Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS GENERAL PROJECT INFORMATION/LOCATION Project description: A Site -Specific Development Plan and Use by Special Review Permit for buildings exceeding the maximum building coverage for all structures ten percent (10%) in a subdivision in the A (Agricultural) Zone District. This project is south of and adjacent to 14th Street and is east of Denver Avenue in Fort Lupton. Parcel number: 130932301003. Access is onto 14th Street in Fort Lupton. ACCESS Development Review has reviewed the application materials related to access. The applicant has existing access onto 14th Street. This portion of 14th Street is under the jurisdiction of the Town of Fort Lupton. The applicant shall contact the Town concerning access. ROADS AND RIGHTS -OF -WAY This portion of Road 14th Street is under the jurisdiction of the Town of Fort Lupton. The municipality has jurisdiction over access to the road. The applicant shall delineate on the plat the future and existing right- of-way and the physical location of the road. Pursuant to the definition of setback in the Weld County Code Sec. 23-1-90, the required setback is measured from the future right-of-way line. Be aware that physical roadways may not be centered in the right-of-way. Please contact the municipality to verify the access permit or for any additional requirements that may be needed to obtain or upgrade the permit. DRAINAGE REQUIREMENTS This area IS within an Urbanizing Drainage Area: Urbanizing Drainage Areas typically require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 5 -year storm falling on the undeveloped site for URBANIZING areas. The applicant shall submit a drainage narrative that includes an acceptable stormwater detention exception. The narrative shall also acknowledge that the parcel is in an MS4 area and that future activity may trigger MS4 requirements. Historic Flows: The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from the property. MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4) This site is located in a Municipal Separate Storm Sewer System (MS4) Area which may trigger specific water quality requirements or other drainage improvements. In addition to compliance with applicable Weld County regulations, property owner is required to be compliant with any additional MS4 requirements. Currently, no MS4 requirements have been triggered on this parcel. Questions pertaining to the MS4 requirements should be directed to the Public Works Department 970- 400-3788. CONDITIONS OF APPROVAL A. A Final Drainage Narrative, that acknowledges MS4, is required. (Development Review) B. The USR map shall be amended to delineate the following: 1. This portion of 14th Street is under the jurisdiction of the Town of Fort Lupton. Please contact the municipality to verify the right-of-way. Show and label the right-of-way. Show the approved access(es) on the site plan and label with the approved access permit number if applicable. (Development Review) 2. Show and label the existing access location onto14th Street. (Development Review) 3. Show and label drainage flow arrows. (Development Review) DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN) 1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Development Review) 2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages and/or off -site tracking. (Development Review) 3. This site is located in the MS4 area and is subject to the regulations of the state -issued MS4 Permit. (Development Review) 4. The historical flow patterns and runoff amounts on the site will be maintained. (Development Review) Weld County Department of Public Health and Environment Memorandum To: Kim Ogle From: Lauren Light, Environmental Health Services Date: August 22, 2022 Re: USR22-0023 Applicant: Antonio Trujillo-Batalla and Ma Erika Guadarrama Environmental Health Services has reviewed this proposal for a Site -Specific Development Plan and Use by Special Review to exceed the maximum allowed building coverage in the A (Agricultural) Zone District. The existing residence is served by an individual well for water service (187713) and an on -site wastewater treatment system (OWTS) permitted for 3 bedrooms (G19681007). It appears the OWTS is located to the east of the residence and is not in the vicinity of the garage. We recommend that the following requirement be incorporated into the permit as a development standard: 1. All structures must meet the required setbacks from the existing On -site Wastewater Treatment System in compliance with provisions of the Weld County Code, pertaining to On -site Wastewater Treatment Systems. 1555 N. 17th Avenue Greeley, CO 80631 Phone: (970) 304-6410 weldhealth.org Public Health MEMORANDUM • To: Kim Ogle, Principal Planner From: Bethany Pascoe, Code Compliance Officer II Subject: USR22-0023 Referral August 11, 2022 Upon review of my case files and computer, an active Code Violation (ZCV22-00055) was noted. This violation was initiated due to the addition of multiple structures without first obtaining the required building and/or land use permits. Due to the addition of these structures, the property is in violation for exceeding of the maximum amount of lot coverage without a Use by Special Review (USR) permit. This case has NOT been forwarded to the County Attorney's Office; therefore, an investigation fee is not required. Due to records release laws, staff no longer tracks complainant information, but please be aware it is staff's policy to no longer accept staff -initiated complaints without there being a safety component to the complaint. If this application is approved and the final (USR) map is recorded, as well as building permit applications have been completed and submitted to this office and once the permits are finaled, the Code Violation (ZCV22-00055) would be closed. If this application is denied, any structures exceeding the maximum lot coverage of 11.4% would need to be removed and any remaining structures permitted, the case (ZCV22-00055) would proceed accordingly through the County Court process.
