get the property as it has been operated for years to match up to the USR so we are in sync. Add the new shop north and west of the Hiner's home. - Show the plugged and abandoned oil/gas well just west of the camp lake. Add the 12 camping spots to the small lake in the southeast corner of the property called the "Camp Lake". Get the South Lake camping spots in compliance on the USR for overnight camping. In 2015 there was a meeting in Kersey with FEMA and Weld County and the property owners were told that FEMA would allow overnight camping to take place on the on the South Lake. Since that meeting took place and verbal approval was given we have been operating that way. We now want it to be reflected on the USR Permit. The Landowner, Leaseholder and Members would like to respectfully request that we can leave our campers, support/storage trailers and large items at the site in our camping area in the offseason. The offseason is 10/15 to 04/14 each year. Although some of these spots are in the flood plain (not all of them) the risk of any flooding in the offseason is minimal or nonexistent. This is a period when there is no runoff or heavy rains in Colorado. We would be open to some additional rules and creating an anchoring system for each RV and trailer and all small items in a members site would have to be enclosed in a shed, trailer or removed from the property in the offseason. Owner, Leaseholder and Members may want to add electrical service to each lake and to each site. Permits for all work will be obtained and building codes followed. This work would be done in the next 2 to 3 years. • The other changes are mainly cleaning up some language and removing notes and standards that are redundant. 3. Uses of the site will remain the same and will not have a negative impact to the surrounding area, neighbors or community. Said uses are Oil & Gas Operations, Mining Operations and Private Recreational Watersports and Camping Club. This property has been used in such a manner since the early 1990's. The property site has only improved in condition, the activities on the property have injected large amounts of money in the surrounding community. The uses are and have been in compliance with the previously approved USR Permits, County Code and are in harmony and compatible with the neighborhood as a whole. All activities on the property are approached with respect to the land, guidelines, neighbors and community. The Watersports and Camping Operations have a season which starts 04/15 and ends 10/14 every year. There are no employees in my hire or for RM Hiner Construction with regards to the operations under the MUSR 1075 at 2220 O St., Greeley, 80631. The Watersports and Camping Operations is managed by Mike Bare. There is a strict rules package that is in place for all members to follow as well. There are many areas of landscaping and screening throughout the property both planted by the owners and by lake members over the years. There is also much natural growth that is occurring and is maintained. 2- Items being Stored. The following items are being stored for the Watersports and Camping Operations: a. RV's, Boats & Campers, and related equipment. b. Support Trailers such as enclosed trailers, utility trailers. c. Construction & Farm Equipment d. Construction Materials. e. Vehicles (personal and business support). f. Carports, Storage Sheds, Shade Structures. The following items are being stored on the property for the Construction, Mining Operations and Oil & Gas Operations: a. Items pertaining to the construction company that are being stored on the property include all necessary safety equipment, safety vests, earplugs, hard toed shoes/boots, FR clothing (fire retardant) , hardhats, gloves, fire extinguishers, and first aid kits, b. Digging equipment, back filling equipment, and boring equipment. c. Welding, testing and related equipment. d. All construction supporting equipment, and supplies (such as oil, fuel, and grease) e. See original USR for reference. 4) Change deck and patio size form 10'x20' to 30 x 50 and add word patio or deck. 5) Change storage shed/trailer size to 12 x 25 6) Add 10 camp sites to west shoreline of Camp Lake and 2 sites to south shoreline. These sites have been there for 3 years. The lake has been designated for water sports and recreational activities since the USR inception. 7) Remove oil/gas well operations area near camp lake, well is now plugged and inoperable. Also, remove 3 -inch gas line from Well area by Camp Lake going east to property line. Gas line has been removed. 8) Add 12 camp sites to shoreline of South Lake. Add 2 docks in water on west end of south lake. These sites have been there for 10 years, and the lake has been designated for water sports and recreational activities. For 2014 & 2015 we were not camping overnight in these areas and had alternate camp sites for the South Lake Members on the North Lake. In 2016 the property owners Rex & Sharon Hiner were advised that we could overnight camping on the South Lake again like we had in the past. It has been this way since 2016. 9) South Lake and Camp Lake are in the proposed flood plain as far as we are aware. Depends on the Flood info being used (current or proposed). This may have changed since 2011 or later. If the Camp Lake and South Lakes are in the flood plain, then we need to come up with an acceptable tethering or anchoring device/system to anchor the trailers, decks, storage sheds or trailers to the ground in case of a flooding scenario (only if determined to be necessary). This would be a work around to allow these sites to be permitted and set up in the flood plain. I am working with the Planning and Flood Plain departments to devise the proper system. 10) Although not stated in the USR the Hiners have agreed, and we want to allow the members to leave their sites set up year-round instead of breaking them down and moving RV's, equipment, and trailers to the designated storage areas. In other words, to not break them down in the offseason. The only reason this was done in the past was the Hunting operations that happened on the property in the winter during the waterskiing offseason. The Hunting operations are not happening now and if they resume for any reason the Hunters will be instructed to stay away from all the camp site areas on the lake. We can and will have provisions in the rules to direct the members for the offseason storage such as site cleanup and preparation for winter/off season. We will also have provisions that the members could not use their sites for any recreation purposes, only to check on their sites and equipment during the offseason. 11) We would like to move the primary entrance for the lake operations to the pervious entrance behind the Weld County Planning Building at the Northeast corner of the property. Want to do this because the current entrance is too narrow and has a sharp left or right turn when going through the gate. This is problematic as it does not allow for long vehicles and RV's as well as is a congested area. Moving the entrance to where it was will allow for straight shot in and out of the automatic gate. We will move the automatic gate to the Northeast corner if approved. This has been asked in the past couple years to Weld County and we were denied the change. 12) Development Notes -Page 1 Changes to revised USR-1075 permit 2020. #1- added camp sites and adjusted typical size. #2- Adjusted typical camp site for South Lake site. #8 — Adjusted language of toilets and added trash. #9- added this note for clarification. #10 -added this note for clarification and procedure to leave sites set up during season and offseason as well. #15 -adjusted number of people to match rules and what we have done for 15 years. #16 -added language to match rules and what we have done for years. 13) The Following Development Standards page 2 were revised: a. #26 -this changed to read that campsites and overnight parking would be allowed with the proper anchoring systems in place. b. # 27 -Not sure how to change this but it needs to allow for overnight parking and camping. FYI, for #26 & 27 we have been overnight camping in these areas for over 10 years on the South Lake and 3 years on the Camp Lake. Weld County forced us to abide by these standards for 2 years (2014 & 2015) after the 2013 floods and then relaxed those standards and allowed camping and overnight parking in these sites in 2016 to current. c. #32 -Not sure what needs to be added here to comply. Perhaps some exception language based on the anchoring system. d. #48 -Additional standard regarding site use and all -season storage on site. e. #52 -Storage areas to be defined near the South Lake boat ramp, near the boat ramp, on the North Lake in the southwest corner and along the fence line of the property that is directly west of the west end of the North Lake. Most likely these areas will not be used much when we switch to a policy and procedure of not breaking down our sites. Although I want members to have the ability to use these areas if they want to. f. #55 -The first sentence changed to read for North, South and Camp Lake campsites. Item b should have added: and Member's Guest RV's and Member's with a Split Memberships RV". Item d should have Patio after Deck. g. #56 changed to read "North Lake, South Lake and Camp Lake". Pre -Application Request Questions 14) Existing Use of Property Oil & Gas operations, Water Sports and Recreation Activities, Mining Operations. None of these activities are being changed with this revision. We are simply cleaning up the USR Permit to match what has been allowed at the property for many years. Additionally, there are many other lakes in the area practicing the same operations we have without the scrutinization. 15) Potable Water Source: For the Water Sports and Recreation Activities there is not a potable water source and never has been since the lake operations inception. Each of the members brings their own water in a small tank and transfers it into their camper if they want. There is no expectation for potable water from the members. 16) Sewage Disposal System: The Water Sports and Recreation operations does not have a sewage disposal system and does not need one. We have between 3 to 4 portable toilets on each lake that are cleaned weekly which keeps them clean and sanitary. They also have hand sanitizers in them. 17) Site Description and Improvements: Most of the site description is the same from the current USR permit. Changes that were made have to do with moving the alternate South Lake camp sites to their correct location on the South Lake, adding the camp sites to the Camp Lake to reflect what is actual on site. Lights, fencing parking and storage have not been changed but have been better defined on the revised USR Permit submitted. 18) Oil & Gas, Irrigation Ditches, Pipelines: All the same as the current USR Permit except for the well site near the Camp Lake and the 3 -inch gas line from that site running along access road between North Lake and Camp Lake going toward the east property line. 19) Water Sports and Recreation Operation Season is already defined in current USR Permit. 20) Employees: There are not employees on site or affiliated with Property Owner or Leaseholder. 21) Accessing Site: There are 36 total memberships and Camp Sites for the Water Sports and Recreation operations. Those members can have guest up the guest policy defined in development notes, page 1. It is encouraged and controlled to limit guests by the Lake manager/leaseholder. There are also a few vendors that access the site such as trash removal, portable toilet service etc.. 22) Number of Vehicles: Each member is allowed what is defined in the typical site on page 2 of the USR Permit such as RV, Trailer, Boat. It has been this way for many years and since the initial USR Permit. There is also a few trailers and equipment the leaseholder and property owner need and use to maintain the property. 23) Permits: The is a USR Permit required and potentially a Flood Plain Permit for those sites in the Flood Plain. 24) Storage, Fuels: Each Member may have some fuel stored at the site (minimal amount) for the operations of equipment, boats, generators. There are several storage areas noted on the current USR Permit. 25) Nuisances: There will not be any nuisances from the revisions requested in the USR Permit. The Water Sports and Recreation Activities Operation is professionally managed and there is an extensive Rules Package that each member signs and agrees to. The property is also maintained for weeds and grasses by the Leaseholder and Property Owner. We believe the property is run and taken care of very well. We are seeking the following Exception, # 11 as listed in Sec 8-11-40 of the Weld County Drainage policy: An individual parcel with an unobstructed flow path and no other parcel(s) between the Federal Emergency Management Administration (FEMA) regulatory floodplain channel and the project. ii. Where the water originates if it flows onto the property from an offsite source Hard to pinpoint the actual sources but I know for sure from the farm fields north of O Street. This water flows to the retention ponds on the South side of O Street in front of the Weld County Buildings, Jail, Sheriff's Office and Juvenile Detention Center into tunnels to the North lake. The majority of the lakes water is supplied from the water table which is supplied from the Poudre River. iii. Where it flows to as it leaves the property Water flows a few ways form what I can tell. There are 3 pipes (Installed by Weld County) that connect the North Lake, South Lake and the Camp Lake. There are also 2 headgates, one on the North Lake on the east end which flows to a Weld County Lake believe. Also one on the South Lake that flows to the Poudre River. Both gates are operational from what I understand. The last time they were used was during the 2013 flood. iv. The direction of flow across the property To the best of my knowledge the water flows form the Northwest corner towards the river flowing south and easterly at the same time. 1 v. If there have been previous drainage problems with the property. Nodrainage problems since I have been there which has been from 2006. The property did not flood during the 2013 floods by the way.
