HomeMy WebLinkAbout20221601.tiffHEARING CERTIFICATION DOCKET NO. 2022-61.B RE: PROBABLE CAUSE HEARING, PCSC22-0011, TO CONSIDER SETTING A SHOW CAUSE HEARING TO DETERMINE WHETHER OR NOT THE PERMITTEE IS IN COMPLIANCE WITH CERTAIN DEVELOPMENT STANDARDS, FOR SITE SPECIFIC DEVELOPOMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR-895, FOR A SOLID WASTE DISPOSAL SITE AND FACILITY, AND USR18-0065, FOR A SOLID WASTE DISPOSAL SITE AND FACILITIES, IN THE A (AGRICULTURAL) ZONE DISTRICT - WASTE MANAGEMENT DISPOSAL SERVICES OF COLORADO, INC. A public hearing was conducted on August 31, 2022, at 9:00 a.m., with the following present: Commissioner Scott K. James, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Perry L. Buck Commissioner Steve Moreno Commissioner Lori Saine Also present: Acting Clerk to the Board, Jess Reid County Attorney, Bruce Barker Planning Services Department representative, Kim Ogle The following business was transacted: A public Probable Cause hearing, PCSC22-0011, was conducted on June 20, 2022, to consider setting a Show Cause Hearing to determine whether or not the permittee, Waste Management Disposal Services of Colorado, Inc., was in compliance with certain Development Standards contained in Use by Special Review Permit, USR-895, for a Solid Waste Disposal Site and Facility, and USR18-0065, for a Solid Waste Disposal Site and Facilities, in the A (Agricultural) Zone District. At said hearing the Board continued the matter to August 31, 2022, to allow Waste Management Disposal Services of Colorado, Inc., time to come into compliance with certain Development Standards. Bruce Barker, County Attorney, made this a matter of record. Kim Ogle, Department of Planning Services, presented a summary of the progress the permittee has made since the hearing on June 20, 2022, to obtain compliance and displayed images from site visits in April, June and August of 2022. He stated the permittees are still not in compliance with Development Standard (DS) #30 (maintain approved Landscape Plan) for USR-895, and DS #7 (on -site fencing shall be maintained) for USR18-0065, but noted the permittee has submitted plans of how they will obtain compliance. El Chris Anderson, Disposal Manager, represented the permittee, explained the improvements they have made on the site, described the plans for additional improvements with regard to the fence and landscaping, and mentioned the site has a new District Manager. (PCSC22-0011) PAGE 2 Freeman stated he lives near the site and commended Waste Management for the work they have done to clean it up. El Commissioner Freeman moved to dismiss Probable Cause hearing, PCSC22-0011, for Use by Special Review Permit, USR-895, for a Solid Waste Disposal Site and Facility, and USR18-0065, for a Solid Waste Disposal Site and Facilities, in the A (Agricultural) Zone District, held by Waste Management Disposal Services of Colorado, Inc. The motion was seconded by Commissioner Saine, and it carried unanimously. There being no further discussion, the hearing was completed at 12:15 p.m. This Certification was approved on the 14th day of September, 2022.
