Home My WebLink About730547 c?9,/ C - - - RESOLUTION WHEREAS, a public hearing was held on May 29, 1973, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Marvin R. Weber, Route 1, Box 29, Ault, Colorado 80619, requesting permission for expansion of an existing cattle and sheep feedlot operation on the following described property, to-wit: The Southeast Quarter (SE+) of Section Eight (8), Township Seven (7) North, Range Sixty six (66) West of the Sixth P. M. , Weld County, Colorado (cattle pens); The Northeast Quarter (NE4) of Section Seventeen (17), Township Seven (7) North, Range Sixty-six (66) West of the Sixth P. M. , Weld County, Colorado (sheep pens); and, WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner for the expansion of said feedlot operation, and WHEREAS, the said requested feedlot operation is located in an agricultural z one as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution of Weld County, said feedlot operation or any expansion, thereof may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner, and studied the recommendation of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Marvin R. Weber, Route 1, Box 29, Ault, Colorado 80619, for expansion of an existing cattle and sheep feedlot operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to expand said feedlot operation and shall have up to one year from date hereof to begin construction for the expansion thereof. 3. That when expansion of said feedlot operation is completed, same shall contain, in addition to the facilities present at the time of hearing, those additional pens, all as shown on plat as submitted and made a part hereof by reference. That petitioner shall construct sealed holding pond or ponds as may be required by the State Health Department and that same shall be designed by a registered professional engineer or the soil con- servation service. 5. Weld County Planning Commission Weld County Courthouse 9th & 9th Greeley, Colorado 80631 Re: Wykert and Weber, Inc. • (SE4i Sec. 8, T-7, R=66) Dear Sirs: A survey of the Wykert and Weber feedlot area reveals that existing cattle and sheep feeding facilities do not meet State Water Pollution Control Standards. The area drains directly into the Collins irrigation ditch which extends southward to the Weld Canal. The proposed expansion and reconstruction of the cattle feeding operation would seem to correct that portion of the violation. However, since a Sealed Retention Pond is needed, it will be necessary that an engineering report prepared by a professional engineer registered in the State of Colorado be furnished. This report must furnish the information required under Section 5 of the Rules and Guidelines For Water Pollution Control At Livestock Confinement Areas. In lieu of a report by a registered professional engineer, a similar report by the U. S. Soil Conservation Service will be • acceptable. Evaluation is to determine the suitability of the soil for feedlot expansion with animal waste sewage disposal system. The soils in this area are deep, well drained, medium to moderately coarse textured with nearly level to rolling topography. The area is not subject to flooding except from occasional runoff from surrounding areas. There is a canal which flows south running through the area and this would have to be protected from pollution by runoff. The soils are suitable for holding or retention ponds if needed. James A.
