The building under consideration is a cement block:stucco structure which was built in 1916 by the State of Colorado as an armory. Over the intervening years the building has been used by the Ault school district and some private enterprise. The Bison Breath was added to the original structure shortly after the end of WWII (1945) by the school district and was used as a shop and shower room for the athletic department. The VFW acquired the building from the school district in late 1951. as I understand it the cost was $1.00. As you can see the building has a lot of historical value but the condition of the structure is also dated. The main building is used by the VFW as a meeting hall. In addition the hall is rented out to anyone who wants to hold a large event. The VFW hall is one of the few places which is large enough for large events. This past year the rental income amounted to $3.250. In part the VFW continues to maintain the building as a service to the surrounding community. Activities that are held at the VFW include fund raisers for the Ault school athletic programs. fund raisers for individuals who have large medical bills, and families who need a place to hold memorial services for deceased family members. The VFW holds a raffle twice a year to support the building. More often then not the profit from one of those raffles does not pay the taxes. The daily cost to maintain and operate the building is approximately $75/day. Of that $5.87'day= are taxes. We are well aware that it is not the job of the assessor's office to evaluate the viability of any business when setting the valuation however the VFW is not a business, it is a service club which not only tries to assist veterans but the surrounding community. Looking back at the valuation of 2 years ago and the increase at that time the proposed valuation would be a 29.2% increase in the taxes for the VFW. We are aware that the housing market may justify this amount of increase but the VFW is not in the housing market. There have been no comparable sales for the past 4 or more years. The building and situation are just too unique. As such we feel that the land and the building should be classified in a different manner. It is our thoughts that the total assessment should be reset to $250,000 or at maximum of $300.000. The Bison Breath is a commercial portion of the VFW's holding. We lease this part of the structure. That lease brings in $9600/year to the VFW. The bar and restaurant are a part of our service organization even though we lease it out. Sincerely. Dave Sloan. (b)(I) The Assessor, the County Board of Equalization, or the Board of County Commissioners of the County, as applicable, shall, upon request made by the petitioner, provide to a petitioner who has filed an appeal with the Board of Assessment Appeals not more than ninety days after receipt of the petitioner's request, the following information: (A) The primary method used by the county to determine the value of the subject property; and (B) The rates used by the county to determine the value of the subject property under the method identified in accordance with subsection (5)(b)(l)(A) of this section. (II) The party providing the information to the petitioner pursuant to subparagraph (I) of this paragraph (b) shall redact all confidential information contained therein. (c) If a petitioner fails to provide the information required by subparagraph (I) of paragraph (a) of this subsection (5) by the deadline specified in subparagraph (II) of said paragraph (a), the County may move the Board of Assessment Appeals to compel disclosure and to issue appropriate sanctions for noncompliance with such order. The motion may be made directly by the County Attorney and shall be accompanied by a certification that the County Assessor or the County Board of Equalization has in good faith conferred or attempted to confer with such petitioner in an effort to obtain the information without action by the Board of Assessment Appeals. If an order compelling disclosure is issued under this paragraph (c) and the petitioner fails to comply with such order, the Board of Assessment Appeals may make such orders in regard to the noncompliance as are just and reasonable under the circumstances, including an order dismissing the action or the entry of a judgment by default against the petitioner. If you choose this option, the arbitrator's decision is final and you have no further right to appeal your current valuation. C.R.S. §39-8-108.5 governs this process. The arbitration process involves the following: a. Select an Arbitrator: You must notify the Board of Equalization within 30 days that you will pursue arbitration. You and the Board of Equalization will select an arbitrator from the official list of qualified people. If you cannot agree on an arbitrator, the District Court of the county in which the property is located (i.e. Weld) will select the arbitrator. b. Arbitration Hearing Procedure: Arbitration hearings are held within sixty (60) days from the date the arbitrator is selected, and are set by the arbitrator. Both you and the Board of Equalization are entitled to participate in the hearing. The hearing is informal. The arbitrator has the authority to issue subpoenas for witnesses, books, records documents and other evidence pertaining to the value of the property. The arbitrator also has the authority to administer oaths, and determine all questions of law and fact presented to him. The arbitration hearing may be confidential and closed to the public if you and the Board of Equalization agree. The arbitrator's decision must be delivered personally or by registered mail within ten (10) days of the arbitration hearing. c. Fees and Expenses: The arbitrator's fees and expenses are agreed upon by you and the Board of Equalization. In the case of residential real property, the fees may not exceed $150.00 per case. For cases other than residential real property, the arbitrator's total fees and expenses are agreed to by you and Board of Equalization, but are paid by the parties as ordered by the arbitrator.
