HomeMy WebLinkAbout720636.tiff PaN —i 3- c w yc . - R FINDINGS AND RESOLUTION CONCERNING CHANGE OF ZONE PETITION OF NELSON, HALEY, PATTERSON & QUIRK The petition of Nelson, Haley, Patterson & Quirk, Weld County, Colorado, requesting a change of zone from "R" Residential District to "H" High Density Unit Development of a parcel of land more particular described as follows, to-wit: A tract of land located in HIGHLAND HILLS SUBDIVISION as recorded in the records of Weld County, Colorado, and being part of the North Half (NZ) of Section 15, Township 5 North, Range 66 West of the Sixth Principal Meridian, Weld County, Colorado shown on recorded plat as parcel "B" and being more particularly described as follows: Commencing at the Northwest Corner (NWCor) of said Section 15, and considering the North line of the Northwest Quarter of the Northwest Quarter (NW4NWg) of said Section 15 to bear North 88° 08'30" East and with all bearings contained herein being relative thereto: Thence North 88° 08' 30" East, along the North Line of said Section 15, a distance of 1823. 12 feet; Thence South 89° 57' 30" East, along the North Line of said Section 15, 801. 40 feet to the True Point of Beginning; Thence con- tinuing South 89° 57' 30" East, along the North Line of said Section 15, 521. 55 feet. The evidence discloses that the applicants failed to sustain the burden of proof as to the need for change of zone, or that the present zone is erroneous or that circumstances warrant a change of zone at this time. 720636 �-/ 9A' ,95'3 1 ^ � R 2. The evidence discloses that the present zoning is complimen- tary to the surrounding area. 3. Investigation shows that the inhabitants of the immediate vicinity of the area sought to be rezoned are unanimously opposed to the change of zone. 4. That each of the preceding findings in and of themselves, and independent of each other, constitutes a separate and individual ground for denial of the change of zone. RESOLUTION WHEREAS, the Board of County Commissioners of the County of Weld has heard the application of Nelson, Haley, Patterson and Quirk, Weld County, Colorado, for change of zone from "R" Residential District to "H" High Density Unit Development of said parcel of land as hereinabove recited and made a part hereof by reference, and WHEREAS, said Board has made its findings on the evidence and testimony submitted to it, which findings precede this Resolution and by reference are incorporated herein and made a part hereof, and WHEREAS, said Board has carefully considered the petition, evidence and testimony and the recommendations of the Weld County Planning Commission, and has made an investigation of the area, and given the same such weight as it in its discretion deems proper, and is now fully advised in the premises; NOW, THEREFORE, BE IT RESOLVED, that the petition of Nelson, Haley, Patterson and Quirk, Weld County, Colorado, requesting a change of zone from "R" Residential District to "H" High Density Unit Development of the parcel of land indicated above be, and it hereby is denied upon each of the grounds set forth in the Board's findings therein. The Highland Hills Official Development Plan, as prepared by our firm, contains approximately 24,4 acres. Our Preliminary Drainage Study shows that the site will be divided into three separate drainage areas upon completion of the street and lot grading as shown on Exhibit "A". Storm water runoff from Area "A" will flow in an easterly direction and will be routed through the lots and streets to 50th Avenue where it will follow the existing drainage pattern north along 50th Avenue and east to the West Grapevine Laterial ditch. Area "B" drains in a northwesterly direction toward the intersection of 20th Street and the proposed West 20th Street Road. At this point, there are two alternatives to off-site drainage. Alternate "A" would route the storm water along 20th Street and into the east branch of Sheepdraw. Alternate "B" would be to route the water north along the entrance road to Aims College and into the West Grapevine Lateral ditch of into the West Greeley Drainage System along 16th Street. Area "C11 will drain in a westerly direction onto Clubhouse Drive where it drains South to Highland Hills Golf Course and ultimately to the irrigation reservoir. It should be noted that this is a preliminary study and indicates only the basic drainage pattern of the proposed site. The quantities involved and the improvements required will be established in a final drainage study of this site.
