BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
MONDAY, OCTOBER 4, 2021
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, October 4, 2021, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:
Commissioner Steve Moreno, Chair
Commissioner Scott K. James, Pro-Tem
Commissioner Perry L. Buck
Commissioner Mike Freeman
Commissioner Lori Saine

MINUTES: Commissioner Saine moved to approve the Minutes of the Board of County
Commissioners meeting of September 20, 2021, as printed. Commissioner Buck seconded the motion,
and it carried unanimously.

PUBLIC INPUT: No public input was given.
El AMENDMENTS TO AGENDA: There were no amendments to the agenda.
ETJ CONSENT AGENDA: Commissioner James moved to approve the Consent Agenda, as printed.
Commissioner Freeman seconded the motion, and it carried unanimously.
COMMISSIONER COORDINATOR REPORTS: Commissioner James stated the Colorado
Department of Transportation's Greenhouse Rulemaking initiative is continuing and Weld County offered
testimony. Commissioner Saine mentioned after a lengthy community meeting with Green Acres, the
community clean up went well in Brighton, Colorado, over the weekend. Commissioner Buck stated the
Department of Human Services has approved $5,600,000.00 and 2,500 Emergency Rental Assistance
applications, the Friendly Fork Program is reducing their frozen meals from two meals a week to one
meal a week, with intentions of stopping this program by the end of this year, and Desiree Rodriguez is
the newly certified Ombudsman for Weld County. Commissioner Buck further stated she recently toured
the Al Organics facility, she attended a lunch with Governor Polis, who shared his tax plan and
employment initiative, she joined in the Walk to End Alzheimers that took place at Lincoln Park in
downtown Greeley, and she too attended the community clean-up in Brighton, Colorado. Chair Moreno

commented on the success of the Emergency Preparedness Training held last week and expressed that
while convenient to hold the training in Weld County, there is evident benefit to hosting the training outside
of Weld County to afford people the opportunity to be fully immersed in the subject material without
distraction. Commissioner Buck echoed his sentiments.
e PRESENTATIONS:
1) RECOGNITION OF SERVICES, DEPARTMENT OF PUBLIC WORKS — MIKE HANNA: Chair Moreno
read the certificate for the record. Jay McDonald, Director of the Department of Public Works, introduced
Mike Livengood, direct supervisor of Mike Hanna, who shared fond memories of their time working
together over the last 20 years, as well as his appreciation for Mr. Hanna's dedication during his tenure.
Each of the Commissioners, in turn, congratulated Mr. Hannah on his retirement and thanked him for his
commitment to Weld County. (Clerk's Note: The group gathered for a photo opportunity.)
PROCLAMATIONS:
1) WELD COUNTY LONG-TERM CARE RESIDENTS' RIGHTS MONTH - OCTOBER 2021:
Chair Moreno read the proclamation for the record. Jaime Ulrich, Director of the Department of Human
Services, explained the proclamation recognizes the dignity, respect, and rights of each resident living in
long-term care communities and this years' theme is, "Reclaiming My Rights, My Home, My Life." She
expanded the Weld County and Larimer County Ombudsman Programs coordinated a resident art
contest and introduced Jon Davis, resident of Aladin Assisted Living in Keenesburg, Colorado, stating
his artwork will be displayed on yard signs at every long-term care facility in Weld County.
Raegan Maldonado and Desiree Rodriguez, Department of Human Services, along with a Larimer
County Ombudsman representative, displayed the yard sign and artwork of Mr. Davis and presented him
with a plaque of recognition. Mr. Davis thanked the Board for their recognition. Each of the
Commissioners congratulated Mr. Davis on his artwork and expressed their support for the rights and
freedoms of long-term care residents. (Clerk's Note: The group gathered for a photo opportunity.)
WARRANTS:
1) GENERAL WARRANTS - SEPTEMBER 30, 2021, AND OCTOBER 1, 2021: Commissioner Buck
moved to approve the General Warrants, as printed. Commissioner Saine seconded the motion, and it
carried unanimously.
2) GREELEY-WELD COUNTY AIRPORT AUTHORITY WARRANTS - OCTOBER 1, 2021:
Commissioner Freeman moved to approve the Greeley -Weld County Airport Authority Warrants, as
printed. Commissioner James seconded the motion, and upon a roll call vote, the motion passed four (4)
to one (1), with Commissioner Saine opposed.
NEW BUSINESS:
1) CONSIDER CONTRACT ID #5258 PROFESSIONAL SERVICE AGREEMENT FOR ELEVATOR
MAINTENANCE AND AUTHORIZE CHAIR TO SIGN - KONE, INC.: Toby Taylor, Director of the
Facilities Department, stated a bid for elevator maintenance was previously awarded to Peak Elevators,
LLC, who is now being considered for contract renewal; however, over the past year, 21 out of 24
elevators did not pass annual inspections by the third -party inspector. Mr. Taylor further stated the
department is not recommending renewal of the contract with Peak Elevators, LLC, rather, he
reommends pursuing a Communities Agreement through Cooperative Purchasing pursuant to
Section 5-4-100 of the Weld County Code, with said award granted to KONE, Inc., for $3,282.00 per
month. In response to Chair Moreno, Mr. Taylor confirmed the agreement is for every elevator in the
County, excluding the elevator in the Chase Building because it is currently under a property
management contract. Commissioner Freeman moved to approve said agreement and authorize the
Chair to sign. The motion was seconded by Commissioner Buck and it carried unanimously.

• 2) CONSIDER CONTRACT ID #5272 FUNDS DEPOSIT AGREEMENT AND COST AGREEMENT
FOR AULT GRADER SHED, AND AUTHORIZE CHAIR TO SIGN — TOWN OF AULT: Mr. Taylor
explained the County recently purchase property within Ault Town limits to construct a grader shed and
these agreements allow the County to submit the necessary application to the Town's Planning
Department and pay the associated fees of $5,000.00. Commissioner James moved to approve said
agreements and authorize the Chair to sign. Seconded by Commissioner Buck, the motion carried
unanimously.
• 3) CONSIDER TEMPORARY CLOSURE OF CR 63 BETWEEN CRS 66 AND 68: Amy Mutchie,
Department of Public Works, requested closure of County Road 63 from October 11, 2021, to October 15,
2021, to enlarge and replace an irrigation culvert, and stated water will be used for dust control as
necessary. Commissioner Freeman moved to approve said temporary road closure. The motion, which
was seconded by Commissioner Buck, carried unanimously.
El 4) STATEMENT OF SUPPORT FOR WELD PROJECT CONNECT: Commissioner James, Chair
of Project Connect, introduced Margie Martinez, United Way of Weld County, who explained the wide
array of services provided to vulnerable popluations within Weld County at a one -day event held at the
Island Grove Event Center. She stated nearly 1,000 people participated in 2020, 800 people participated
in 2019, and she thanked the Board of County Commissioners and the City of Greeley for their help and
collaboration. Each of the Commissioners spoke to the monumental coordination and effort that goes into
organizing this event and the positive impact it has on the community. Commissioner Buck moved to
approve said Resolution. Commissioner Saine seconded the motion and it carried unanimously.
El PLANNING:
1) CONSIDER PARTIAL VACATION OF FOUR -LOT RECORDED EXEMPTION, RECX19-0093, FOR
REMOVAL OF LOT D - PAWNEE RANCH, LLC, C/O MICHAEL MCCRERY AND MARVIN BARSTOW:
Diana Aungst, Department of Planning Services, presented the request of Michael McCrery and
Marvin Barstow, managers of Pawnee Ranch, LLC, to vacate Lot D of Recorded Exemption,
RECX19-0093. She stated no easements were created by the plat, the resulting parcel will be larger than
35 acres in size, and Lots A, B, and C, which access off of County Road 53, are owned by
CMH Homes, Inc., and are not a part of this request. Ms. Aungst presented staff's recommendation for
approval and reviewed the site location via a PowerPoint presentation. No public testimony was offered
concerning this matter. The motion to approve said partial vacation was made by Commissioner James,
seconded by Commissioner Buck, and it carried unanimously.

are owned by CMH Homes, Inc., who is not a part of this request. She reviewed the site location via a
PowerPoint presentation and presented staff's recommendation for approval. No public testimony was
offered concerning this matter. The motion to approve said partial vacation was made by Commissioner
James, seconded by Commissioner Saine, and it carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board.
