RE: APPROVE AMENDED BYLAWS FOR ADULT PROTECTION COMMUNITY TEAM
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on June 19, 2017, the Board adopted the Bylaws for the Adult Protection
Community Team, and
WHEREAS, the Board has been presented with revisions to said Bylaws, and
WHEREAS, after review, the Board deems it advisable to amend said Bylaws, a copy of
which are attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the amended Bylaws for the Adult Protection Community Team, be, and
hereby are, approved.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 8th day of June, A.D., 2022.

Community Team Bylaw Revisions
Please review and indicate ifyou would like a work session prior to placing this item on the Board's agenda.
Request Board Approval of the Department's Area Agency on Aging Adult Protection (AP)
Community Team Bylaw Revisions. As required by Colorado Code of Regulations, the Director of each
County Department with ten (10) or more screened in reports of at -risk adult mistreatment and/or self -
neglect in the prior state fiscal year is required to establish or coordinate an Adult Protection Team. Weld
County meets this criteria and in 2017 the AP Team Bylaws were written per requirements in Colorado
Code of Regulations (12 CCR 2518-1), Section 30.830 (A) (Revised 01/30/17). The Department is now
requesting to revise the 2017 Bylaws as noted below:
• Membership (New Section) — Identifies who the membership team will consist of.
• Chairperson Duties — Added language to identify Chairperson duties on the AP Team.
• Team Structure — Clarifies how the AP Team meeting will be structured and identifies
confidentiality laws.
• Team Member Resignation and Termination (New Section) — Identifies what must occur when
an AP Team member resigns or is terminated.
These Bylaw revisions have been reviewed and approved by legal (C. Perry).
I do not recommend a Work Session. I recommend approval of these Bylaws.

Adopted on: by Weld County Adult Protection Team (herein referred to as
"Team") and the Weld County Department of Human Services (herein referred to as "WCDHS").
Purpose of the Weld County Adult Protection Community Team
The purpose of the Weld County Adult Protection Community Team (Team) is to serve as an advisory
body to the Weld County Department of Human Services (WCDHS), Adult Protective Services (APS) staff.
The Team will review the processes used to report and investigate mistreatment or self -neglect of at -risk
adults, review the provision of protective services for such adults, facilitate interagency cooperation,
and provide community education on the mistreatment and self -neglect of at -risk adults, as outlined in
Section 26-3.1-103(3), C.R.S.
The Team serves:
• To provide a forum for selected referrals and discussion of other agency and community services
for at -risk adults.
• To coordinate services and information as they relate to specific clients.
• To prevent duplication of services by networking and sharing information and resources.
• To promote interagency education by providing team members an opportunity to share
information regarding specific service areas of expertise.
• To review APS cases presented by the APS Caseworkers, for continued departmental and other
agency involvement and intervention during the assessment, investigation, and the on -going
case phase.
• To increase public knowledge of Adult Protection and the at -risk adult population by providing
community education on mistreatment and self -neglect of at -risk adults.
• To identify gaps in existing service systems.
• To review applicable regulations and policy changes that may impact at -risk adults.
• To establish and review protocols between agencies that serve at -risk adults.
Membership
Membership of the team will consist of representatives from various mandatory reporter professions
who are required to report mistreatment and neglect. This may include any person providing healthcare
or health-care related services including hospital and long-term care facility personnel, first responders,
counselors, social workers, home care staff, staff of human services, and staff of housing agencies.
Each team member will secure authority from their agency to act in an advisory capacity while serving
on the Team. Members may nominate an alternate from their own agency who must receive prior
approval by the Team. Team members are governed by APS statute (§26-3.1-101, C.R.S., et seq) and rule
(12 CCR 2518-1).
Team membership is voluntary. Members, whether serving in a permanent or consultative capacity, are
required to sign a confidentiality agreement, and are expected to strictly adhere to that agreement to
ensure the confidentiality of information within APS reports and cases in accordance with Section 26-
3.1-102(7), C.R.S. Permanent team members must sign the confidentiality agreement annually.

Consultative members must sign a confidentiality agreement at the beginning of each meeting they
attend.
Conflict of Interest
Conflict of interest refers to a situation in which a team member's or prospective team member's
personal or business interests have the potential to impair their judgment in carrying out their
responsibilities as a member of the Team. Team members may have an ongoing potential for conflict of
interest in APS cases, such as home health providers, or may have a case -limited conflict of interest,
such as a personal relationship with an APS client and/or client's family.
When it appears that a team member has potential conflict of interest that could raise questions about
the team member's impartiality during case review and planning, the team member will immediately
notify the APS Program Supervisor who may request the team member recuse themselves from staffing
the case in question.
Chairperson Duties
The Team Chairperson will be the Adult Protection Program Supervisor or a member of the Team who
may or may not be employed by the WCDHS. The Chairperson may volunteer, be appointed, or be
elected by the Team. The Team Chairperson may complete their duties or may delegate some or all of
the duties to other Team members. The Team Chairperson duties include:
• Providing input into the development of the meeting agenda
• Overseeing the meeting process and following the agenda
• Bringing pertinent protection issues to the Team's attention
• Maintaining the meeting structure and time schedule
• When/how a Team member may refer a case to the Team for review
• Ensuring development and delivery of required community educational events
• Initiating and monitoring membership letters of appointment and/or reappointment and
termination
• Administrative duties, such as:
o Drafting and updating team documents:
■ Bylaws
■ Confidentiality agreements
o Planning, organizing, and facilitating team meetings
o Notifying members of meeting schedules
o Summarizing cases for review
o Documenting Team activities in the APS data system
o Identifying appropriate training for Team members
o Soliciting feedback from the Team
Individual Members' Duties
Individual team members' duties include:
• Committing to at least one and a half (1.5) hours for each team meeting.
• Assisting with the development of team policies, goals, and objectives.

• Providing professional expertise and opinions as pertinent to each case brought for review.
• Educating other team members about their respective service systems.
• Assisting with identification of topics, planning, and development of community educational
events.
Team Structure
The team meeting will be structured as follows:
• Regular team meetings will be scheduled for one and a half (1.5) hours every other month.
• Emergency meetings may be called as needed to provide support, advice, and guidance to the
WCDHS.
• Confidentiality laws (§26-3.1-102(7), C.R.S.) will be followed at all times.
• Recommendations by the Team are advisory only and are not mandates to the WCDHS or any
agency.
• The Team may ask that updated information be provided at a later meeting related to a case
previously reviewed by the Team.
Terms of Office
Appointment will be for a period of two (2) years unless the member resigns. Each member will be
asked by the Team to recommit to team membership every two (2) years.
Team Member Resignation and Termination
• Team members resigning from the Team will provide written or verbal notice to the Team
Chairperson prior to the date of resignation.
• Whenever possible, the agency being represented by the resigning team member will designate
another representative from the agency to replace the resigning Team member.
• The WCDHS Director or Team Chairperson may request that a member resign and/or may
terminate membership for violating the terms of the Confidentiality Agreement, unprofessional
or unethical conduct, and/or other behaviors or issues determined to be inappropriate and not
conducive for the Team.
• When Team membership is terminated for violating the terms of the Confidentiality Agreement,
unprofessional or unethical conduct, and/or other behaviors or issues determined to be
inappropriate and not conducive for the Team, a written or verbal notice advising of this
decision will be provided to the Team member by the WCDHS Director or Team Chairperson.
