RESOLUTION
WHEREAS, on or about June 24 , 1970, Moore Realty Company,
as owners, entered into an agreement with Weld County, Colorado,
whereby the owners agreed to construct Cactus Drive, Yucca Court,
and Suguaro Court in accordance with Weld County road specifications
all as contained in that certain agreement dated June 24, 1970,
copy of which is attached hereto for ready reference, and
WHEREAS, in order to comply with the agreement to build
Cactus Drive, Yucca Court, and Suguaro Court, the owners signed
and delivered to the Board of Weld County Commissioners a
Contract Bond #1608696 dated June 24, 1970, in the sum of
$10, 500. 00 guaranteeing that the said roads would be built in
accordance with the specifications and in accordance with the
aforementioned agreement, and
WHEREAS, it has now come to the attention of the Board that
the owners have completed the work pursuant to the agreement and
in accordance with the specifications as contained therein and
now wish to have the aforementioned bond cancelled and returned,
and
WHEREAS, the Board has determined that the owners have
fulfilled their agreement with regard to building the said roads
and its subsequent acceptance by the County of Weld for maintenance.
NOW, THEREFORE, BE IT RESOLVED, by the Board, and it
hereby orders and authorizes that the aforementioned bond dated
June 24, 1970 , in the sum of $10, 500. 00, be marked cancelled and
that same shall be returned to the owners pursuant to the
agreement.
