RE: APPROVE AMENDMENT #1 TO CONTRACT FOR AMENDMENT 35 TOBACCO USE
PREVENTION AND CESSATION EDUCATION, AND AUTHORIZE CHAIR TO SIGN
AND SUBMIT ELECTRONICALLY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with Amendment #1 to the Contract for
Amendment 35 Tobacco Use Prevention and Cessation Education between the County of Weld,
State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf
of the Department of Public Health and Environment, and the Colorado Department of Public
Health and Environment, commencing July 1, 2018, and ending June 30, 2022, with further terms
and conditions being as stated in said amendment, and
WHEREAS, after review, the Board deems it advisable to approve said amendment, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Amendment #1 to the Contract for Amendment 35 Tobacco Use
Prevention and Cessation Education between the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, on behalf of the Department of
Public Health and Environment, and the Colorado Department of Public Health and Environment,
be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to electronically sign and submit said amendment.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 23rd day of June, A.D., 2021, nunc pro tunc July 1, 2018.

For the Board's approval is contract amendment #1 between the Colorado Department of Public
Health and Environment (CDPHE) and the Board of County Commissioners of Weld County for
the use and benefit of the Weld County Department of Public Health and Environment
(WCDPHE), for the Tobacco Use Prevention & Cessation Education program.
Tobacco use continues to be one of the main causes of death and disability in Colorado and Weld
County. The State Health Department provides tobacco use prevention and cessation funding to
local public health agencies from monies received via Amendment 35, a voter approved initiative
to use a portion of state tobacco excise taxes to fund prevention and cessation activities.
With the approval of the Board, the WCDPHE will renew the tobacco use prevention contract
with CDPHE. The funding is for one (1) additional year. The contract becomes effective July 1,
2021 and ends June 30, 2022. The budget amount for year -one is $300,056.00, all of which is
State funding. Activities will be conducted by current staff; no additional FTE is being requested.
Assistant County Attorney, Karin MacDougal, has reviewed this contract and determined that its
terms are acceptable.
The Board approved placement of this contract amendment on the Board's agenda via pass -around
dated June 11, 2021.
I recommend approval of this continuation contract for tobacco use prevention with CDPHE.

Brief description of the problem/issue:
For the Board's review and approval is contract amendment #1 between the Colorado Department of Public
Health and Environment (CDPHE) and the Board of County Commissioners of Weld County for the use and
benefit of the Weld County Department of Public Health and Environment (WCDPHE), for the Tobacco Use
Prevention & Cessation Education program.

What options exist for the Board? (include consequences, impacts, costs, etc. of options):
Approving and signing this contract will enable the continuation of various tobacco use prevention activities
aimed at youth prevention and cessation.
Declining this contract will result in the loss of $300,056.00 of state tobacco tax monies to be used for tobacco
use prevention and cessation activities within Weld County. Youth may begin using tobacco and other drugs as
a result of lost prevention activities; adults who want to quit may have less incentive or resources to quit.
Recommendation: I recommend approval of this continuation contract for tobacco use prevention with
CDPHE.

1. PARTIES
This Amendment (the "Amendment") to the Original Contract shown on the Signature and Cover
Page for this Amendment (the "Contract") is entered into by and between the Contractor, and the
State.
2. TERMINOLOGY
Except as specifically modified by this Amendment, all terms used in this Amendment that are
defined in the Contract shall be construed and interpreted in accordance with the Contract.
3. AMENDMENT EFFECTIVE DATE AND TERM
A. Amendment Effective Date
This Amendment shall not be valid or enforceable until the Amendment Effective Date
shown under the State Controller Signature. The State shall not be bound by any provision of
this Amendment before that Amendment Effective Date, and shall have no obligation to pay
Contractor for any Work performed or expense incurred under this Amendment either before
or after of the Amendment term shown in §3.B of this Amendment.
B. Amendment Term
The Parties' respective performances under this Amendment and the changes to the Contract
contained herein shall commence on the Amendment Effective Date shown under the State
Controller Signature or July 1, 2021, whichever is later, and shall terminate on the
termination of the Contract or June 30, 2022, whichever is earlier.
4. PURPOSE
The Parties entered into the agreement to This project serves to improve public health through
evidence -based, culturally responsive strategies that prevent, postpone, and treat chronic disease,
improve health promotion/prevention policy, transform health care delivery and integrate
community/clinical care prevention efforts during the state funding period through the
building/maintenance of comprehensive tobacco control programming efforts to benefit
communities in the entity's project area.
The Parties now desire to increase funding and change Statement of Work for the following
reason: To increase services as stipulated in the original contract.
5. MODIFICATIONS
The Contract and all prior amendments thereto, if any, are modified as follows:
A. The Contract Maximum Amount table is deleted and replaced with the Current Contract
Maximum Amount table shown on the Signature and Cover Page for this Amendment.
B. The Contract Initial Contract Expiration Date on the Contract's Signature and Cover Page
is hereby deleted and replaced with the Current Contract Expiration Date shown on the
Signature and Cover Page for this Amendment.
C. The Parties now agree to modify Exhibit, B, Statement of Work of the agreement. Exhibit,
B Statement of Work is deleted and replaced in its entirety with Exhibit B Statement of

6. LIMITS OF EFFECT AND ORDER OF PRECEDENCE
This Amendment is incorporated by reference into the Contract, and the Contract and all prior
amendments or other modifications to the Contract, if any, remain in full force and effect except
as specifically modified in this Amendment. Except for the Special Provisions contained in the
Contract, in the event of any conflict, inconsistency, variance, or contradiction between the
provisions of this Amendment and any of the provisions of the Contract or any prior modification
to the Contract, the provisions of this Amendment shall in all respects supersede, govern, and
control. The provisions of this Amendment shall only supersede, govern, and control over the
Special Provisions contained in the Contract to the extent that this Amendment specifically
modifies those Special Provisions.

STATEMENT OF WORK

These provisions are to be read and interpreted in conjunction with the provisions of the contract specified above.
I. Entity Name: Weld County Department of Public Health and Environment
II. Project Description:
This project serves to improve public health through evidence -based, culturally responsive strategies that
prevent, postpone, and treat chronic disease, improve health promotion/prevention policy, transform health
care delivery and integrate community/clinical care prevention efforts during the state funding period
through the building/maintenance of comprehensive tobacco control programming efforts to benefit
communities in the entity's project area.
The purpose of comprehensive tobacco control programs is to reduce disease, disability, and death related
to tobacco use. This will be accomplished through a multi -pronged approach: 1) Community education on
policies that influence tobacco use/reduce health disparities; 2) Authentic community engagement to create
community -specific tobacco prevention activities; 3) Promotion of culturally -tailored tobacco treatment
resources; 4) Education on survey data specific to tobacco priority populations; 5) Building/maintenance of
tobacco subject matter expertise at the entity; 6) Implementation of evidence -based tobacco program
interventions as identified in the CDPHE-provided local public health agency framework.
Tobacco use remains the most preventable cause of death, disability and disease in Colorado, killing more
than 5000 Coloradans each year. Tobacco use is higher among the following populations: 1) Adults with
lower income/education level; 2) Young adults age 18-24 who go to work rather than college; 3) Black/
African American and American Indian/Alaska Native adults; 4) Pregnant women who are on Medicaid;
5) Adults with mental health conditions; 6) LGBT youth/adults. In addition, health care and lost
productivity from tobacco use costs Colorado's economy $3.2 billion and taxpayers $692 per household
annually.
This project promotes tobacco community -based work as identified by the Tobacco Education, Prevention
and Cessation Program created by Colorado Revised Statutes 25-3.5-804 that supports funding for
community -based and statewide tobacco education programs designed to reduce initiation of tobacco use
by children/youth, promote cessation of tobacco use among youth/young adults, and reduce exposure to
secondhand smoke/vapor.

a. health/economic burden imposed by tobacco use

i. cost-effectiveness of clinical cessation interventions
ii. return on investment of clinical interventions
iii. importance of treating tobacco use as a chronic condition.
3. The Contractor shall provide education/technical assistance to:
a. maximize opportunities to screen for tobacco use
b. link tobacco users to evidence -based tobacco dependence
counseling/medications.
4. The Contractor shall work with health systems to support the reduction of
barriers to accessing cessation services by:
a. integrating treatment/referral processes into existing medical/social
care settings
b. promoting availability of low/no cost cessation benefits, including
those offered through the:
i. Colorado QuitLine
ii. Medicaid.
c. Where applicable, the Contractor shall support the adoption of
tobacco -free policies.

1. The content of electronic documents located on CDPHE and non-CDPHE
websites and information contained on CDPHE and non-CDPHE websites may
be updated periodically during the contract term. The Contractor shall monitor
documents and website content for updates and comply with all updates.
2. The Contractor shall follow the requirements in the CDPHE-provided local
public agency framework. This document is incorporated and made part of this
contract by reference and is available on the following website:

3. CDPHE will provide the local public health agency framework no later than
July 1, annually.
4. The Contractor shall prioritize low-SES/other priority populations as defined in
the CDPHE local public health framework in all work to reduce tobacco use in
settings such as:
a. schools
b. multi -unit housing
c. health care systems
d. social services settings
e. municipal settings
f. other settings as applicable

5. The Contractor shall, in all efforts to educate the community/policy makers
about tobacco control policies which reduce tobacco use, utilize a youth/adult

6. The Contractor shall not begin activities outlined in the implementation plan
until approved by CDPHE.
7. CDPHE will review the implementation plan within 21 business days.
8. The Contractor shall make any necessary modifications to the implementation
plan within 30 business days of notification by CDPHE.
9. CDPHE will approve the implementation plan within 21 business days of
submission.
10. The Contractor shall, at a minimum, annually, work with the following to
update the implementation plan:
a. CDPHE-approved Technical Assistance provider(s)
b. STEPP Point of Contact
11. The Contractor shall, based on activities identified in the implementation plan,
utilize CDPHE-approved technical assistance providers. This information is

20. CDPHE will, through CDPHE's Evaluation Contractor, aggregate data as part
of the macro -evaluation of the Tobacco Grants Program.
21. The Contractor shall use standardized survey tools available from CDPHE to
conduct the following assessments:

STEPP New Employee Orientation training within three (3) to six (6) months of
hire. This training is incorporated and made part of this contract by reference

V. Monitoring:
CDPHE's monitoring of this contract for compliance with performance requirements will be conducted
throughout the contract period by the STEPP Point of Contact. Methods used will include a review of
documentation determined by CDPHE to be reflective of performance to include progress reports and other
fiscal and programmatic documentation as applicable. The Contractor's performance will be evaluated at
set intervals and communicated to the contractor. A Final Contractor Performance Evaluation will be
conducted at the end of the life of the contract.
VI. Resolution of Non -Compliance:
The Contractor will be notified in writing within 15 calendar days of discovery of a compliance issue.
Within 30 calendar days of discovery, the Contractor and the State will collaborate, when appropriate, to
determine the action(s) necessary to rectify the compliance issue and determine when the action(s) must be
completed. The action(s) and timeline for completion will be documented in writing and agreed to by both
parties. If extenuating circumstances arise that requires an extension to the timeline, the Contractor must
email a request to the STEPP Point of Contact and receive approval for a new due date. The State will
oversee the completion/implementation of the action(s) to ensure timelines are met and the issue(s) is
resolved. If the Contractor demonstrates inaction or disregard for the agreed upon compliance resolution
plan, the State may exercise its rights under the provisions of this contract.
