IN THE MATTER OF WATER COMMISSIONER
FOR WATER DISTRICT NUMBER 1 .
The following resolution was unanimously passed and adopted, viz : --
BE IT RESOLVED By the Board of County Commissioners of Weld County, Colorado , at a meeting
regularly held, that this Board for and on behalf of Weld County, respectfully recommends His
Excellency, Hon. Jesse F . McDonald, Governor of the State of Colorado to appoint Charles I .
Colwell of Morgan County to the position of Water Commissioner within and for Water district
No. 1 of Division Number 1 .

to adjournment of the 10th inst .

The minutes of the proceedings as held March 15 and April 3--4--5--6--7--5--10 were read
and on motion duly approved.

It appearing to the Board that County Warrant No . 7276 Series E . and County Warrant No .
9543 Series E . Were drawn in payment of the same claim and that County Warrant No . 9543 has
been paid and cancelled, it was therefore on motion ordered that County warrant No. 7276 be and
the same is hereby cancelled and held for naught .
The petition of D. P . Hubbard praying for a rebate of the 1904 Military Poll tax assessed
against was presented and after making a careful investigation of same and being fully advised
in the premises it was on motion ordered that he be granted a rebate of same for the reason of
having served in the U . S . army during the war of the rebellion.
rqg IN THE MATTER OF SALARIES
TO BE PAID IN COUNTY TREASURER' S OFFICE.
The Board then fixed the salaries to be paid in the
County Treasurer' s office for the year 1905 as follows , viz : --
Deputy Count)'Treasurer, the sum of -- -- - - - - - $115 . per month.
Clerk in Treasurer' s office the sum of - - - - - - - ;70 . per month.
with the understanding that said raise will date back to February 1 , 1905 and is to cover all
and any extra office hire .
134 IN THE MATTER OF RESIGNATION OF
JUSTICE OF THE PEACE OF JUSTICE PRECINCT NO . 35 .
The resignation od J . H . Rowe , Justice of the
Peace in and for Justice Precinct No . 35 was presented and on motion duly accepted.
W . J . Henderson then applied for the appointment to said office and after carefully con-
sidering same, and taking into consideration the recommendations filed in his behalf it was on
motion ordered that said W J Henderson be and he is hereby appointed Justice of the Peace in
and for said Justice Precinct No . 35 . Provided that he will furnish the necessary bond in the
sum of $1000 as required by law.

giving same their careful consideration it was on motion ordered that the County Attorney be and
he is hereby authorized and directed to defend the County' s interest in the same until they have
been fully settled by said Court .

The report of S . A. Bradfield, David Kelley and B . C . Rienks ,
viewers appointed March 14, 1905 to view a line of road described as follows , viz : --
Commencing et corner of Sections Two, Three , Ten and Eleven Township 7 , Range 67 West
and running East on the Section line between sections 2 and 11 one mile to open prairie . Begin-
ning at same starting point going south one mile between sections 10 and 11 to County Road -
was presented to the Board when the following action was taken and entered of record, to-Twit : --

h; \\.\J The Board having carefully considered the report of the viewers herein and all objections
JlA(. made thereto and the great expense necessary to open said road to travel and believing that it
is inexpedient at the present time it wits on motion ordered that report and recommendations of
the viewers be accepted and the road therein described be not granted. The Clerk is directed
to turn over to the County Treasurer the sum of $15 . deposited by Myrta Carleton for defraying
the expense of viewing said road.

Baird and John Root , viewers appointed to view the following described line of road, viz--

The Board having carefully considered the report of the viewers herein, as well as the
objections made thereto, and finding the report correct us to form, and believing the public
good does not require a road over 40 feet wide as recommended by the viewers , it was on motion
ordered that the report be approved and adopted, and the road therein described and recommended
by the viewers be and is hereby reduced from 6o to 40 feet in width. The clerk is direcTed to
plat the road as changed and notify the petitioner of the action of this Board.

A petition signed by Sam Brinkerhoff and numerous others praying for
a road sixty feet in width and described as follows , viz : --
"We the undersigned citizens of Weld County, Colorado in the vicinity of the desired road
most respectfully petition your honorable body . to throw out enough ground for a public highway
0 between the Northwest quarter of Section 3, and the ICE .* of section 4, Tp . 2N . , R. 6s West .
The said road to begin at the Township line on the North Of said sections and run south a dis-

1 tance of one half mile to connect with the public highway now open and running South from

the intersection of the north and south section line between said sections running East and

e4 West -- was presented to the Board when the following action was taken and entered of record,
to-wit : --

_ It appearing to the Board that the right of way for said road through patented lands is do-
t by the owners thereof , and the Board believing that the public good requires the laying
out of said road, on motion it was ordered that the prayer of the petitioners be granted, and

WARRANT NO . 8518 . -
A . J . Mayne having filed his affidavit showing that he was the rightful and
legal owner of a certain county warrant numbered 8518 series "E" in the sum of $12 .50 and
bearing date December 7 , 1904; that said warrant mesas been misplaced, lost or destroyed , and
after a most careful and diligent search he has been and is still unable to find the same , nor
can he produce the same for presentation for payment , and he asks that the Board, by proper
order , entered of record, issue to him a new warrant in place of said lost warrant .
Now it appearing to the Board that said A . J . Mayne has filed his indemnifying Bond in
the penal sum of $25 . 00 to save and keep harmless the said County of Weld and all of its
officials from all damages that may be occasionSd by the issuance of a new warrant without the
surrender of said warrant No . 8518 , it was , on motion ordered that a new warrant in the said
sum of $12 .50 be drawn on the County Treasurer in payment of the same claim as that of said
lost warrant .

Milton Seaman, Street Supervisor of the City of Greeley appeared before the Board and
asked that they appropriate about $90 00 toward laying stone walks over and across Ninth Street
a4d Ninth Avenue , and stated that if the County could do so the City of Greeley would also
appropriate the same amount , after carefully considering the matter and believing that the same
would be of a great benefit to the patrons of the Court House it was on motion ordered that
an appropriation of 075 . be and the same is hereby made with the understanding that the same
will be applied to layinG the walk East and North across Ninth Street and Ninth avenue where
said street and avenue corner on the Court House grounds .
IN THE MATTER OF COUNTY PRINTING
AND ADVERTISING .
The time having arrived for the opening of the several proposals received for
doing the county printing and advertising required by Weld County for the ensuing year, the
clerk proceeded to open and read the bids of The Kersey Enterprise , The Greeley Sun, The
Weld County Republican and The Greeley Tribune , being all the bids received, after carefully
considering each and all of said bids and believing the bid of the Greeley Sun to be the best
bid received it was on motion ordered that the contract for furnishing said printing and adver-
tising be and the same is hereby awarded to The Greeley Sun. Provided that in letting said
contract to the said Greeley Sun the Board of County Commissioners reserve the right at any and
all times during the life of said contract to print on their Mimeograph machide all circular
letters and any other matter necessary to the use of any one of the county officials .

' 7 :7IN THE MATTER OF APPROPRIATION FOR AN EXPERIMENTAL FARM
FOR WELD COUNTY.
A petition signed by J . F . Reed, Ernest R. Bliss and one hundred and twenty-
three others , all residents , tax payers and business men of Weld County, was presented to the
$'oard. askinG that an appropriation of $500 a year for 5 years be made, beginning with 1906 , to
help maintain and conduct an experimental farm; after carefully considering said- petition and
resolution and taking into consideration all points made therein it was the unanimous opinion
of the Board that such a farm would be of great value and benefit to each and every farmer
in the county , it was therefore on motion ordered that said petition be Granted and an appro-
priation of $500 be and the same is hereby made under the followinG provisions , viz : --
FIRST : --In making said appropriation the Board will require that the manager of said farm
be a practical farmer and whose appointment. must be approved by the Honorable Board of County
Commissioners , said Manager to be under the General supervision of the Agricultural college
Experimental Board.
SECOND : --Said appropriation to be $500 a year for Five years , the Board of County Commis-
sioners reserving the right at any and all times to reduce said appropriation accordingly when-
ever the profits of said farm are great enough to maintain itself or partially so . The Board
further reserves the right at any time to cut off the entire appropriation if said experimen-
tal station or farm is not carried on in a businesslike manner and according to agreement in
petition as now on file with the Clerk of this Board.

The following petition praying for a right of way over and across certain public highways , as
named therein, viz : --
TO THE HONORABLE BOARD OF COUNTY COMMISSIONERS,
of WELD COUNTY, COLORADO .
GENTLEMEN : --
The Northern Construction Company, a corporation duly organized and existing under the
laws of the State of Colorado , and the petitioner herein, is constructing a railroad from the
town of Johnstown to a point near Highlandlake, in Weld County , Colorado, for the purpose of
hauling sugar beets , farm products and for other traffic necessary in the conduct of its
business , and in the construction thereof it is necessary to cross a number of public highways
along the line thereof , and at each and every crossing there is required a strip of land
eighty feet in width, the same beinG forty feet on either side of the center line of the track
of said railroad, as the same is now located by the enGineer of said company .
By reason of the premises , the Northern Construction Company, petitioner herein, as afore-
said, does hereby petition to your honorable body for a right of way for a crossing eighty
feet in width, the same being forty feet on each side of the center line of said railraod, as
now surveyed and located, throuGh, over and across the followinG public highways , described as
follows , to- wit : --
In Township four, North of Range 67 , West of the 6th p . m.
Public Highway No . 376 running East and West on the half section line of section 9 , where
said railway crosses same diagonally at a point 1618 . 5 feet east of the west line of said
section,
Public Highway No . 120 , running North and South between sections Nos . 16 and 17 , where
said railraod crosses same diagonally at a point 1436 . 5 feet south of the Northwest corner of
said section 16 .
Public highway No . 3667 running East and West between sections Nos . 17 and 20 , where said
railroad crosses same diagonally at a point 1447 feet west of the Southeast corner of said
section 17 .
Public highway No . 344 running East and West between sections 20 and 29 , where said
railraod crosses same diagonally at a point 2315 feet East of the Northwest corner of said

Public Highway No . 389 , running North and south between sections 11 and 10 , where said

Public highway No . 98 , running North and South between sections 10 and 9 , where said rail-
road crosses same diagonally at a point 856 feet North of the southwest corner of said section
10 .
Public Highway No 68 , running East and west between sections 9 and 16 where said railroad
crosses same diagonally at a point 324. 5 feet West of the Northeast corner of said section 16 .
Public highway No . 137 , running East and West between sections 16 and 21 , where said
railroad crosses same at a point 2419 feet west of the Southeast corner of said section 16 .
Public Highway No. 59, running East and West between sections 21 and 28 , where said rail-
road crosses same diagonally at a point 570 feet west of the north quarter corner of said sec-
tion 28 .
Also the right to cross any other highway necessary to be crossed in the construction
and operation of said railroad.
The rights-of-way to be granted by your Honorable Body, through, over and across the afore-

said Public Highways , is to be granted to this Corporation for the purposes , as stated herein,
and such occupation by this corporation, its successors and assigns , shall be subject to the
condition that , in the construction, operation and maintenance of said railroad, they will do
and perform whatever a reasonable public necessity will require to maintain said crossings'as a
public highway, as public safety and convenience may require .
All of which is most respectfully submitted and petitioned for herein.

Was presented to the Board when the following action was taken and entered of racord, to-wit : --
The said petition and all matters therein contained having been duly, regularly and
faithfully considered, the rights of way and each and all of them, as prayed for in said pe-
tition, be and the same are hereby granted upon the terms and conditions as in said petition set
forth and prayed for ; and a further consideration that said crossings and each of them shall
be constructed as near as may be possible and practical , so as to conform to the present grade
of said highways , and shall be so constructed and maintained as not to interfere with the
proper and necessary use of said highways for the public travel , as well as for the proper
drainage thereof , and of my irrigating ditches . And whenever necessity requires that said
c'rossinGs be made a grade higher or lower than the highway, the said company shall construct
and maintain abroad and easy crossing and approaches thereto, which shall, when done, be sub-
ject to the approval and acceptance of this Board, or the Road Overseer within the district
where said roads are located.
It is further ordered that said petition be entered of record in and upon the records of
this Board immediately preceding the action granting the same by this Board.

Company appeared before the Board and requested that they be allowed to make a Runway under the
county road at the Southwest corner of Section 36, Pp . 5N. , R. 65 West, said runway being at
a4point where the natural slope Qf the land is very favorable to it and is to be used for the
purpose of running cattle too and from one piece of land to another,' after carefully consider-
ing the matter and beina well advised in the premises it was on motion ordered that their re—
quest be and the same , is hereby granted, provided that said runway be built and maintained
without cost to the county.

On motion of Commissioner Bradfield and seconded by Commissioner DeVinny the fol-
lowing resolution was unanimously passed and adopted, viz : --
WHEREAS, The Live Stock Company a corporation duly organized and existing under and by
fl virtue of the Laws of the State of Colorado has by Warranty Deed of Date , May 26, A. D . 1905,
by them duly acknowledged and delivered and duly recorded in Book 228, at page . 1.49. , Weld
County records , has offered to dedicate and has dedicated to the County of Weld in the State of
Colorado for road purposes a strip of land as follows , viz : --
A strip of land Sixty feet wide for a county road, the same beinG situated in the
Ybk of Section Eight (5 ) , Township Six (6 ) North, Range Sixty-seven 1(67 ) West, the center
line of which is described as follows , to—wit : --
Commencing at a point on the section line 128 and 6/10 (120--6/10 ) feet south of the
Quarter section corner between sections 7 and S in Tp . 6 North, Range 67 West; thence
North 16° 14' East 568 & $/10 feet, thence North 4° and 30 ' West 476 & 1/10 feet ; thence
North 31 ° and 25 ' West 230 & 9/10 feet to the said section line between sections 7 & S.
NOW THEREFORE Be It Resolved by the Board of County Commissioners for said County of
Weld and for the use and benefit of its traveling public does hereby accept said offer of dedi-
cation and dedication of said strip of land for the purpose of the use of a public highway and
the same as above described are hereby established as and declared to be a public highway.

II IN THE FATTER OF APPROPRIATION FOR AN
AGRICULTURAL EXPERIMENT STATION .
Ernest R. Bliss, Secretary of the Weld County Farmers league
appeared before the Board and asked for an amendment to a certain order passed by this Board
of date May 9, 1905, entitled "IN THE MATTER OF APPROPRIATION FOR AN EXPERIMENTAL FARM FOR
WELD COUNTY" ; after carefully considering said request and being well advised in the premises
on motion, it was ordered that said request be and the same is hereby granted, and that the
order passed' .. in relation thereto on the date above mentioned be and the same is hereby
amended so as to read as follaws , viz : --
FIRST . --In making said appropriation the Board will require that the manager or super-
intendent of said Farm shall be a practical farmer, whose appointment shall be approved by
the Board of County Commissioners ; said manaGer or superintendent to be under the exclusive
supervision of the Agricultural Experiment Station of the Colorado Agricultural College .
SECOND. --Said appropriation to be $500. for each of the Five years beginning with and in-
cluding 1906, the Board of County Commissioners reservinG the right at any and all times to
reduce said appropriation accordingly whenever the. proceeds of said farm are over and above
its expenses or in other words, the County throuGh its Board of County Commissioners agrees
to guarantee, to the extent of $500 . per year against an excess of expenses over receipts
from the products of said farm; and
THIRD.--The appropriation is made always with the provision, that the Colorado State Board
of Agriculture shall establish a sub-station or experiment farm under the direction of The
Colorado Experiment Station, for field experiments , with farm crops, especially potatoes
within the Greeley potato district of Weld County.

On motion of Commissioner DeVinny and seconded by Commissioner Bradfield
the following resolution was .unanimously passed and adopted, vizt --
BE IT RESOLVED By the Board of County Commissioners of Weld County, Colorado that from and after
this date all claims presented to this Board for provisions , Labor, etc furnished and rendered
to and for any person or persons without the same having been authorized by this Board will be
disallowed immediately upon receipt of same , unless in an urGent case whereby immediate aid is
necessary, then and in that case allowance will be made provided that notification be given at
the first opportunity; said allowances to be at same rate as paid for similar pauper cases under
existing contracts held by, the county .
The clerk is directed to communicate with each and every City and Town Board within the
county and notify them of the above action.

II IN THE MATTER OF DISPOSING OF REAL PROPEPTY
HELD BY WELD COUNTY .
Mr. A. B . Hilton appeared before the Board and stated that the S .E .
Section 15 , Tp . 10N. , Range 61 West is now held by Weld County and that he desired to pur-
chase the interest of the county in said described property and offered to pay the sum of
$50 . therefor,
Upon investigating the matter it was found that said property was sold to Weld
County in 1897 for the taxes of prior years ; that said property is still held by Weld
County by virtue of said tax sale ; that in consequence of said property being held by said
Weld county no taxes have been collected thereon since the issuance of said certificates
and in order to place said property back upon the tax rolls it was thought best to dispose
of the same ;
Therefore it was on motion ordered that the offer of Mr . A. B . Hilton be and the same
is hereby accepted and the County Treasurer be and he is hereby authorized and directed to
issue a certificate of sale for said property upon the payment of the said sum of $50 .

donated by the owners thereof, and the Board believing the public good requires the laying out

The Board having carefully considered the report of the viewers herein, as well as the

objections made thereto, and finding the report correct as to form, and believing the
public good requires the laying out of the road as recommended by the viewers, it was on
motion ordered that the report be approved and adopted, and the road therein described and
recommended by the viewers be and is hereby declared a public highway. It is also further
ordered that the line of road asked to be vacated and abandoned be closed as a public high-
way from and after this date . The clerk is directed to record the report , plat the road, draw
warrants in favor of parties for damages awarded, and cause notices to be posted of opening
of said road, and notify the road overseer of the proper district to open the same to travel
in sixty days as required by law.

granted and The Schaeffer Land and Live Stock Co. having deposited $15 . to pay the expense of
viewing in case said road be not granted, on motion it was ordered that Commissioner R. W.
DeVinny, Henry Baab and Sherman Markle be and they are hereby appointed viewres to meet at the
starting point at 10 : o ' clock a . m. Tuesday the 20th day of June 1905 and view the line of road
herein prayed for and file their report thereon, as required by law, with the County Clerk ten
days before the next regular meeting of the Board. F . M. Schaeffer is hereby appointed to post
notices as required by law. -

/ / ,?_ Mr . Brown, representing The Colorado Bell Telephone Company appeared before the Board and
requested that new contracts for the use of their telephones be entered into from and after
the first day of July , 1905, and saying that under said new contracts the change would be a
saving of about 1�• 0. per year to the County , but a charge of Five cents a talk would be
between Greeley and Eaton, Greeley and Ault and also Greeley and Windsor , and the
Board after carefully considering the matter believe that under said change the county at the
end of one year would be paying a great deal more for the use of same than they have ever
heretofore allowed; it was therefore on motion ordered that all county phones be taken out at
the end of the present quarter , except those in use by the two Judges of the District Court ,
these two phones being under the direction of said judges .
The Board then resumed the checking ,of the Books and Accounts of the County Treasurer ,
and continued thereat the remainder of the day completing its labors . The warrants , school
orders and all cash items were ordered turned over to the County Clerk; subject to the order
of the District Court .
There being no further business to com before the Board an adjournment was ordered taken

In compliance with an Act of the laws passed at an extra session of the Thirteenth General
Assembly of the State of Colorado , entitled "REVENUE" to provide for the better assessment and
collection of Revenue , etc . ( See Section 110 , Page 104, Session Laws of 1902 ) and in accor-
dance with the reports of the State Board of Equalization for the year A. D . 1905 , the fol-
lowing distribution of Mileage and valuations thereof of the several Railway , Telegraph and
Telephone lines , Sleeping and other car Companies is hereby ordered made to the several School
Districts and Municipal corporations within the County of Weld and entered in the record of
the proceedings of this Board . And it is further ordered that a copy thereof be furnished to the
County Assessor directing him to spread same upon the Assessment roll of said Weld County for
