Bowles number 1 or Bowles reservoir and seepage ditch, the Bowles number 2 or Jack Trail ditch, the Curtis seepage ditch, the West Burlington extension ditch and the West Hudson lateral and the East Burlington extension ditch and the East Hudson lateral , and laterals and connecting ditches between the said lakes. The motion of Commissioner Bolander for the adoption of the above resolution was duly put to vote , and the ayes and noes being celled was unaaim nusly carried, all of the commission- ers voting aye. On motion by E. J. Estes and seconded by P. G. Bolander' duly made, seconded and unanimous- ly carried, it was ordered that the name of said irrigation district shall be and is "THE DENVER-GREELEY VALLEY IRRIGATION DISTRICT. " Upon motion by P . G. Bolander and seconded by E. J . Estes duly' made and seconded and unanimously carried, the following resolutions were adopted, namely: RESOLVED that said irrigation district be divided into three divisions , as follows , to wit : Division number 1 shall comprise all that part of saiddistrict and' the lands embraced therein which are included in said district , which lie south of the south boundaries of sections 27, 28, 29 and 30 , township 2 north of range 65 west , 'ant section 25 , township 2 north of range 66 west . Division number 2 shall comprise all that part of said district and the lands embraced therein which are included in said district , which lie within the following-described boundaries : Beginning at the southeast corner of section 27, T. 2 N R 65 W. ; thence west to the south- west corner of the southeast quarter of the southwest quarter of section 25, T . 2 N R 66 W. ; thence north along the west boundary of the district to the southwest corner of the southeast quarter of the southeast quarter of section 11 , T. 2 N: R 66 W. ; thence east to the quarter corner be- tween sections 7 and 18, T 2. N R 64 W. ; thence south on the east boundary of the district to the southeast corner of Sec . 27, T. 2 N R 65, the point of beginning. Division number 3 shall comprise all that part of said district and the lands embraced therein which are included in said district , which lie north of the north boundaries of section 18 , township 2 N. R. 64 W. ? and sections 13, 14, 15 , 16 , 17 and 18 , T. 2 N R 65 W. , and sections 13 and 14, T. 2N. R. 66W. r 144 RESOLVED FURTHER, that each of the said divisions above described be and are hereby con- stituted a voting precinct for all purposes of said irrigation district as provided by law, and that the polling places within said precinct ter the holding of elections are hereby fixed as follows , to wit : • for precinct 1 , the residence of Edward Jones , situated in the southeast quarter of the south- east quarter of section 32, township 2 north of range 65 west . for precinct 2, the residence of Robert Penix , situated upon the southeast quarter of the southwest quarter of section 30 ) township 2 north of range 65 west . for precinct 3, the residence of Delia C Kinney , situated in the northeast quarter of section 4, township 2 north of range 65 west . Upon motion of Commissioner E. J. Estes , seconded by Commissioner P . G. Bolander , and unanimously carried , the following resolutions was adopted : RESOLVED that the entire prayer of the petition for the organization of said Denver- Greeley Valley Irrigation District be and the same is hereby granted as hereinabove set forth, and as hereinabove modified, and that an election be and is hereby ordered and directed to be held within the said proposed irrigation district and in the ♦erious precincts thereof as above described , for, the purpose of submitting to the vote of the qualified electors the question of the formation, establishment and organization of the said proposed irrigation district , under and by virtue of and in accordance with the law, and the election of a board of directors for Sia district as by law provided; that Saturday the 27th day of February A. D. 1909 is hereby fixed for the holding of said election in the various precincts of said district , and the polls are directed to be opened for that purpose from the hours of seven A. M. of that date con- tinuously until the hour of seven P . M. of the same date ; and be it . FURTHER RESOLVED that the following named persons are appointed for judges of said election, to wit.: precinct number 1 , James F. Jones, Edward Jones and LeRoy Jones. precinct number 2, Frank F. Smith, Bertha A. Smith and Robert Penix. precinct number 3, Delia C. Kinney, Chas. F. Corlew and John Hoback. AND BE IT FURTHER RESOLVED that the following names are hereby submitted to be voted for as directors of said district in the respective precincts , to wit : for division or precinct number 1 James F. Jones ; for division or precinct number 2 Frank F. Smith; for division or precinct number 3 John Hoback. Upon motion of P. G. Bolander and seconded by E. J. The following resolution was unanimously passed and adopted, viz :-- - WHEREAS, on the seventh day of October , 1903 , the Board of County Commissioners of Weld County, Colorado , granted to George J . Spear and his assigns a certain franchise and rights of way over certain public reads and highways in said county for the construction and operation of an electric railway or railways , conditioned that said grantee or his assigns should on or prior to the 31st day of December , 1905 , file with the County Clerk and Recorder of Weld county, Colorado , a map with verified statement designating the particular roads and which side thereof in the territory described in said grant on which a line or lines of electric railway should be constructed and operated; and, WHEREAS, in the month of JAnuary, 1904, The Greeley & Northern Railway & Utility Company was duly incorporated under the laws of the State of Colorado., and is the assignee of said Spear of all his rights and interests in said franchise and rights of way, and, WHEREAS, in due time and on the 28th day of December , 1904, there was filed in the office of the County Clerk and Recorder of said Weld County on behalf of said Tli Greeley & Northern Railway & Utility Company the map and verified statement aforesaid and requi in said original grant ; an; WHEREAS, by sundry amendments and action of the Board of County Q amissioners of said Weld county the time for commencing construction of said railroad and completion of certain amount thereof has been extended; and, HH r: 11: 2 WHEREAS , said The Greeley & Northern Railway & Utility Company, by its President , represents and states to thmyBoard that it has at all times since the granting of said franchise and rights of way made •diligent and active efforts to finance and build an electric railway and now believes that ifogranted a further resonable time it will be able to finance and build such railway and , • WHEREAS , in skid original grant and extensions thereof , no limitation in time was made as to the duration of said grant ; and , WHEREAS , in the judgement of this Board the duration and life of said grant of franchise and rights of way should be limited to twenty years from this date ; and , , WHEREAt acid The Greeley & Northern Railway & Utility Company has offered in eansideration of the further extention of time for }ommencing construction and conpletion of said railroad here- in permitted and allowed, that the life of said grant and franchise be limited to twenty years and by accepting the extension of time herein allowed expressly consents to the limitation of a said grant and franchise for a period of twenty years from this date ; NOW, in consideration of the premises , BE IT RESOLVED, that the franchise and grant of rights of way over public roads and high- ways heretofore granted by Board of County Commies oners of Weld County, Colorado , is hereby him- ited to twehty years from this date and no longer , which limitation as to time is hereby express- ly ace opted by the Greeley & Northern Railway & Utility Company, assignee of said George J. The means proposed to supply water for the irrigation of the lands embraced in said irriga- tion district are as follows: r -4 r ' 165 The District shall acquire by purshase and all ether lawful means appropriation rights to water from Laramie river, McIntyre , Rawah, Spring/ Rapid, Fall , Mill , West Fork, East Fork, Half Mile, Brinker , Porter , Nunn and Deadman creeks, Michigan, Cache la Poudre and Noth Poudre rivers , Dry Creek , Indian , Box Elder , Coal Bank, Lone Tree , Owl, Robinson, Eastman, Coal, Sand and Crow creeks and all tributaries of said rivers, creeks and streams ,and other sources of water supply, and by a aystem of dams , tunnels, ditches and water works shall divert waters from said sources and other sources of supply for direct application and storage in a system of reservoirs to be acquired , enlarged and constructed both in the beds and channels of said streams and in basins and sites re- mote threrfrom, and among others in the Larimer River°Reservoir Link Lakes , East Fork, Tunnel Reservoir , Pan Handle , Mitchell Lakes , Douglas Lake , North Poudre Reservoirs Nos . 5, 6 , 7 and 9, Cobb Lake , County Line Reservoir , Me Grew Lake or Eastman and other Sites , Basins and Reservoirs to be acquired and constructed in such manner as to permit of the storage of the waters obtainable from the sources of supply of said district therein, and the discharge therefrom of said impounded waters into a system of distributing - tunnels , canals and laterals to be acquired and constructed and thereby distributed to the lands of the district ; and also to purchase , construct and acquire by all other lawful means and to thereafter operate , control and maintain for the use and benefit of said district , such other canals , conduits , tunnels , ditches , laterals , dams , embankments, reservoirs , basins, reservoir sites , easements , privileges , devices, waterways , water rights and water works as may be necessary for the use of said district in order to secure therefore , a system of irrigation works and water rights necessary, proper and sufficient to afford to all the irriga- ble , arable lands of said district a full and adequate water supply for the necessary and proper irrigation of same . district 5 . The irrigation^above described is formed for the further purpose of purchasing, acquiring, enlarging, leasing or renting all or any part of the Poudre Valley Canal, Pierce Lateral or any other ditch or ditches, Water rights or Water works that may be necessary or advantageous to said district and its water consumers . 6 . Thereupon the board on further examination of said petition and after the introduction of eviden ee both oral and documentary did find and determine and declare that said petition for the formation of an irrigation district has been signed by the requisite number of petitioners as by law required and that said petition is signed by a majority of the resident free-holders within said proposed _ The Greeley -Poudre Irrigation di strict . who are the owners in the aggregate of a majority of the whole number of acres belonging 10 the resident free-holders within said proposed irrigation die- , trict and do find and determinine that all a nd singular the recitals and averments of skid petition are true, and said board did then and there on motion duly made , seconded and carried proceed to define and establish the boundaries of said proposed irrigation district , and proceed to and did hear all applications for the exclusions of lands therefrom, and inclusions of lands therein. Thereupon, Calvin J.McMullen, claiming to be the owner of the lands hereinafter described, pre- sented a petition praying that said lands be excluded from said district in the formation thereof, . , upon the ground averred in said petition, that said lands are already sufficiently supplied with water , and that the owner of said lands is now possessed of sufficient water to supply the full irrigation needs of said lands, and that said lands would not be benefitted by the irrigation works proposed to be secured for said district , to-wit : - All that part of the NOrtheast quarter of Section 22, Township B, NOrth, Range 66 West , which lies east of the west line of the right of way of the Union Pacific Railroad. Thereupon the Board proceeded to consider said petition and evidence pertinent thereto , and found the recitals and averments thereof to be true , and upon motion duly made , seconded and carried it was ordered by the Board that the above described lands of said CalvincTMc Mullen be exculded from said district and that the boundaries of said district as set forth in said petition and as rr 172 prayed to be established, be so mofified as to exclude from said district the lands above described . Thereupon Samuel H. Southard, presented a petition to the Board in which it was averred that said Samuel H. Southard was owner. of certain lands described in said petition, and praying that said land be excluded from said district in the formation and establishment thereof, upon the ground averred in said petition, that said lands are already sufficiently supplied with water for the full and prop- er irrigation thereof, and that said owner of said lands is now possessed of right to sufficient wa- ter to supply the full irrigation needs of said lands and all thereof, and that said lands would not he benefitted by the irrigation works, proposed to be secured for said district , to-wit : - All of sections 9, 17 and 21 in Township 8, NOrth Range 66 West . Thereupon the Board proceeded to and did consider said petition and application for exclusion of lands from said district , - and evidence pertinent thereto, and found the said petition to be in all particulars regular , and recitals and averments thereof to be true , and it was then and there on motion duly carried , ordered by the Board that the above described lands be excluded from said proposed irrigation district and that the boundaries of said district as set forth in said petition for the establishment thereof be so modified as to exclude said lands and all thereof from said irrigation district . WHEREUPON, Commissioner R.W.Devinny moved the adoption of the following resolutions , findings , recitals and orders for the consideration and final action of the board in the premises . WHEREAS. a petition has been duly presented, signed by George M, Eastlack and other freeholders of the ° unty of Weld, in the State of Colorado , stating that it is the purpose of the petitioners L. • 1771 to organize an irrigation - district in accordance with law, containing a general description of the boundaries of such proposed di strict and all and singular the averments by law provided and requi- red, and praying that this . Board define and establish the boundaries of said irrigation district , which it is prayed in said petition shall be known as THE GREELEY-POUDRE IRRIGATION DISTRICT, and submit the question of the organization of the same to the vote of the legally qualified electors of said proposed irrigation district , duly signed by the requisite number of resident freeholders r who are owners in the aggregate of a majority of the whole number of acres belonging to resident freeholders of said proposed irrigation district ; and WHEREAS . the said petition has been found and is hereby found to be in due and regular form;that the law has been in all respects complied with in the filing, 'publishing notice , presentation and allowance of said petition; that said district is entirely in the County of Weld in the State of Color ado ; that a bond has been duly filed and approved by this Board, providing for the payment of expenses of the proceedings and the election, in case the ' district shall not be established; and that all and singular the recitals and averments of said petition are true ; and WHEREAS, sundry changes in the boundaries of said district have been made by this Board by the exclusion of certain lands embraced therein; and 'the inclusion in said district of certain lands not embraced within the boundaries of staid district as prayed in said ' petition; and, WHEREAS, it has been shown to the satisfaction of this board that all matters ` embraced in said petition and all the objections thereto , together with all the petitions for the exclusion of lands from said district , or the inclusion of lands within the same and all other matters and things proper ' to be considered by said Board pertinent to said petition, having been duly considered and determined as preliminary to the fixing and establishment of said proposed irrigation district and the boundaries thereof; that in the opinion of the Board, all lands within said boundaries , '' as modified herein, are susceptible to irrigation by the irrigation works sought to be obtained and constructed by said district . D. 1909 were canvassed and counted , from which it was found that nine (9 ) votes were marked "IRRIGATION DISTRICT-YES" and none of said votes were marked "IRRIGATION DISTRICT-NO" , from whieh it appeared to the board and was found by the said board that the majority of all the resident freeholds ere who are legal electors in said proposed district and have paid property taxes in the last year preceding said election have voted and did vote " IRRIGATION DISTRICT-YES" ; and thereupon the boards proceeding to canvass the votes east in said district for directors , found the following results : For director :: in and for division number 1 , James F. Thence extending north on said center line to the intersection with the south line, of right of way of the Union Pacific Railroad Company ( known as the line east from Greeley) .
