WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Application for the Energy and Mineral
Impact Assistance Program Grant for the County Roads 66 and 41 Intersection Improvements
Project (Tier II - March Cycle) between the County of Weld, State of Colorado, by and through
the Board of County Commissioners of Weld County, on behalf of the Department of Public
Works, and the Colorado Department of Local Affairs (DOLA), commencing upon full execution
of signatures, with further terms and conditions being as stated in said application, and
WHEREAS, after review, the Board deems it advisable to approve said application, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Application for the Energy and Mineral Impact Assistance
Program Grant for the County Roads 66 and 41 Intersection Improvements Project (Tier II - March
Cycle) between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Public Works, and the Colorado
Department of Local Affairs (DOLA), be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that Elizabeth Relford, Deputy Director of the
Department of Public Works be, and hereby is, authorized to electronically submit said
application.

SUBJECT: DOLA Application -2022 March Cycle
In accordance with the work session held on February 16, 2022, Public Works is
requesting the Commissioners submit one Tier 2 Energy and Mineral Impact Assistance
Fund (EIAF) grant to the Department of Local Affairs (DOLA) for the 2022 March cycle.
This grant request is for a Tier 2 - $750,000 application for Weld County Road (WCR) 66
and WCR 41 intersection improvements. The total construction budget is estimated to be
$8,000,000. If awarded and upon contract approval, Public Works will follow our
procurement process and competitively bid construction of the project this summer.
Construction is anticipated to begin in November with completion before the end of 2023.
Staff recommends Board approval to submit this application to DOLA by the March 1st
deadline. I am available to answer any questions you may have.

At the Public Works CIP on October 13, 2021, the Board stated they wanted a separate work session to
discuss projects to be submitted for the next DOLA cycle. The purpose of this work session is to
identify a project to submit in the March cycle. DOLA has $15,000,000 available in this next round
and applications are due on March 1, 2022.
Similar to the last cycle, DOLA does not want us to submit applications in both the Tier I and Tier II
cycles. Therefore, Public Works recommends submitting a Tier II application for the WCR 66/41
Intersection Improvements. The project estimate is approximately $7,559,250.
Options for the board:
1. Put the DOLA applications on the BOCC agenda before March 1, 2022.
2. Recommend other projects.
3. Submit a Tier I application instead of a Tier II.

The Department of Local Affairs' (DOLA) Energy and Mineral Impact Assistance Fund (EIAF) program was created to assist political
subdivisions that are socially and/or economically impacted by the development, processing, or energy conversion of minerals and mineral
fuels. Funds come from the state severance tax on energy and mineral production and from a portion of the state's share of royalties paid to
the federal government for mining and drilling of minerals and mineral fuels on federally -owned land. The creation of the fund is outlined in
C.R.S. 34-63-102 (Federal Mineral Lease) and C.R.S. 39-29-110 (Severance). Grant dollars are to be awarded for the planning, design,
construction, and maintenance of public facilities and for the provision of services by political subdivisions.
Requests in this Cycle 22-06 may be for either Tier I: up to $200,000 or Tier II: over $200,000 and up to $750,000 with a 1:1 match
requirement for any application. Tier I award notifications are anticipated early May. Tier II applicant presentations are scheduled for early

Weld County requests funding to partner with DOLA on the construction of safety improvements at the intersection of WCR 66 and
WCR 41 intersection. This project has experienced increased broadside crashes in the last five years and with the closure of the
Union Pacific Railroad (UPRR) crossing at O Street this year, we anticipate increased truck traffic using this intersection.

Weld County will contract the construction improvements for this unsafe and substandard intersection. WCR 66 is an arterial corridor
that connects the County Highway and US 85. With the increased traffic to the region, CDOT is planning on adding a traffic signal at
US 85 and WCR 66. Between CDOT and Weld County's safety improvements this corridor would be significantly safer for the traveling
public.

Why is the project needed at this time? (2,500 character limit)
WCR 66 is an important arterial corridor linking the County Highway and US 85. This east/west corridor is busy due to an oil and gas
terminal and midstream facility along the corridor. In addition, with the closing of the O Street railroad crossing, we anticipate
additional truck traffic needing to use this intersection, which is why widening of the intersection is needed to better accommodate
heavy duty vehicles without impeding existing travel lanes.

Does this project, as identified in this application, completely address the stated need? If not, please describe additional work or
phases and the estimated timeframe. Do you anticipate requesting Energy and Mineral Impact Assistance funds for future phases?

Yes, the completion of this project will completely address the safety need. This intersection will be better equipped to safely
handle truck traffic that is currently turning into oncoming traffic when performing turning movements. Weld County received DOLA
funding for the design of this intersection and upon completion of the construction project, Weld County will not be requesting
additional funding for this location.

Does the project duplicate service capacity that exists at this time? Does it expand, enhance or leverage work being done on other

This project does not duplicate service capacity, but improves safety adjacent to other agency's roadway networks to enhance and
leverage other work simultaneously occurring.

If funding is not awarded, Weld County will figure out a way to get this safety project completed. However, we would hope DOLA
would see the value of this important safety project, which directly affects the oil and gas industry.
E. MEASURABLE OUTCOMES
a. Describe the expected measurable outcomes
How will the project enhance the livability* of your region, county, city, town or community? Examples would include constructing a
new water plant to eliminate an unsafe drinking water system and provide safe and reliable drinking water; the construction of a
new community center that would provide expanded community services, or projects achieving goals regarding energy conservation,
community heritage, economic development/diversification, traffic congestion, etc.

The intersection improvements will enhance the increased traffic and better serve the two nearby oil and gas midstream facilities
and crude oil terminal. It will provide safe travel for oil/gas hauling, school buses, emergency vehicles and the traveling public, and
add years of life to the existing roadway because it will be constructed in concrete rather than asphalt.

Will this project implement an energy efficiency/strategy that could result in a reduction of the community carbon footprint,
increased conservation of energy, or does it capitalize on renewable energy technology? If yes, please describe. (2,500 character

Yes, Public Works will require the use of the recycled asphalt to be used as part of the subgrade for the concrete. In addition, an
existing oil and gas well will be capped and abandoned to accommodate the intersection widening footprint.

Anyone utilizing this intersection will appreciate this safety investment. This road is an important arterial corridor and WCR 41 is a
local road that parallels US 85 connecting to East Greeley. This area contains many agricultural farms and oil and gas businesses and
they are aware of the safety issues and have expressed their support for this project.

consists of industry partners discussing impacts affecting everyone and problem solves how we can all work together to minimize or

This project bisects the floodplain and we have obtained the approved no rise certificate from our Floodplain Administrator. No
other permits are required for us to proceed with bidding the project.

Weld County is the #1 producing oil and gas county in the entire state and is therefore, extremely impacted. Much of the road traffic
and deterioration is due to heavy duty oil and gas trucks. Relocation of existing oil and gas facilities will occur with this project. In
addition, oil and gas traffic utilizes this corridor to access existing midstream facilities and a crude terminal.
b. Use data
Cite actual use data that documents direct impact as it relates to the need for the project. For example: "heavy truck traffic directly
related to energy development activities is impacting County Road X. A traffic count done in May 2021 showed energy -related truck
traffic increased from 100 trips per day to 300", or "there are X number of oil and gas wells, storage facilities, transfer stations, miles of
pipeline in the municipal or county boundaries." (2,500 character limit)
WCR 66 an arterial road with current traffic volumes at 667 vehicles per day (vpd) with 28% truck traffic. This count was taken on
9/28/2018. WCR 41 is a local road with a traffic count of 1,222 AADT taken on 7/9/2021 and has 21% truck traffic.
I. MANAGEMENT CAPACITY —
a. Fund management
How will you separate and track expenditures, maintain funds and reserves for the capital expenditures and improvements as

Weld County's Accounting Department is recognized as a Tier 3 local government by the State and can manage all invoicing
information through the Banner Accounting System. In addition, Public Works will use the project management software PubWorks to
assist in tracking and administering the grant.
b. Project management
Describe the technical and professional experience/expertise of the person(s) and/or professional firms responsible to manage this
project, including knowledge and application of best design and management practices. (2,000 character limit)
Horrocks Engineering performed the design and engineer's estimate, which was reviewed and approved by Public Works Engineers.
Weld County Public works has several engineers on staff with proven expertise in roadway improvement projects. Chris D'Ovidio is
the point of contact for this grant and Elizabeth Relford will be responsible for managing and tracking the construction project.
c. Project life cycle

This intersection is being constructed in concrete to extend the maintenance life of the intersection. When maintenance is needed,
Weld County will utilize our HUTF funding to maintain this intersection.

The Energy and Mineral Impact Assistance Program is required to integrate resilience criteria into the program. By bringing resiliency
considerations into project planning and implementation, projects should be better poised to benefit a number of sectors (economy, health,
infrastructure, etc.), minimize long-term risks, and anticipate or be better prepared to respond to changing conditions faced by Colorado
communities.
The 2020 Colorado Resiliency Framework provides nine Resiliency Prioritization Criteria that can serve as a guide when planning a project
to enhance its long-term resilience. More information on the Resiliency Prioritization Criteria can be found at www.coresiliency.com. Below,

future when the corridor is widened in this location so that other projects would align with this one.

K. HIGH PERFORMANCE CERTIFICATION PROGRAM (HPCP) COMPLIANCE
Colorado Revised Statutes (C.R.S. 24-30-1305.5) requires all new facilities, additions, and renovation projects that meet the following criteria
to conform with the High Performance Certification Program (HPCP) policy adopted by the Office of the State Architect (OSA) if:
• The project receives 25% or more of state funds; and
• The new facility, addition, or renovation project contains 5,000 or more building gross square feet; and
• The building includes or will include an HVAC system; and
• In the case of a renovation project, the cost of the renovation exceeds 25% of the current value of the property.
The HPCP requires projects that meet the criteria above to achieve third party verification with the target goal of LEED Gold or Green
Globes -Three Globes. Projects are strongly encouraged to meet the Office of the State Architect's (OSA) Sustainable Priorities in addition to
the LEED prerequisites. Projects funded through DOLA that meet the above applicability criteria are required to complete the DOLA

performance-certification-program for more information or contact your DOLA Regional Manager.
In instances where achievement of LEED Gold or Green Globe -Three Globes certification is not achievable, an applicant may request a
modification of the HPCP policy or a waiver if certain conditions exist. DOLA staff will work with applicants to identify workable solutions to
meet the program's intent to maximize building energy efficiencies.

Request Floodplain Development Permit — FHDP21-0028 — Intersection improvements
(Intersection of CR 41 and CR 66)
As a participant in FEMA's National Flood Insurance Program (NFIP), Weld County is required
by FEMA to ensure that all development (as defined by FEMA) in a designated 100 -year floodplain
or floodway is compliant with FEMA, Colorado Water Conservation Board, and Weld County
floodplain regulations (Chapter 23, Article XI) The intent of the Weld County floodplain regulations
is to promote public health, safety and general welfare and to minimize public and private losses
due to flood conditions Failure to comply with the General and Specific Standards listed in Article
XI of the Weld County Code and conditions listed in this FHDP may result in a violation case being
brought before the Weld County Board of County Commissioners and potential fines
Based application materials and the review of the current effective data this Floodplain permit
(FHDP21-0028) is approved with the following conditions
1 The applicant shall ensure that the site remains in compliance with FEMA, Colorado Water
Conservation Board, and Weld County floodplain regulations (Chapter 23, Article XI) at all
times
2 If fill material is used in the floodplain, a registered Colorado Professional Engineer shall
certify that the fill material is designed to withstand the erosional forces associated with
the base flood
3 Outside storage of floatable materials associated with non-agricultural uses shall not be
allowed Materials that are not floatable can be stored outside provided that a floodplain
development permit is obtained
4 At conclusion of construction, a LOMR will be required Documentation shall be submitted
to the Department of Planning Services within six (6) month of project completion

Weld County Public Works is requesting a floodplain permit for intersection improvements at
County Road 41 and County Road 66. The roadway improvements will widen and raise the road
and, therefore, change the BEE. A Letter of Map Revision (LOMR) is required upon completion
