Chapter 20
Sec. 20-1-60. Imposition of fee.
B. Fee schedules. Any person who causes the commencement of development, except those persons exempted or
preparing an Independent Fee Calculation Study pursuant to Section 20-1-80 below, shall pay impact fees in
accordance with the fee schedules below, which will be adjusted annually for inflation.
C. Inflation adjustment. The Board of County Commissioners shall consider adjusting each fee amount in this
Section by the rate of inflation. The rate of inflation shall mean the percentage change from the prior calendar
year in the United States Bureau of Labor Statistics Consumer Price Index for Denver -Boulder -Greeley, all items,
all urban consumers or its successor index. Fee changes resulting from an inflation adjustment shall take effect
on or after January 1st

Health: They will be submitting their changes in October as a part of the budget process but separate as they are
approved by Resolution and not included in the code changes.

32. Staff time for applicants or constituents that
propose novel uses or development that does not fit
into established fee categories where staff will spend
4 or more hours of review, oversight or assistance.
The hourly rate shall be calculated on a full cost
recovery basis of the County's costs for the staff
positions involved in the assistance. The full cost
recovery rate shall be determined by the Director of
Finance and Administration and shall include salary,
fringe benefits, support costs (services and supplies)
and indirect costs calculated in accordance with the
County -wide cost allocation plan per Federal OMB -87
methodologies.
Constituents shall deposit the estimated amount of
the costs prior to assistance. The County will draw
upon it based on the standard hourly rate for each
staff providing the review, oversight or assistance.

APPENDIX 5-E RATES FOR CLERK TO THE BOARD
TRANSCRIPTS FROM TAPES:
IF TRANSCRIBED IN-HOUSE: $60.00/hour for time spent on the transcription, plus $4.00 per page. (Provides
two (2) certified copies of transcript to requestor.) Minimum charge of $60.00, with a deposit of three (3) times
the clock time of the tape to be paid in advance, with balance payable prior to receipt of transcript. Transcripts will
be completed as staff time is available. Fee nonrefundable. No deadline will be assured.

Sec. 20-1-60. Imposition of fee.
B. Fee schedules. Any person who causes the commencement of development, except those persons exempted or
preparing an Independent Fee Calculation Study pursuant to Section 20-1-80 below, shall pay impact fees in
accordance with the fee schedules below, which will be adjusted annually for inflation.
C. Inflation adjustment. The Board of County Commissioners shall consider adjusting each fee amount in this
Section by the rate of inflation. The rate of inflation shall mean the percentage change from the prior calendar
year in the United States Bureau of Labor Statistics Consumer Price Index for Denver -Boulder -Greeley, all items,
all urban consumers or its successor index. Fee changes resulting from an inflation adjustment shall take effect
on or after January 1St.

I reviewed the statutes and Criminal Justice Record Act fee statute is less prescriptive than the CORA fee statute, so the
SO fees can stay as they are and do not need to match the change to 33.58 in the CORA fees. The body camera and
evidentiary video are also governed by the CCJRA so if the SO doesn't want to change fees, they are fine the way they
are.

I would recommend that for Appendix 5-O, we check with the County Attorney to see if we need to consider
changing the cost for "Redaction/Extended Research/Retrieval" to mirror item 6 in Appendix 5-D;
The actual cost up to $33.58 per hour of time spent by custodian's staff performing such research and retrieval;
however, first hour of time spent is free and custodian must be paid the estimated cost prior to custodian's staff
commencing such research and retrieval (C.R.S. § 24-72-205(6)(a), effective July 1, 2019); I believe our current
charges may be out of alignment with CRS § 24-72-205(6)(a).
The same consideration should be made for "Copies of photos, CD/DVD, media" and "Body Worn Camera or Evidentiary
video retrieval", since they both reference they are subject to CORA and CCJRA.
If legal believes we are in compliance with statute, then I would recommend we make no changes to our fees for 2023. I
have copied Karin, so she can weigh in on this topic.

fees for your department or office in Appendix 5-D and 5-O of the Weld County Code to determine if any fees need to be
updated for 2023 at:

WE usually try to have the first reading in early November, so it is all done in time for the January 15` effective date. We
should have all the info to do it by the end of the budget work session in October, so we can have first raeding in early
November.

I have a couple of minor technology/terminology changes that I'm working on, but in the interim, can we go over timing
of the Ordinance?
Commissioner Same requested to approve the fees prior to consideration of the Final Budget I'd like to work with
Cheryl to get the three readings slated and then I can work on getting the various Appendix edits drafted as the
proposals come through to you Have you two discussed specific dates? I'm thinking we want the Final Reading to be
sometime before December 14th

As mentioned in May, we are including the 2023 Fee Updates as a part of the budget process this year Please review the
fees for your department or office in Appendix 5-D of the Weld County Code to determine if any fees need to be
updated for 2023 at

If any of them need to be changed, please notify me by email by Friday, August 5, 2022 A response indicating no
changes would also be appreciated If there are changes for the 2023 year, a new fee ordinance will be drafted and put
on the Board of County Commissioners' agenda in order to have three readings between October and December 2022,
to be effective January 1, 2023
