TO THE 1-3 (HEAVY INDUSTRIAL) ZONE DISTRICT — GARY LEE
A public hearing was conducted on January 12, 2022, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated November 9, 2021, and duly published
November 12, 2021, in the Greeley Tribune, a public hearing was conducted to consider the
request of Gary Lee, for a Change of Zone, COZ21-0007, from the A (Agricultural) Zone District
to the 1-3 (Heavy Industrial) Zone District. Bob Choate, Assistant County Attorney, made this a
matter of record.
rv. = Angela Snyder, Department of Planning Services, presented a brief summary of the proposal,
described the site location, and the existing residence on the location and its proposed future use.
Ms. Snyder explained this request meets all five (5) criteria requirements for the proposal, which
are: The Comprehensive Plan, compatibility, water and sewer, adequate streets, and compliance
with standards. She explained no responses were received from Notices sent to surrounding
property owners (SPOs), which emphasized the ability to meet the compatibility criteria. She
relayed there were no concerns addressed regarding the water and sewer and explained the site
utilizes a septic system for wastewater services. Ms. Snyder described East 16th Street, which is
designated on the 2011 Greely Transportation Plan as a minor arterial, and a local road with
60 feet of right-of-way on the Weld County Functional Classification Map. Ms. Snyder described
the access onto East 16th Street, and explained obtaining an Access Permit would not be a
problem. She stated based on the Traffic Narrative submitted, the county road facilities providing
access to the property are adequate and functional. Ms. Snyder stated the site is located within
the Airport Overlay District, and any future development requests will be sent to the airport for
review. Ms. Snyder entered the favorable recommendation of the Planning Commission into the
record as written and displayed images of the site and surrounding views.

_ 1 Lauren Light, Department of Public Health and Environment, stated the site is currently
served by the North Weld County Water District and there is a septic system that is permitted for
three (3) bedrooms. Additional items such as on -site dust and waste will be addressed during the
Site Plan Review. She stated there are several note suggestions for the plat related to water,
septic and industrial development and relayed there are no outstanding issues with this request.
Gary and Cheryl Lee, applicants, had no comments.
No public testimony was offered concerning this matter.
The Board reviewed the Conditions of Approval and Development Standards and made no
changes.
In response to Chair James, Mr. and Mrs. Lee indicated they had reviewed, and agreed to
abide by, the Conditions of Approval. Commissioner Freeman commented this request is an
example of why the Code changes were made, to get industrial sites where they belong.
Commissioner Freeman moved to approve the request of Gary Lee for a Change of Zone,
COZ21-0007, from the A (Agricultural) Zone District to the 1-3 (Heavy Industrial) Zone District,
based on the recommendations of Planning staff and the Planning Commission, with the
Conditions of Approval, as amended. The motion was seconded by Commissioner Saine, and it
carried unanimously. There being no further discussion, the hearing was completed at 10:27 a.m.
This Certification was approved on the 26th day of January, 2022.
