M., WELD COUNTY, COLORADO: or nr A, BE IT RESOLVED, by the Board of County Commissioners of If\ Weld County, Colorado that they do hereby order that the attached document °i be recorded. a c� The above and foregoing resolution was, on motion duly made and seconded, adopted by the following vote: ga J� � �r AYES: a XL c/eatii dc an,a Ain Qt.,,fLii,a THE BSS CO COMMISSION WELD COUNTY, COLORADO DATED: APRIL 11, 1973 �-�� - 0J / 730969 r - -' t _17 OWL f 689 imvn37 GRANT OF EASEMENT AND RIGHT-OF-WAY d -. 2- KNOW ALL MEN BY THESE PRESENTS: That, WESTERN SLOPE GAS COMPANY, a Colorado corporation, whose address is 550 15th Street, Denver, Colorado, for the sum of ONE DOLLAR ($1.00) in hand paid and for other valuable consideration, does hereby grant, bargain, sell and convey to WELD COUNTY, COLORADO, a permanent easement and right- of-way for the installation, construction, repair, maintenance and reconstruction of a road and appurtenances thereto, together with all rights and privileges as are necessary or incidental to the rea- sonable and proper use of such easement and right-of-way, in and to, over, under and across the following described real property, situate in the County of Weld, State of Colorado, to-wit: A parcel of land along the East line of the North Half (N'1) of Section 16, Township 5 North, Range 66 West of the 6th P.M., more particularly described as follows: Beginning at the NE corner of said Section 16, said point being the True Point of Be- ginning; thence South along the East line of said Section 16, 330 feet; thence West parallel with the North line of said Section 16, 40 feet; thence North parallel with the East line of said Section 16, 330 feet to the North line of said Section 16; thence East along the North line of said Section 16, 40 feet to point of beginning. AND, Grantor, for itself and for its successors and assigns, does hereby covenant and agree that no permanent structures or improvements shall be placed on said easement and right-of-way by it or its successors or assigns, provided however Grantor reserves the right to place utility facilities in said easement which do not interfere with its use as a road. In the event this easement is no longer used for road purposes, all rights herein shall revert to the Grantor, its successors and assigns. The easement herein granted is subject to the lien of the Grantor's Inden- ture, and to its termination by the Indenture Trustee upon the occurrence of an event of default under the Indenture.
