The following resolution was unanimously passed and adopted, viz : -- BE IT RESOLVED By the Board of County Commissioners of Weld County, Colorado , at a meeting regularly held, that this Board for and on behalf of Weld County, respectfully recommends His Excellency, Hon. Jesse F . McDonald, Governor of the State of Colorado to appoint Charles I . Colwell of Morgan County to the position of Water Commissioner within and for Water district No. 1 of Division Number 1 . The minutes of the proceedings as held March 15 and April 3--4--5--6--7--5--10 were read and on motion duly approved. • It appearing to the Board that County Warrant No . 7276 Series E . and County Warrant No . 9543 Series E . Were drawn in payment of the same claim and that County Warrant No . 9543 has been paid and cancelled, it was therefore on motion ordered that County warrant No. 7276 be and the same is hereby cancelled and held for naught . The petition of D. P . Hubbard praying for a rebate of the 1904 Military Poll tax assessed against was presented and after making a careful investigation of same and being fully advised in the premises it was on motion ordered that he be granted a rebate of same for the reason of having served in the U . S . army during the war of the rebellion. rqg IN THE MATTER OF SALARIES TO BE PAID IN COUNTY TREASURER' S OFFICE. The Board then fixed the salaries to be paid in the County Treasurer' s office for the year 1905 as follows , viz : -- Deputy Count)'Treasurer, the sum of -- -- - - - - - $115 . per month. Clerk in Treasurer' s office the sum of - - - - - - - ;70 . per month. with the understanding that said raise will date back to February 1 , 1905 and is to cover all and any extra office hire . 134 IN THE MATTER OF RESIGNATION OF JUSTICE OF THE PEACE OF JUSTICE PRECINCT NO . 35 . The resignation od J . H . Rowe , Justice of the Peace in and for Justice Precinct No . 35 was presented and on motion duly accepted. W . J . Henderson then applied for the appointment to said office and after carefully con- sidering same, and taking into consideration the recommendations filed in his behalf it was on motion ordered that said W J Henderson be and he is hereby appointed Justice of the Peace in and for said Justice Precinct No . 35 . Provided that he will furnish the necessary bond in the sum of $1000 as required by law. 4 The matter of the cases of M. G . Palmer versus The Board of County Commissioners of Weld PC)- County , Colorado and Jesse S . Gale versus George D. The report of S . A. Bradfield, David Kelley and B . C . Rienks , viewers appointed March 14, 1905 to view a line of road described as follows , viz : -- Commencing et corner of Sections Two, Three , Ten and Eleven Township 7 , Range 67 West and running East on the Section line between sections 2 and 11 one mile to open prairie . Begin- ning at same starting point going south one mile between sections 10 and 11 to County Road - was presented to the Board when the following action was taken and entered of record, to-Twit : -- J h; \\.\J The Board having carefully considered the report of the viewers herein and all objections JlA(. made thereto and the great expense necessary to open said road to travel and believing that it is inexpedient at the present time it wits on motion ordered that report and recommendations of the viewers be accepted and the road therein described be not granted. The Clerk is directed to turn over to the County Treasurer the sum of $15 . deposited by Myrta Carleton for defraying the expense of viewing said road. 490 i. 37/IN THE MATTER OF VIEWERS REPORT ON ABANDONMENT OF 20 FEET /0 (2 OF ROAD ALONG NORTH SIDE OF SECTION 17 , TP . 4N . , R. 66 WEST . The report of R. W. DeVinny, A. P . Baird and John Root , viewers appointed to view the following described line of road, viz-- ' I.> D lib "We the undersigned, your petitioners , respectfully represent that the necessities of the 1 Q public does not require a sixty foot road as it now runs along the north side of section 17 , I Tp , 4N . , R. 66 West ; therefore your petitioners humbly pray that said road be reduced from 60 is to 40 feet in width. " k,, was presented to the Board when the following action was taken and entered of record, to-wit : -- V The Board having carefully considered the report of the viewers herein, as well as the objections made thereto, and finding the report correct us to form, and believing the public good does not require a road over 40 feet wide as recommended by the viewers , it was on motion ordered that the report be approved and adopted, and the road therein described and recommended by the viewers be and is hereby reduced from 6o to 40 feet in width. The clerk is direcTed to plat the road as changed and notify the petitioner of the action of this Board. -79"//I IN THE MATTER OF PETITION FOR ROAD IN BOG) TOWNSHIP 2N . , RANGE 68 WEST . A petition signed by Sam Brinkerhoff and numerous others praying for a road sixty feet in width and described as follows , viz : -- "We the undersigned citizens of Weld County, Colorado in the vicinity of the desired road most respectfully petition your honorable body . to throw out enough ground for a public highway 0 between the Northwest quarter of Section 3, and the ICE .* of section 4, Tp . 2N . , R. 6s West . The said road to begin at the Township line on the North Of said sections and run south a dis- N 1 tance of one half mile to connect with the public highway now open and running South from N N the intersection of the north and south section line between said sections running East and k e4 West -- was presented to the Board when the following action was taken and entered of record, to-wit : -- 'U _ It appearing to the Board that the right of way for said road through patented lands is do- t by the owners thereof , and the Board believing that the public good requires the laying out of said road, on motion it was ordered that the prayer of the petitioners be granted, and the line of road prayed for be and is hereby declared a public highway. Bartholo- PIp C- N ilmew, viewers appointed February 17 , 1905 to view the following described line of road viz : -- ommencing at the S . E . Corner of section 22, Tp . 8N . , R. 66 West and running thence due fic.st one mile between sections 22 and 27 to the S .W . corner of said section 22 ; thence due Perth one mile between sections 22 and 21 to the N . W. Corner of said section 22; Thence East Imile between sections 22 and 15 to the N . Bliss and one hundred and twenty- three others , all residents , tax payers and business men of Weld County, was presented to the $'oard. askinG that an appropriation of $500 a year for 5 years be made, beginning with 1906 , to help maintain and conduct an experimental farm; after carefully considering said- petition and resolution and taking into consideration all points made therein it was the unanimous opinion of the Board that such a farm would be of great value and benefit to each and every farmer in the county , it was therefore on motion ordered that said petition be Granted and an appro- priation of $500 be and the same is hereby made under the followinG provisions , viz : -- FIRST : --In making said appropriation the Board will require that the manager of said farm be a practical farmer and whose appointment. must be approved by the Honorable Board of County Commissioners , said Manager to be under the General supervision of the Agricultural college Experimental Board. SECOND : --Said appropriation to be $500 a year for Five years , the Board of County Commis- sioners reserving the right at any and all times to reduce said appropriation accordingly when- ever the profits of said farm are great enough to maintain itself or partially so . The following petition praying for a right of way over and across certain public highways , as named therein, viz : -- TO THE HONORABLE BOARD OF COUNTY COMMISSIONERS, of WELD COUNTY, COLORADO . GENTLEMEN : -- The Northern Construction Company, a corporation duly organized and existing under the laws of the State of Colorado , and the petitioner herein, is constructing a railroad from the town of Johnstown to a point near Highlandlake, in Weld County , Colorado, for the purpose of hauling sugar beets , farm products and for other traffic necessary in the conduct of its business , and in the construction thereof it is necessary to cross a number of public highways along the line thereof , and at each and every crossing there is required a strip of land eighty feet in width, the same beinG forty feet on either side of the center line of the track of said railroad, as the same is now located by the enGineer of said company . By reason of the premises , the Northern Construction Company, petitioner herein, as afore- said, does hereby petition to your honorable body for a right of way for a crossing eighty feet in width, the same being forty feet on each side of the center line of said railraod, as now surveyed and located, throuGh, over and across the followinG public highways , described as follows , to- wit : -- In Township four, North of Range 67 , West of the 6th p . m. The rights-of-way to be granted by your Honorable Body, through, over and across the afore- . said Public Highways , is to be granted to this Corporation for the purposes , as stated herein, and such occupation by this corporation, its successors and assigns , shall be subject to the condition that , in the construction, operation and maintenance of said railroad, they will do and perform whatever a reasonable public necessity will require to maintain said crossings'as a public highway, as public safety and convenience may require . Bliss, Secretary of the Weld County Farmers league appeared before the Board and asked for an amendment to a certain order passed by this Board of date May 9, 1905, entitled "IN THE MATTER OF APPROPRIATION FOR AN EXPERIMENTAL FARM FOR WELD COUNTY" ; after carefully considering said request and being well advised in the premises on motion, it was ordered that said request be and the same is hereby granted, and that the order passed' .. in relation thereto on the date above mentioned be and the same is hereby amended so as to read as follaws , viz : -- FIRST . --In making said appropriation the Board will require that the manager or super- intendent of said Farm shall be a practical farmer, whose appointment shall be approved by the Board of County Commissioners ; said manaGer or superintendent to be under the exclusive supervision of the Agricultural Experiment Station of the Colorado Agricultural College . SECOND. --Said appropriation to be $500. for each of the Five years beginning with and in- cluding 1906, the Board of County Commissioners reservinG the right at any and all times to reduce said appropriation accordingly whenever the. proceeds of said farm are over and above its expenses or in other words, the County throuGh its Board of County Commissioners agrees to guarantee, to the extent of $500 . per year against an excess of expenses over receipts from the products of said farm; and THIRD.--The appropriation is made always with the provision, that the Colorado State Board of Agriculture shall establish a sub-station or experiment farm under the direction of The Colorado Experiment Station, for field experiments , with farm crops, especially potatoes within the Greeley potato district of Weld County. Brown, representing The Colorado Bell Telephone Company appeared before the Board and requested that new contracts for the use of their telephones be entered into from and after the first day of July , 1905, and saying that under said new contracts the change would be a saving of about 1�• 0. per year to the County , but a charge of Five cents a talk would be between Greeley and Eaton, Greeley and Ault and also Greeley and Windsor , and the Board after carefully considering the matter believe that under said change the county at the end of one year would be paying a great deal more for the use of same than they have ever heretofore allowed; it was therefore on motion ordered that all county phones be taken out at the end of the present quarter , except those in use by the two Judges of the District Court , these two phones being under the direction of said judges . The Board then resumed the checking ,of the Books and Accounts of the County Treasurer , and continued thereat the remainder of the day completing its labors .
