unpeteated government land be-taken Su accordance with Section 2477 of the Revised Statutes of the U. S.,
and the line'of road prayed for be and is hereby declared a public hiihway. The Clerk is directed to
record the petition, plat the road as granted, and notify the Road Overseer of the proper District to

Gentlemen:
As you are aware, this Department acquired for.the United
States Government, certain parcels of land adjacent to County
highways which were needed to improve said highways for use by
the Government to service'Missile Installations at various
locations in Weld County.
Deeds for the above parcels were taken to the Department •
of Highways, State of Colorado. Due to the fact that all parcels
are on County highways rather than State Highways, this Depart—
ment is deeding same to Weld County by Quit Claim Deed which is
attached as agreed.
Your attention is called to the fact that the Deed has been' y/
fully executed by the Department and also that same should be •
recorded by the County.
If you should have any question relative to the above, •
please do not hesitate to contact us.

The' object of these specifications is to provide the minimum construction
requirements for roads to be constructed on locations other than the Forest •
Development road system. '
Any departure from these specification's must have prior written approval of
the Forest Supervisor.
LOCATION:
The location, including drainage structures and dips shall be the responsibility
of the permittee and approved by the Forest Officer in Charge prior to the start
of construction.
•
Avoid: Closely paralleling a stream; steep side hill slopes; long un-
broken grades; sharp curves and switchbacks on grades over 4%; locations where
{ it is possible for a stream to break over and flow down the road.
Locations where the toe of the fill slope, will extend to the high
water level; there should be a vegetated strip between the toe of the fill and
•
the high water level of the stream: the width of the strip should be governed
by the steepness :of the slope and the filtering capacity of the ground cover
and soil.
• COt STRUCTT_ON:•
Clearing & Grubbing - The area to be cleared and grubbed shall extend 3
feet outside of the top of the backslope and 3 feet beyond the toe of the fill
slope.
All trees, stumps, brush, and debris shall be cleared from the area and the

material disposed of as directed by the Forest Officer in Charge:

The clearing and grubbing work shall be completed prior to the start of the
grading operation.
•
• Gradi - Width: The road shall be constructed to a minimum width of
• 12 feet with turnouts provided at intervals which will provide, safe travel on
the road.
Slopes: Cut slopes shall be excavated to a 1: 1 slope. Overhang
at the top of the slope will not be acceptable. Fill slopes shall be constructed
on a 11:1 slope. '
Allowable Grades: Grades should be held as low as possible, but
in order to insure drainage no grade of less than 1% will be used.
Grades on switchbacks and sharp curves will not exceed 4%.
The following table'of maximum grades and distances between breaks in grade
shall govern:

Drainage - Install bridges, culverts or fords to carry live streams or
definite drainage channels across the road.

Dips located into the grade line in accord with the attached plan will be con-
structed at not to exceed 1,000 foot intervals on grades 2% to 5%, 300 foot •
intervals on all grades exceeding 5% and at shorter intervals on grades of 8%
or more.
If culverts are installed in lieu of dips the road will be ditched on sidehill
and through cut sections. Ditches shall not exceed one foot in depth with 3:1
slope from the shoulder of the road to the bottom of the ditch.
Curvature - The radius of curves should be as long as practicable. No
curves will be permitted-with less than a 38 foot radius.
Maintenance - The maintenance of the road to the extent necessary to pre-
vent erosion of the road surface and to protect the watershed values of the
areas affected by the road shall be the responsibility of the permittee during
the life of the special use contract.

WHEREAS, the Forest Service of the United States Department of
Agriculture has submitted to Weld County District Number One a special
use application for the opening of a portion of County Road Number 833, and
WHEREAS, it appears that the necessities of the public require that
County Road Number 833 be extended approximately 2z miles more particularly
located as follows:
A strip of land 30' wide being the south 30' of the north 60'
of Sections 21, 22 and the south 30' of the north 60' of the
west half of Section 23, all in Township 11 North, Range 58
West of the 6th P. M., all in Weld County, Colorado
NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners,

3. Development plans;layout plans; construction,'reconstruction, or alteration of improvements; or
revision of layout or construction plans for this area must be approved in advance-and in writing by the
forest supervisor. Trees or shrubbery on the permitted area may be removed or destroyed only after
the forest officer in charge has approved, and has marked or otherwise designated that which may be
removed or destroyed. Timber cut or destroyed will be paid for by the permittee as follows:Merchantable
timber at appraised value; young-growth timber below merchantable size at current damage appraisal
value;provided that the Forest Service reserves the right to dispose of the merchantable timber to others
than the permittee at no stumpage cost to the permittee. Trees,shrubs,and other plants may be planted
in such manner and in such places about the premises as may be approved by the forest officer in charge.
4. The permittee shall maintain the improvements and premises to standards of repair,orderliness,
neatness,sanitation,and safety acceptable to the forest officer in charge.
5. This permit is subject to all valid claims. •
6. The permittee, in exercising the privileges granted by this permit;shall comply with the regula-
tions of the Department of Agriculture and all Federal, State,.county, and municipal.laws, ordinances,
or regulations which are applicable to the area or operations covered by this permit.
7. The permittee shall take all reasonable precautions to-prevent and suppress forest fires. No ma-
terial shall be disposed of by burning in open fires during the closed season established by law or regula-
tion without a written permit from the forest officer in charge or his authorized agent.

10.22. This permit is not transferable. If the permittee through voluntary sale or transfer, or through
enforcement of contract,foreclosure,tax sale,or other valid legal proceeding shall cease to be the owner of
the physical improvements other than those owned by the United States situated on the land described in
this permit and is unable to furnish adequate proof of ability to redeem or otherwise reestablish title to
said improvements,this permit shall be subject to cancellation. But if the person to whom title to said
improvements shall have been transferred in either manner above provided is qualified as a permittee and is
willing that his future occupancy of the premises shall be subject to such new conditions and stipulations as
existing or prospective circumstances may warrant,his continued occupancy of the premises may be author-
ized by permit to him if,in the opinion of the issuing officer or his successor,issuance of a permit is desir-
able and in the public interest.
11.1` In case of change of address,the permittee shall immediately notify the forest supervisor.
12.11 The temporary use and occupancy of the premises and improvements herein described may be
sublet by the permittee to third parties only with the prior written approval of the forest supervisor but
the permittee shall continue to be responsible for compliance with all conditions of this permit by persons to
whom such premises may be sublet.
13.11 This permit may be terminated upon breach of any of the conditions herein or at the discretion of
the regional forester or the Chief,Forest Service.
14.11 In the event of any conflict between any of the preceding printed clauses or any provision thereof
and'any of the following clauses'or any provisions thereof,the preceding printed clauses will control. '
15.1ll This permit is accepted subject to the conditions set forth above and to conditions 16 to

16. The permittee agrees to take all reasonable precautions to avoid
damage to property and resources of the United States and diligently to
undertake suppression action in the event of fire resulting from the
exercise of the privileges herein granted.
17. The road shall be so- constructed and maintained as to prevent the
accumulation of excessive heads of water and the erosion of the road ,
surface and drainage ditches.
18. The' permittee shall install corrugated metal pipe culverts or other
suitable devices and drainage structures, as directed by the forest officer,
sufficient in number to, prevent the accumulation of excessive heads of water
and the erosion of the road surface, drainage ditches, and adjacent lands,
including post-construction maintenance and protection from erosion.
19. , All earth cut or fill slopes' favorable to revegetation and.which are
flatter than 1 to 1, or other areas on Which ground cover is destroyed' in
the course of construction, will be seeded or planted to grasses or.other
, suitable vegetation as required by the Forest Supervisor. In unusual
situations, he may also require that a ground cover be established on cut
or fill slopes favorable -to revegetation but which are steeper than 1 to 1.
20. Seeding or planting will be done at a time of the year, in a manner,
and with species which in the opinion of the Forest Supervisor offers the
best chance of success.
21. Depending on the species used, 8 to 15 pounds per acre of seed will
be required for revegetation. The minimum to be required will be specified
by ,the Forest Supervisor.
22. The Forest Service reserves the right, whenever desired, to install
cattle guards or stock crossings at'any points'on the road on national
forest land.
23. After construction, .the road, 'for its entire length, whether on
Government or private land, shall remain open continuously and indefinitely
to free use of the public at all times.
24. The road authorized by this'permit shall be on "a location approved in ,
advance by the district ranger: Construction standards shall be not lower
than those shown on the attached specification sheet for Off System Special
Use Roads. Ali practicable'precautions 'shall be to minimize damage
• to the soil, and to prevent the creation of conditions conducive to soil
erosion. ;

25. The permittee will post and maintain signs as requited by the district
ranger notifying the public of road closures, unusual hazards, or other
special conditions pertaining to the use of the road authorized by this
permit. '

26. All roads constructed under the authority of this permit shall be
free public roads.
27. - -The permittee, in the exercise of this permit, shall.not discriminate
against any employee or applicant for employment because of race, creed,
color or national origin, and shall include in all subcontracts a provision
imposing a obligation on subcontractors.
28., None of the conditions of the permit as set forth herein can be varied -
or modified, except with the written consent of the Forest Supervisor.
' 29. This permit shall have no force or effect until the permittee has
signified his acceptance of it by signing and returning the duplicate copy •
to the Forest Supervisor. -

Notice is hereby given that in pursuance of a petition heretofore pre-
sented to the Board of County Commissioners of Weld County, the said
Commissioners have appointed three Road Viewers to meet at point
