RESOLUTION
WHEREAS, pursuant to law, the Board of County Commissioners,
Weld County, Colorado, is vested with the responsibility of administering
the affairs of Weld County, Colorado, and
WHEREAS, it has come to the attention of the Board that the
Larimer-Weld Area Agency on Aging has been formed to serve, unite
and coordinate area wide service delivery to older Americans including
the establishment of multi-purpose senior citizen centers, and additionally
to serve as a conduit for Federal funding of the agency, and
WHEREAS, the Board feels it to be in the best interest of the
County, as a member of C, O. G. , to approve this agency as a worthwhile
project for its senior citizens, and
WHEREAS, the Larimer-Weld Area Agency on Aging has presented
a set of proposed By-Laws therefor, and
WHEREAS, the Board has studied said proposed I3 -Laws of the
Larimer-Weld Area Agency on Aging and has determined that it would he
in the best interest of the County to approve the same.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that the ray-I_,aws of the Larimer-
Weld Area Agency on Aging, copy attached hereto and made a part hereof
by reference, be, and they hereby are approved as to form.
The above and foregoing Resolution was, on motion duly made and

RESOLUTION
WHEREAS, pursuant to law, the Board of County Commissioners,
Weld County, Colorado, is vested with the responsibility of administering
the affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board that there is a
need to purchase chips for application to county roads for the 1974 season,
and
WHEREAS, the Board believes it to be in the best interest of the
county to seek bids for the Board's approval relative to the purchase of
chips to be used on county roads for the 1974 season.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that Mr. Barton Buss, Chief
Accounting Officer for Weld County, advertise for bids to purchase the
aforementioned chips for use on Weld County roads for the 1974 season,
BE IT FURTHER RESOLVED, that the Board be, and it hereby is
authorized to execute an agreement with the sucessful bidder for the
purchase of the aforementioned chips and to make the same effective
forthwith,

WHEREAS, the Good Americans Organization dba GAO whose
address is two miles North of Brighton on Old U. S. Highway 85,
Brighton, Colorado, have filed their application for a liquor license
to sell malt, vinous and spirituous liquors by the drink only at the
above location, and
WHEREAS, the Good Americans Organization has exhibited a
State Liquor License issued by the Secretary of State, together with
receipt to-wit for the payment of federal taxes thereon, and

RESOLUTION
RE: ESTABLISHMENT OF URBAN AREA BOUNDARIES FOR GREELEY,
COLORADO.
WHEREAS, pursuant to law, the Board of County Commissioners,
Weld County, Colorado, is vested with the responsibility of administering;
the affairs of Weld County, Colorado, and
WHEREAS, pursuant to the 1973 Federal-Aid Highway Act, the
procedure for establishing boundaries for urban areas of ove r 5000
population has been modified, and
WHEREAS, the Board has determined that it would be desirous
and in the best interest of the County to properly define and establish the
City of Greeley, Colorado urban area, thus providing increased flex-
ibility to various federally aided highway programs having direct
reference to said urban area, and
WHEREAS, in accordance with the newly modified procedure the
City of Greeley, Colorado urban area has been determined to have a
population of 41, 680, more or less, per Bureau of Census figures, all
as shown within the designated boundaries of the City of Greeley and its
urban boundaries, per copy of map marked "Exhibit A" and made a part
hereof by reference.
NOW, THEREFORE, I3E IT RESOLVED, by the Hoard of County
Commissioners, Weld County, Colorado, that the urban area boundary
map of the City of Greeley, Colorado urban area hereinabove referred
to as Exhibit A, be, and the same is hereby approved.

FINDINGS AND RESOLUTION
CONCERNING CHANGE OF ZONE
PETITION OF DACAPO DEVELOPMENT COMPANY
The petition of Dacapo Development Company, P. O. Box 219,
Dacono, Colorado, requesting a change of zone from "A" Agricultural
District to "E" Estates District - Planned Unit Development, of a
parcel of land more particularly described as follows, to-wit:
That portion of Section 7, Township 2 North, Range 67
West of the 6th P. M. , Weld County, Colorado, lying
East on the Union Pacific Railroad, more particularly
described as follows:
Beginning at the Southeast Corner of said Section 7 and
considering the South line thereof to bear South 89°
23' 29" West;
Thence along the South line of said Section South 89° 23'
29" West 2, 621. 21 feet to the South Quarter Corner of
said Section; thence continuing along said South line
South 89° 23' 29" West 2, 129. 25 feet to the Easterly
right-of-way line of the Union Pacific Railroad as
described in Deeds recorded in Reception Numbers
154750 and 142117, Records of said County, as further
evidenced by existing right-of-way fences in the field.
Thence along said Easterly right-of-way line the
following courses: North 0° 55' 26" West 632. 01 feet
to the beginning of a tangent curve concave to the South-

came on for hearing on October 23, 1973, and the Board of County
Commissioners of the County of eld, State of Colorado, having heard
the testimony and evidence adduced upon said hearing and having con-
sidered the testimony, evidence and recommendations of the Weld County
Planning Commission filed with said Board, and having carefully weighed
the same, now makes the following findings:
1. The evidence discloses that the applicant failed to sustain
the burden of proof as to the need for a change of zone or that the present
zone is erroneous or that circumstances warrant a change of zone at
this time.

2, The evidence and investigation show that the inhabitants of the
immediate vicinity of the area sought to be rezoned are unanimously
opposed to the change of zone.
3. The evidence discloses that the present zoning is complementary
to the surrounding area, and that rezoning of subject land would not be
compatible with the surrounding land use and not in conformity with the
Weld County Comprehensive Plan.
4. Rezoning of subject land would constitute spot zoning and that
as such it would not be consistent with the Weld County Development
policy and its comprehensive plan.
5. The proposed land unit development does not conform to
Sectian 106-2-37, CRS 1963, as amended, (HB 1553) as the Weld County
Health Department is on record as stating that it will not approve con-
ventional septic tanks or evaporation systems for this area and will require
a central sewage treatment facility.
6. The proposed planned unit development does not conform to
Section 92-36-5(1) CRS, 1963, as amended, (HB 1529), as both the
geological report submitted by the applicant (pp 1, 3) and a preliminary
review by the Colorado Geological Survey reveals that the area proposed
for rezoning is underlain by coal beds.
7. The evidence and investigation show that there is a need for
further study and development of a comprehensive plan for the greater
tri-town area of Dacono, Frederick and Firestone, and therefore, any
rezoning of subject property at this time would be premature and not in
the interest of good planning.
8. That each of the preceding findings in and of themselves and
independent of each other constitutes a separate and individual ground for
denial of the change of zone.
RESOLUTION
WHEREAS, the Board of County Commissioners of the County of
Weld, State of Colorado, has heard the application of Dacapo Development
Company, P. O. Box 219, Dacono, Colorado, for change of zone from "A"
Agricultural District to "E" Estates District - Planned Unit Development,
of a parcel of land as hereinabove recited and made a part hereof by
reference, and
WHEREAS, said Board has made its findings on the evidence and
testimony submitted to it, which findings precede this Resolution and by
reference are incorporated herein and made a part hereof, and
WHEREAS, the said Board has carefully considered the petition,
evidence and testimony and the recommendations of the Weld County
Planning Commission and has given the same such weight as it in its
discretion deems proper, and is now fully advised in the premises.

NOW, THEREFORE, BE IT RESOLVED, that the petition of
Dacapo Development Company, P. O. Box 219, Dacono, Colorado,
requesting a change of zone from "A" Agricultural District to "E"

forth in the Board's findings therein.

RESOLUTION
WHEREAS, it has been determined by the Board of County
Commissioners , Weld County, Colorado, that a proposed sale of a
tract of land more particularly described as follows , to-wit :
A triangular parcel of land situate in the West Half of
the Southwest Quarter of Section 13 , Township 4 North ,
Range 66 West of the 6th P.M. , Weld County, Colorado ,
and more particularly described as follows : Commencing
on the West side of said property at a point in the North
bank of the Western Mutual Ditch ; thence running North
in the West section line 260 feet ; thence East 125 feet
to a point on the North bank of. the Western Mutual Ditch;
thence running Southwesterly along the North bank of said
Western Mutual Ditch 290 feet more or less to the point
of beginning .
by Edward J. Jerke and Ethel E. Jerke does not come within the
purview of the definition of the terms "subdivision" and "subdivided
lands" as set forth in CRS 106-2-33 (a) and (b) 1963 , as amended,
and
WHEREAS, the Board of County Commissioners of the County
of Weld, State of Colorado, desires to exempt this particular
division of land upon the recommendation of the Weld County Planning
Director for the reasons as stated and pursuant to its authority
under CRS 106-2-33 (d) , 1963 , as amended,
NOW, THEREFORE, BE IT RESOLVED, that the proposed sale of
the hereinabove described tract of land by Edward J. Jerke and
Ethel E. Jerke be exempted from the definition of the terms
"subdivision" and "subdivided lands" as provided for in the new

RESOLUTION
RE: CONSERVATION OF ENERGY IN WELD COUNTY, COLORADO.
WHEREAS, pursuant to law, the Board of County Commissioners,
Weld County, Colorado, is vested with the responsibility of administer-
ing the affairs of Weld County, Colorado, and
WHEREAS, pursuant to announcement and directive by the President
of the United States of America requesting voluntary cooperation by all
of the states and their political subdivisions to conserve all forms of
energy wherever possible, and
WHEREAS, the Board has determined that it would be in the best
interest of the County to recognize the seriousness of the problem of
energy shortage in the United States, in Colorado, and in Weld County,
and to effect compliance with the presidential guidelines and policies
as announced.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that until further order of
the Board, the following rules and regulations shall prevail in Weld
County and shall be strictly obeyed and abided by, to-wit:
1. That all County owned vehicles shall not be driven at
speeds in excess of those which may be set by state
statute, or otherwise determined to be in the best in-
terest of energy conservation.
2. That all County maintenance personnel are hereby
directed to set thermostats throughout County owned
and/or County controlled buildings at such tempera-
tures and in such manner as to maximize energy
efficiency, minimize energy consumption, and elimi-
nate wherever possible unnecessary or wasteful use
of energy supplies while maintaining reasonable work-
ing conditions.
3. That all janitorial services performed by County
personnel in County owned and/or County controlled
buildings shall be during regular office hours in
order to conserve rapidly dwindling existing energy
resources.
The above and foregoing Resolution was, on motion duly made and

WHEREAS, pursuant to law, the Board of County Commissioners,
Weld County, Colorado, is vested with the responsibility of administering
the affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board that there is a
need to purchase complete liability, fire and extended coverage insurance
for all County owned real and personal property for the year 1974 under
the most reasonable terms and conditions, and
WHEREAS, the Board believes it to be in the best interest of the
County to seek bids for the Board's approval relative to the purchase of
the aforementioned insurance in accordance with bid specifications and/or
schedules.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that Mr. Barton Buss, Chief
Accounting Officer and Purchasing Agent for Weld County, advertise for
bids or proposals to purchase the aforementioned insurance coverage in
accordance with bid specifications and/or schedules, all as shown on
exhibit attached hereto and made a part hereof by reference.
BE IT FURTHER RESOLVED, that the Board be, and it hereby is
authorized, to execute an agreement with the successful bidder for the
aforementioned insurance coverage on all of the County owned real and
personal property for the year 1974.

RESOLUTION
RE: AGREEMENT BETWEEN WELD COUNTY AND POUDRE VALLEY
RURAL ELECTRIC ASSOCIATION (R. E. A. ) FOR ELECTRIC
POWER SERVICE TO THE FORMER ATLAS MISSILE SITE WEST
OF GREELEY, COLORADO.
WHEREAS, pursuant to law, the Board of County Commissioners,
Weld County, Colorado, is vested with the responsibility of administering
the affairs of Weld County, Colorado, and
WHEREAS, Weld County is the owner of the former Atlas Missile
site west of Greeley, Colorado, and
WHEREAS, the Board has determined to develop said former Atlas
Missile Site as a county park and recreational area and is desirous of
obtaining electric power service thereto, and
WHEREAS, Poudre Valley Rural Electric Association (R. E. A. )
has submitted an agreement providing for the necessary electric power
service to said former Atlas Missile Site, and
WHEREAS, the Board believes it to be in the best interest of the
County to enter into such agreement on the basis recited therein.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that said agreement with
Poudre Valley Rural Electric Association (R. E. A. ) providing for electric
power service to the former Atlas Missile Site west of Greeley, Colorado,
copy attached hereto and made a part hereof by reference, be, and it
hereby is approved.
BE IT FURTHER RESOLVED, that the I3oard be, and it hereby
is authorized to execute the agreement as submitted and to make the same
effective forthwith.
BE IT STILL FURTHER RESOLVED, that the Board, be, and it
hereby is authorized to execute an easement providing the necessary
right-of-way to Poudre Valley Rural Electric Association (R. E. A. ) for
the necessary power lines to run parallel with the access road leading to
the aforementioned former Atlas Missile Site.
The above and foregoing Resolution was, on motion duly made and

The undersigned(hereinafter called the"Applicant'hereby applies for electric service from Poudre Valley Rural Electric Association,Inc.,
(hereinafter called the"Association")upon the following terms and conditions
1. GENERAL
a. The.applicant will,when electric energy becomes available,purchase from th Association c!!electric energy used on the pram Ises described
below and will pay therefore at the applicable rates and terms in accordance,ovith the"Schedule of Rates for Electricity and Rules and
Regulations" (hereinafter called the"Rules and Regulations") as may from time to time be filed with the Public Utilities Commission of
the State of Colorado. This contract shall continue in force for a minimum of five years from the date service is made available hereunder
and thereafter until the contract expiration date if for a period greater than five years and/or thereafter until cancelled by at least thirty
(301 days written notice given by either party to the other,
b. The minimum monthly or annual charge for electric service,regardless of the kilowatt hours consumed,shall be the higher of the following
cherges;
1) The minimum specified in the applicable rate schedule,or
2) One percent(1%)of theconstruction cost per month or twelve percent 112%) of the construction cost annually,based upon the actual
necessary cost of constructing and installing the line extension and facilities necessary to supply the service,or

_. No agent or representative of the Association has the power to amend,modify, eitlr or waive any of the provisions of the terms of this
cnntr3Ct, any promises,agreements,or representations made by any agent or representative of the Association not herein set forth shall
be void and of no effect.
d. Acceptance of this contract by the Association shall constitute a binding agreement between the Applicant and the Association. Thls
contract will not alter the terms of any other contract between the Applicant and the Association,
2. RESPONSIBILITY
a. The Applicant will sign a separate Application for Service on the form provided and will comply with the Rules and Regulations of the
Association,
b, Failure on the parr of the Applicant to accept service from the Asso,irltion, to comply with the Rules and Regulations of tie Association
or to carry out the terms and conditions of this contract, shall not relieve the Applicant from the payments and conditions set forth
this contract,
c. The applicant agrees that indebtedness incurred under this contract shall be considered as a lien against the reel estate described below and
may be enforced by foreclosure thereof. The Association may record this instrument in the office of the County Clerk and P,ecordet Ir.
the County in which the real estate is situated.
d. This agreement shall be binding upon the successors,legal representatives,heirs,devisees,and auigns of the respective parties hereto.
e, The Association shall use reesonable diligence to provide the Applicant with a constant and uninterrupted supply of electric power and
energy;but if such supply shall fail or be interrupted or become defective through act of God,or the public enemy,cr by accident,strikes,
labor troubles,or by action of elements or inability to secure rights-of-way,or other permits needed,or any other cause beyond reasonable
control of the Association,the Association shall not be liable therefore.
3. RIGHTS-OF-WAY
t. The Applicant hereby grants and conveys unto the Association die right, privilege and easement to construct, cperate and hraintalt,
together with right of ingress and egress, transmission or distribution lines and appurtenances,either overhead and/or underground over
and across lend of the Applicant, as may be necessary or convenient to the extension of service and agrees,upon request,to execute the
Association's Standard Right-of-Way Easement granting suitable easement,at no expense therefore,
t, The Applicant hereby glyos to the Association without cost or expense,the further right and privilege to slit and bin',any tree nr shrub-
bery near said overhead lines supplying the Applicant,so that adequate and proper service may be extended hereunder,
e. The Applicant further agrees to assist In obtaining needed rights.of-way that may be required to provide service hereunder.
d, The Applicant agrees to Indemnify the Association against loss or damage to underground property of the Applicant of to underground
property of others on the Applicants property. The Association will use reasonable care in locating and digging hole;or trenches for poles,
anchors or underground service but will not be responsible for damage to sewers,water lines or other underground facilities if the exact
location of such underground property can not be determined before construction begins.
4 CONTRACT PROVISIONS
a. Service will be rendered at the Association's standard voltage. The Association's meter shall constitute the point of delivery to the Appli-
cant and the Applicant will own and maintain all poles,wires,equipment and other facilities beyond the point of delivery,

After investigation and pursuant to Order and Notice heretofore
issued and served on or before September 24, 1973, to show cause why
the above-numbered Certificate of License should not be suspended or
revoked, public hearing was held in the office of the Board of County
Commissioners of Weld County, sitting as the Weld County Licensing
Authority, on Wednesday, the 17th day of October, 1973, and the Board
of County Commissioners of Weld County, Colorado, sitting as the Weld
County Licensing Authority, having heard the testimony and evidence
adduced upon said hearing and having considered the testimony and
evidence filed with said Board, and having carefully weighed the same,
now makes the following findings:
1. The above-named licensee did violate the provisions of the
Solid Waste Disposal Sites and Facilities Act, 1967, Permanent Cumula-
tive Supplement to CRS 36-23-10,as amended, in the following particulars,
to-wit:
1. Failure to properly cover waste material.
2. Failure to comply with water pollution control.
3. Failure to comply with air pollution laws.
4. Other violations contrary to the provisions of Paragraphs
(e) and (g) of the hereinabove mentioned act.
NOW, THEREFORE, in consideration of the foregoing, and pursuant
to authority of law, the Board of County Commissioners of Weld County,
as the Weld County Licensing Authority, hereby finds the respondent, Paul
E. McClure, in violation of the law as aforesaid.
BE IT FURTHER RESOLVED, and it hereby is ordered that the
respondent shall have a period of six (6) months from January 1, 1974,
to bring the operation of said waste disposal site in compliance with the
provisions of the hereinabove mentioned statutes as amended; otherwise,
the Board shall have no alternative but to revoke said certificate of license
#17 and order the same to be returned for cancellation.

WHEREAS, it has been determined by the Board of County
Commissioners, Weld County, Colorado, that a proposed sale of a
tract of land more particularly described as follows, to-wit:
A parcel of land located in the Southeast Quarter of the
Southwest Quarter of the Northeast Quarter (SE4SW4NE4)
of Section Twenty-Eight (28), Township Two (2) North,
Range Sixty-Eight (68) West of the Sixth P. M. , Weld

RESOLUTION
WHEREAS, pursuant to law, the Board of County Commissioners,
Weld County, Colorado, is vested with the responsibility of administering
the affairs of Weld County, Colorado, and
WHEREAS, the Board has determined that there is a need to
re-wire the Weld County Courthouse building, Greeley, Colorado, and
WHEREAS, the Board believes it to be in the best interest of the
County to seek bids for the Board's approval relative to the re-wiring of
said Weld County Courthouse building in accordance with electric code
standards that meet and comply with the City of Greeley and the state
electric code requirements.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that Mr. Barton Buss, Chief
Accounting Officer and Purchasing Agent for Weld County, advertise for
bids to completely re-wire the Weld County Courthouse building in
accordance with submitted specifications that meet and comply with the
City of Greeley and the State of Colorado electric code requirements, all
as shown on exhibit attached hereto and made a part hereof by reference.
BE IT FURTHER RESOLVED, that alt bids shall specify that all
such re-wiring work shall be in accordance with specifications as submitted.
BE IT STILL FURTHER RESOLVED, that the Board be, and it
hereby is authorized to execute an agreement forthwith with the successful
bidder for the re-wiring of the Weld County Courthouse as hereinabove
mentioned, and that the Board be authorized to pay therefor immediately
upon completion of the work project.

WHEREAS, due to the death of Ann Spomer, Clerk and Recorder of
Weld County, Colorado, on December 19, 1973, a vacancy now exists in
said office and it is necessary for the Board of County Commissioners
of Weld County, Colorado, to appoint a Clerk and Recorder to complete
the term of office, and

WHEREAS, the term of Ann Spomer as Weld County Clerk and Recorder
(;; will expire on January 14, 1975, and inasmuch as there had been no pro-
vision made within said office for any deputy to serve in her place as in

WHEREAS, Wattenberg Improvement Association, Inc . of

WHEREAS, the applicant , having tendered to the County

County Commissioners , Meld County, Colorado, having examined
II the said application and the other qualifications of the
applicant , does hereby grant License Number 74- 15 to said
applicant to sell Malt, Vinous , FT Spirituous liquor only at
retail at said place , and does hereby authorize and direct the
issuance of said license by the Chairman of the Board, attested
to by the County Clerk and Recorder of Weld County, good for
December 31 , 1973 9 : 00 p .m. until January 1 , 1974 1 : 00 a.m.
unless sooner revoked, according to law provided, however, that
said license shall be issued upon the express condition and
agreement that the place where said licensee is authorized to
sell Malt , Vinous , $ Spirituous liquor under said license will
be conducted in strict conformity to all laws of the State of
Colorado and rules and regulations relating thereto heretofore
passed by the Board of County Commissioners of Weld County,
and any violation or violations thereof will be cause for
revocation of the license.

that the revenue , other than property taxes , have exceeded the estimated

which could not have been reasonably foreseen at the time of the
adoption of the budget , and ,
WHEREAS , by Colorado Revised Statutes , 1963 Chapter 39- 1

WHEREAS, a public hearing was held on April 30, 1973, in the
chambers of the Board of County Commissioners, Weld County,
Colorado, for the purpose of hearing the petition of Lochbuie Develop-
ment, c/o Gordon McLain, Route 1-0100, Brighton, Colorado,
requesting approval of site for a sewage treatment facility on the following
described property, to-wit:
A tract of land located in the NW-14 of Section 31, Township
1 North, Range 65 West of the 6th P. M. , Weld County,
Colorado, and more particularly described as being
approximately the South 1600 feet of the following described
parcel, to-wit:
Beginning at the North 4 Corner of said Section, thence,
South 272 feet, thence South 36° 19' East, 627 feet,
thence South 51° 51' West, 232 feet, thence South 22° 31 '

WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present; has studied the request of
the petitioner; and studied the recommendations of the Weld County Planning
Commission, and
WHEREAS, the said Board has carefully considered the petition,
evidence, testimony, petitions and remonstrances and given the same
such weight as it, in its discretion, deems proper, and is now fully
advised in the premises;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the application of Lochbuie Development, c/o
Gordon McLain, Route 1-0100, Brighton, Colorado, for site approval
to locate a sewage treatment facility on the premises indicated above, be,
and it hereby is granted under the conditions following:

granted,
3. That all applicable subdivision regulations and zoning
regulations shall be followed and complied with in accordance with the
Zoning Resolutions of Weld County, Colorado.

WHEREAS, it has been determined by the Board that there is a
need to purchase 1, 000 abstract of assessment books for the use of the
Weld County Assessor's Office, and
WHEREAS, the Board believes it to be in the best interest of the
County to seek bids for the Board's approval relative to the purchase of
the aforementioned abstract of assessment books as desired by the Weld
County Assessor's Office.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that Mr. Barton Buss, Chief
Accounting Officer of Weld County, advertise for bids to purchase the

RESOLUTION
WHEREAS, the people of Weld County, State of Colorado, are
saddened by the sudden death of Ann Spomer, Weld County Clerk and
Recorder, and
WHEREAS, Ann Spomer's standards of excellency as County Clerk
and Recorder of Weld County and her services to the Colorado
Association of County Clerks and Recorders and as past president of
the National Association of Recorders and Clerks and as the current
president of the International Association of Clerks, Recorders,
Election Officials and Treasurers has brought national recognition
both to Ann Spomer and to Weld County, and
WHEREAS, Ann Spomer has gained the love, respect and admiration
of the people of Weld County through her great devotion to her office
as Weld County Clerk and Recorder.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners,
Weld County, Colorado, that by the death of Ann Spomer, Weld County has
lost one of its outstanding citizens and it does hereby pay tribute to a
woman of great ability and high integrity, who has well served not only
Weld County but also on the State and National level, and does extend
heartfelt sympathy to the members of her family.

RESOLUTION
WHEREAS, heretofore the Board of County Commissioners , Weld County,
Colorado, by resolution, created an account entitled PUBLIC WORKS FUND,
HOSPITAL BUILDING, in the office of the Weld County Treasurer, and
WHEREAS, it has come to the attention of the Board that such account,
PUBLIC WORKS FUND, HOSPITAL BUILDING, is misleading and may be in
violation of the law pertaining to public works fund purposes , and
WHEREAS, it has been determined by the Board that it would be in the
best interest of the County to close out the account, PUBLIC WORKS FUND,
HOSPITAL BUILDING, and to create a new account entitled WELD COUNTY
GENERAL ;HOSPITAL CAPITAL FUND, and to transfer all moneys derived by
mill levy from the PUBLIC WORKS FUND, HOSPITAL BUILDING , to the nevi
account, WELD COUNTY GENERAL HOSPITAL CAPITAL FUND, and
WHEREAS, it has been further determined by the Board that it would be
in the best interest of the County to create an additional new account
entitled, WELD COUNTY GENERAL HOSPITAL DEPRECIATION FUND, and to
transfer all moneys derived other than by mill levy into such new account.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners,
'geld County, Colorado, and it hereby authorizes and directs the County
Treasurer to transfer all moneys derived by mill levy from the PUBLIC
WORKS FUND, HOSPITAL BUILDING, to the account entitled, WELD [OUT/
GENERAL HOSPITAL CAPITAL FUND, and to close out the PUBLIC WORKS FUND.
HOSPITAL BUILDING account. Said new account to be funded by mill levy
and related investment earnings only and the proceeds therefrom to be
used for hospital buildings and equipment with the approval of the Weld
County Board of Commissioners .
BE IT FURTHER. RESOLVED, by the Board , and it hereby authorizes the
creation of an additional account entitled WELD COUNTY GENERAL HOSPITAL
DEPRECIATION FUND. Said account to be funded other than by mill levy
and the proceeds therefrom to be used for equipment, re-lairs and remodel
of buildings and equipment and other ge nal non-operating expenses of
the hospital .
BE IT STILL FURTHER RESOLVED, by the Board , and it hereby directs and
orders that all previous resolutions relating to creation of the Weld
County General Hospital accounts be revoked and held for naught.

WHEREAS, a public hearing was held on December 26, 1973,
in the chambers of the Board of County Commissioners, Weld County,
Colorado, for the purpose of hearing the petition of Phillips Petroleum
co. , Denver, Colorado, requesting approval of site for the construction
of a natural as liquid extraction facility on the following described
property, to-wit:
A tract of land located in the NW4 of Section 23, Township

Weld County, Colorado, and being more particularly
described as follows:

WHEREAS, it has been determined by the Board of County

RESOLUTION
WHEREAS, a public hearing was held on December 26, 1973, in
the chambers of the Board of County Commissioners, Weld County,
Colorado, for the purpose of hearing the petition of Fred Gibbs, Route 2,
Box 6A, Eaton, Colorado, requesting permission to locate a cattle and
sheep feeding operation on the following described property, to-wit:
A parcel of land more particularly described as being
all that part of the North Half of the North Half (NZNZ)
of Section Four (4), Township Six (6) North, Range
Sixty-Three (63) West of the Sixth P. M. , Weld County,
Colorado, said tract lying North of the Drury Reservoir
Ditch,
and,
WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the request of petitioner
to locate said cattle and sheep feeding operation on the above-described
premises, and
WHEREAS, the said requested cattle and sheep feeding operation

RESOLUTION
WHEREAS, a public hearing was held on December 26, 1973, in

Denver, Colorado, requesting a change of zone from "I" Industrial
District to ."A" Agricultural District, of a parcel of land described as
follows:

Township 3 North, Range 65 West of the Sixth P. M. ,
Weld County, Colorado, containing 10 acres, more
or less,

WHEREAS, the petitioner was present, being represented by

WHEREAS, there was no one present in opposition to the change
of zone, and
WHEREAS, said area, being a small parcel of a large tract of
land, was re-zoned from "A" Agricultural District to "I" Industrial
District, on or about November 12 , 1969, by resolution of the
Board of Weld County Commissioners, and
WHEREAS, the Weld County Planning Commission, by resolution

Colorado to be a threat and a hazard to all dutch elm trees in Colorado,
and further ordered that all such infected trees be destroyed or properly

Ann Spomer, and that he shall serve until the expi ration of her term.
BE IT FURTHER RESOLVED that the books of Gilman E. Olson,
as acting Weld County Clerk and Recorder, be closed as of January 16,
1974, and that the County auditor shall render an audit of said books
and records of Gilman E. Olson as such acting Weld County Clerk and
Recorder and report his findings to the Board of County Commissioners
of Weld County, Colorado.
