FINDINGS AND RESOLUTION
CONCERNING CHANGE OF ZONE
PETITION OF NELSON, HALEY, PATTERSON & QUIRK
The petition of Nelson, Haley, Patterson & Quirk, Weld County,
Colorado, requesting a change of zone from "R" Residential District to
"H" High Density Unit Development of a parcel of land more particular
described as follows, to-wit:
A tract of land located in HIGHLAND HILLS SUBDIVISION
as recorded in the records of Weld County, Colorado, and
being part of the North Half (NZ) of Section 15, Township
5 North, Range 66 West of the Sixth Principal Meridian,
Weld County, Colorado shown on recorded plat as parcel
"B" and being more particularly described as follows:
Commencing at the Northwest Corner (NWCor) of said
Section 15, and considering the North line of the Northwest
Quarter of the Northwest Quarter (NW4NWg) of said
Section 15 to bear North 88° 08'30" East and with all
bearings contained herein being relative thereto: Thence
North 88° 08' 30" East, along the North Line of said
Section 15, a distance of 1823. 12 feet; Thence South 89°
57' 30" East, along the North Line of said Section 15,
801. 40 feet to the True Point of Beginning; Thence con-
tinuing South 89° 57' 30" East, along the North Line of
said Section 15, 521. 55 feet. Thence South 89° 25' 30"
East, along the North Line of said Section 15, 86. 91 feet;
Thence South 00° 53' 40" West, 210. 56 feet; Thence North
89° 06' 20" West 170. 00 feet; Thence South 13° 00' 00"
West, 237. 92 feet; Thence South 77° 00' 00" East, 126. 10
feet; Thence along the arc of a circular curve to the right
having a radius of 455. 79 feet and a long chord that bears
South 72° 37' 50" East, 69. 45 feet; Thence South 40° 01'
43" West, 63. 72 feet; Thence South 12° 58' 30" West
147. 97 feet; Thence North 77° 00' 00" West, 564. 00 feet;
Thence North 13° 00' 00" East, 70. 00 feet; Thence North
28O 16' 51" West 189. 04 feet; Thence along the arc of a
circular curve to the left having a radius of 240. 73 feet
and a long chord that bears North 30° 52' 53" East, 246. 81
feet; Thence North 00° 02' 30" East 109. 66 feet to the
True Point of Beginning, containing 7. 865 acres, more or
less,
all as appears on plat as submitted and made a part hereof by reference,
came on for hearing on June 30, 1972, and the Board of County
Commissioners of the County of Weld, having heard the testimony and
evidence adduced upon said hearing, and having heard the testimony,
evidence and recommendations of the Weld County Planning Commission
filed with said Board, and having carefully weighed the same, now makes
the following findings:
1. The evidence discloses that the applicants failed to sustain
the burden of proof as to the need for change of zone, or that the present
zone is erroneous or that circumstances warrant a change of zone at
this time.

2. The evidence discloses that the present zoning is complimen-
tary to the surrounding area.
3. Investigation shows that the inhabitants of the immediate
vicinity of the area sought to be rezoned are unanimously opposed to
the change of zone.
4. That each of the preceding findings in and of themselves, and
independent of each other, constitutes a separate and individual ground
for denial of the change of zone.
RESOLUTION
WHEREAS, the Board of County Commissioners of the County of
Weld has heard the application of Nelson, Haley, Patterson and Quirk,
Weld County, Colorado, for change of zone from "R" Residential District
to "H" High Density Unit Development of said parcel of land as hereinabove
recited and made a part hereof by reference, and
WHEREAS, said Board has made its findings on the evidence and
testimony submitted to it, which findings precede this Resolution and by
reference are incorporated herein and made a part hereof, and
WHEREAS, said Board has carefully considered the petition,
evidence and testimony and the recommendations of the Weld County
Planning Commission, and has made an investigation of the area, and
given the same such weight as it in its discretion deems proper, and
is now fully advised in the premises;
NOW, THEREFORE, BE IT RESOLVED, that the petition of
Nelson, Haley, Patterson and Quirk, Weld County, Colorado, requesting
a change of zone from "R" Residential District to "H" High Density Unit
Development of the parcel of land indicated above be, and it hereby is
denied upon each of the grounds set forth in the Board's findings therein.
Made and entered this 19 day of July, 1972.

We have been requested by Mr. Roy Lundvall to prepare a preliminary drainage
study for the proposed Highland Hills Planned Unit Development located in
the North Half of Section 15, Township 5 North, Range 66 West of the Sixth
Principal Meridian, Weld County, Colorado. The Highland Hills Official
Development Plan, as prepared by our firm, contains approximately 24,4
acres. Our Preliminary Drainage Study shows that the site will be divided
into three separate drainage areas upon completion of the street and lot
grading as shown on Exhibit "A".
Storm water runoff from Area "A" will flow in an easterly direction and will
be routed through the lots and streets to 50th Avenue where it will follow
the existing drainage pattern north along 50th Avenue and east to the West
Grapevine Laterial ditch.
Area "B" drains in a northwesterly direction toward the intersection of 20th
Street and the proposed West 20th Street Road. At this point, there are
two alternatives to off-site drainage. Alternate "A" would route the storm
water along 20th Street and into the east branch of Sheepdraw. Alternate "B"
would be to route the water north along the entrance road to Aims College
and into the West Grapevine Lateral ditch of into the West Greeley Drainage
System along 16th Street.
Area "C11 will drain in a westerly direction onto Clubhouse Drive where it
drains South to Highland Hills Golf Course and ultimately to the irrigation
reservoir.
It should be noted that this is a preliminary study and indicates only the
basic drainage pattern of the proposed site. The quantities involved and
the improvements required will be established in a final drainage study of
this site.

LAND USE AND DENSITY
T-UD
All uses as presently permitted in the "T" District by the official
Weld County Zoning Regulations except those "H", High Density Resi-
dential District uses permitted in said "T" District.
All other applicable regulations of said "T" District shall apply.
H-UD
All uses as presently permitted by the official Weld County Zoning
Regulations except that the density shall not exceed 12 units per
acre as presently permitted by City of Greeley R-1 PUD District.
All other applicable regulations of said "H" District shall apply.
R-UD
This area, except Lots 1 , 2, 3, 4, and 5 shall be used for the
following purposes : A single family residence plus the growing
grounds for the cultivation and the storage for nursery stock.
The excepted lots shall be used and developed in conformance with
the existing "R" District standards.
STREETS
Streets to be vacated include:
West 20th Street Road between 51st Avenue and 50th Avenue:
Tee Court:
A portion of West 20th Street Road and a portion of 50th Avenue Court.
The remaining streets and cul-de-sacs shall be paved, curbed and guttered
in accordance with applicable County and City of Greeley standards. A
landscaped divided median shall be provided on West 20th Street Road, as
replatted.
LANDSCAPING
Landscaping shall occur in the street median (trees approximately 40 foot
spacing and sodded turf) . Street trees shall be planted paralleling the
dedicated street with an average spacing of 70 feet. Where appropriate_,

landscaping shall be used to assist in screening view of parking lots from
adjacent streets. All trees used for lining streets shall have a minimum
caliper of 2 inches and a minimum height of 8 feet.
OPEN SPACE
Within the H-UD area, 40% of the area shall be retained for common usage of
the tenants.
OFF-STREET PARKING
T-UD Area: A minimum of one space shall be provided for each 200 square
feet of office space.
H-UD Area: A minimum of two spaces shall be provided for each unit.
SCHEDULE OF DEVELOPMENT
The various areas of the Highland Hills Official Development Plan shall be
completed in accordance with the following schedule:
Area A 3 years
Area B 10 years
Area C 3 years
Area D 5 years
Area E 10 years
Said areas shall be completed within the above described periods from the
effective date hereon approved by the Weld County Board of County Commissioners.
