QUESTION
Upon the replat of a single block in an existing subdivision where no
changes in roads or streets are shown and the only reason for the
replat is to decrease the lot sizes, should the Board of County
Commissioners require the person replatting to dedicate land for
park purposes or in the alternative pay an equivalent sum in cash
to be utilized for park purposes when the original subdivision
was approved and recorded prior to the existing requirements?
ANSWER
NO,
My opinion is based upon the above stated question wherein the original
subdivision was approved and recorded prior to the implementation of
the existing regulations which now require dedication of land or in the
alternative the payment of money to be utilized for park purposes.
Further, in the question as posed there is no alteration of the street or
road plan and no additional acreage is involved.
