Dear Mr. Connell: I am advised that the Board of County Commissioners of Weld County have, by resolution, requested that you seek an order stopping sand and gravel mining by Turnpike Construction Co. on property located in Section 30 and 31 of Township 2 North, Range 68 West of the 6th P.M. , Weld County, Colorado. I am authorized to advise you that Turnpike Construction Co. and its owner, Fred Spallone, will voluntarily cease and desist from further mining and crushing activities at the subject location after Wednesday, July 24, 1974, pending issuance of a special use permit for sand and gravel extraction by the Board of County Commissioners. Activities at the site after July 24 , 1974 , will be limited to loading and transporting previously mined sand and gravel but there will be no further excavation. My client' s agreement to voluntarily hault operations shall not prejudice the right of Weld County to seek any court orders it may hereafter deem necessary. The voluntary agreements contained herein are made in a spirit of cooperation based upon assurances that Turnpike Construction Co. Although we sympathize with this problem, the County by statutes can only involve itself in certain matters and these do not include a matter such as you described in your leLLer. If Turnpike Construction's actions are damaging to you, you may wish to take legal action; or if the ditch company found Turnpike's actions detrimental it might wish to take legal action. I regret I cannot be more helpful in this instance. As you probably know, at our last Board meeting, we Commissioners directed the County Attorney to seek an injunction against Turnpike Construction, ceasing their activities until Weld County Planning and Zoning regulations have been met. A definite hearing date has not yet been set since the County Planning Commission is obtaining more information regarding this situation, but I hope a hearing before the Planning Commission will be held in the near future; any seeming time lag delaying the hearing is due to state statutes requiring the County to publish notification of the hearing thirty days before it is to be held. Because we do not want an unsightly County, people endangered or persons operating illegally, we are anxious to correct any wrongdoings.
