The Weld County Board of Health met on October 28, 2025, at 9:00 a.m. in the second-floor hearing
room of the Weld County Department of Public Health and Environment and by via Microsoft
Teams.
Those present included:
Board Members:Tom Cope,Joyce Smock, Anthony Gallardo, Lonnie Ford, Michael Wailes, Linda
Kautz and Bree Lukens.
Others: Katie Sall, Environmental Health Specialist III, Weld County Department of Public Health and
environmert.
Others:Justin Markwardt, CHM Homes Inc representatik,e for the Septic Variance request was
present.
APPROVAL OF AGENDA
The meeting was called to order at 9:00 AM. A motion was made by Joyce Smock to approve the
agenda. Lonnie Ford seconded the motion, and the motion was carried unanimously.
APPROVAL OF MINUTES
The board approved the minutes of the September 28, 2025, meeting. A motion was made to
approve by Tom Cope, Bree Lukens seconded the motio1, and the motion was carried unanimously.
ADMINISTRATIVE REPORT: No report given.
Biosolids Renewal:
Denali Water Solutions—Katie Sall presented 10 biosolid renewal applications.
No public comment or concerns were received. Environmental Health recommends approval.

A motion was made by Lonnie Ford to approval the renewals of Denali water solutions. Joyce
Smock seconded the motion, and the motion was carriec unanimously.

A motion was made by Bree Lukens to approve variance request.Tom Cope seconded the motion,
and the motion was carried unanimously.
PRESENTATIONS: Katie Sall, Environmental Health Specialist III, Weld County Department of Public
Health and environment. Presentation on Chapter 30 OWTS Regulations
Katie presented a slide show of the Chapter 30 OWTS Regulations listed are a few of the changes
she mentioned Weld County required code changes of chapter 30, in March 2025, the Water
Quality Control Commission adopted updates to regulation 43 effective June 15, 2025. Each local
agency will nave up to 12 months (june15, 2026) to adopt updated local regulations consistent with
Regulation 43. Our existing local OWTS regulation will continue to apply until the time when our
local update is adopted.
Our local OWTS regulations (chapter30) must be at least as stringent as Regulation 43.There
continue to be various "opt-in" choices within Regulation 43 that the local board of health (BOCC)
must choose. NOTE:there are three options for develop'ng local regulation. Weld County has
chosen Option 3.
Develop a stand-alone local regulation which includes al requirements of Regulation 43 using a
separate fo-mat. Completion of the "Crosswalk" on pages 5 and 5 and 6 of the local agency
submittal for is required for this method.
Most of the changes to Regulation 43 are minor and serve to clarify and clean up sections of the
code. There are a few major changes to the regulations that will affect Weld County Code.This will
determine what we ask for from the BOCC for code charges.
She mentioned that one of the major changes and top priority for WCHD/EHS is the NDDS(Non-
pressure Drip Dispersal Systems)will now only be allowed in local DINTS programs that have an
operation and maintenance program within their regulations.
A motion was made by Tom Cope to support changes in regulations. Lonnie Ford seconded the
motion, and the motion was carried unanimously.
Meeting was adjourned at 10:06 am. Next meeting is November 25, 2025.
