AM..,..—� . 6QQ w $n<. .m.....-.__1®O4"pp�`JO_..._.�__.__....Ann 5pomor, lteco-dec RESOLUTION / `i WHEREAS, pursuant to law Weld County, Colorado, has obtained ‘4.-) possession and ownership of certain improvements (Bearly Alfalfa C Milling Co. ) located on the Union Pacific Railroad right of way at Fort Lupton, Colorado, by virtue of a Treasurer's Deed No. 2664, recorded October 20, 1972 under Reception No. 1600016, Weld County Records, and L,I W1 WHEREAS, the Board has determined that such improvements on in said railroad right of way have no monetary value and are of no °' functional or economic use to Weld County, and a 0 WHEREAS, Union Pacific Railroad Company is desirous that said improvements be removed from its right of way, and - WHEREAS, the Town of Fort Lupton, Colorado, has requested permission to remove such improvements off the said railroad right of way at no cost to Weld County. NOW, THEREFORE, BE IT RESOLVED that the Board be, and it hereby is authorized to execute a Bill of Sale to the Town of Fort Lupton, Fort Lupton, Colorado, quitclaiming any and all interest that Weld County may have to said improvements (Bearly Alfalfa Milling Co. ) located on the Union Pacific Railroad right of way at Fort Lupton, Colorado. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 3rd day of January, 1973. Billings, Chairman Commissioners of Weld County Weld County Court House Greeley, Colorado Dear Mr. Billings: The City of Fort Lupton has contacted the Union Pacific Railroad Company on the dilopidated buildings on their right— a—way just north of 9th Street, once the operation of Bearley Milling Company, We have been advised that these buildings are now the property of Weld County. We are sending a copy o£ this letter to Mr. James of U.P.R.R. Co. and would like to have permission from each of you to remove the buildings and debris, for the material, which some can be used to riprap our sewer lagoons.
