RESOLUTION
IN THE MATTER OF THE BOARD OF COUNTY COMMISSIONERS, WELD
COUNTY, COLORADO, PURCHASING LAND NEAR NUNN, COLORADO,
TO BE USED FOR COUNTY PURPOSES.
WHEREAS, the Board of County Commissioners, Weld County,
Colorado, has determined that it is rapidly running out of gravel reserves
needed for county road purposes, and
WHEREAS, certain lands near Nunn, Colorado, are available
with vast gravel deposits thereon, and
WHEREAS, the Board deeming it advisable and in the best interests
of the County, has entered into a contract with the Seller for the purchase
of said real estate for the total purchase price of 4 16,000.00 , and
WHEREAS, the location of these gravel deposits near Nunn,
Colorado, makes it convenient and desirable and in the best interests of
the County to purchase said property.
NOW, THEREFORE, BE IT RESOLVED, that the Board of County
Commissioners, Weld County, Colorado, hereby affirms and ratifies
the purchase of said property, described as the Southeast Quarter (SE+)
of Section One (1), Township Eight (8) North, Range Sixty-six (66) West,
Weld County, Colorado, from Agnes Williams; and that record title to
said real estate be taken in the name of the County.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote" -n the 17th day of
of March, 1971.

Gentlemen:
At your request I have examined abstract of title and the records
of the Security Abstract Company of Weld County, Colorado, covering
the title to the following described real property located in Weld County,
Colorado, to-wit:
Southeast Quarter (SE4) of Section One (1), Township Eight
(8) North, Range Sixty-six (66) West of the Sixth P. M.
Title to this property is abstracted by the Security Abstract Company
of Weld County, Colorado, and last certified to under Certificate No.
21265 dated February 24, 1971, at 7:45 o'clock A. M.
From such examination I find as follows:
Fee simple title to the above-described real property is vested in
AGNES FENN, also known as AGNES WILLIAMS, subject to and except
the following:
1. Reservation of mineral lands, except coal and iron lands, as
reserved in United States patent recorded July 9, 1902 at 2:30 P. M. in
Book 201, Page 66, Weld County Records.
2. Reservation of all coal and other minerals and the right to
prospect therefor and remove the same, as set forth in deed of Union
Pacific Railroad Company recorded April 22, 1907 at 11:40 o'clock A. M.
in Book 233, Page 87, Weld County Records.
3. The property is entitled to the benefits and subject to the burdens
by reason of its inclusion in the boundaries of the Northern Colorado
Water Conservancy District.

4. The property is entitled to the benefits and subject to the burdens
by reason of its inclusion in the boundaries of the Nunn Fire Protection
District.
5. The property is entitled to the benefits and subject to the burdens
by reason of its inclusion in the boundaries of the West Greeley Soil Conser-
vation District.
6. Subject to the Weld County Zoning Resolution and all amendments
thereto. Also subject to Weld County Subdivision Regulations and Mobile Home
and Mobile Home Park Regulations and all amendments thereto.
7. Abstract does not certify as to the payment of 1970 taxes. 1971 taxes,
due and payable in 1972, are now a lien.
8. Rights of persons in possession, potential liens by reason of recent
improvments to the premises, if any, and unrecorded easements or rights
of way, if any, may be ascertained by physical inspection of the property.
In my opinion the title as set out above and subject to the foregoing is
good and merchantable.
